WHEREAS, by Resoluti#n Numbers 1811, 18249 1820, 1803, 1312, 1807, 1823, 1808, 1825, 1809, 1821, 1822, 1819 duly adopted on March 19, 1957, May 14, 1957, and Yarch 12, 1957, by the Board of Commissioners of the City of Salina, Kansas, have declared that they deem it necessary to curb, gutter, pav' and grade Cloud Street (thirty-seven (37) feet wide from back: of curb to back of curb) with two (2) inch hot asphalt mix_ over a six (6) inch crushed rock base, from the west line of Broadway Boulevard to the east right-of-way line of the !Missouri Pacific Railroad; curb, gut er, pave and grade Cloud Street (thirty-seven (37) feet wide from back of curb to back of curb with two (2) inch hot asphalt mix over a six (6) inch crushed rock base,[ from the east line of the Missouri. CONSOLIDATED-SNUNA i 1 WHEREAS, said resdlutions were published in The Salina Journal for six days, a daily newspaper, published in said City, and being the official city paper, and the majority of,the resident property owners owning a majority of square feet of the lots or real eattte liable to taxation for the cost of said improvement did not within twenty days from the date of the last publication thereof file with the City Clerk sufficient propest in writing against the making of said improvement, no protests of any kind having been filed, SO, NOW THEREFOREi BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That it is necessary and it is hereby ordered that Cloud Street from the west line of Broadway Boulevard to the east right of -way line of the Missouri Pacific Railroad, in said ity, be curbed, guttered, paved and graded to the established paving grade and paved between the guttering lines thereof. Section 2. That it is necessary and it is hereby ordered that Cloud Street from the east line of the Missouri Pacific Railroad right-of-way to the west line of Westwood Rodd, in said city, be curbed, guttered, paved and graded to the established paving grade and I paved between the guttering lines thereof. Section 3. That it is necessary and it is hereby ordered that Dover Drive from the south end of Dover Drive to the south side of Cloud Street, in said city, be curbed, guttered,', paved and graded to the established paving grade and paved between the guttering lines thereof. Section 4. That it is necessary and it is hereby ordered thatFourth Street from the south line of South Street to the north line of Center Street, in said city, be curbed, guttered, paved and graded to the established paving grade and paved between the guttering lines thereof. Section 5. Th t itis necessary and it is hereby ordered that Kansas Avenue from the south line of Johnson Avenue to the north line of Iron Avenue, in said City, be curbed, guttered, paved and graded to the established paving grade and paved between the guttering lines thereof. Section 6. Tat it is necessary and it is hereby ordered that Kansas Avenue from the south line of Ash Street to the south line of Johnstown Avenue, in said city, be curbed, guttered, paved and graded to the established paving grade and paved between the guttering lines thereof. i Section 7. Th�t it is necessary and it is hereby ordered that Manor Road from the east line of Roach treet to the west line of Ohio Street, in said city, be paved and graded to the established awing grade and paved between the guttering lines thereof. Section 8,0 That it is necessary and it is hereby ordered that Prescott Road from the center line of Guernsey Drive to the cente r line of Roach Street, in said city, be curbed, guttered, and graded to the established paving grade and Vith such excavation as may be necessary therefor or the completion of said work. That it is necessary and it is hereby ordered that Pearl Street from the i north line of RepUblic Avenue to the south line of Martin Avenue, in said city, be paved and graded to the established paving grade and paved between the guttering lines thereof. Section 10. (That it is necessary and it is hereby ordered that Roach Stbeet from the center line of Prescott Road to the center line of Crawford Avenue, be curbed, guttered and graded to the established paving grade and paved between the guttering lines thereof. Section 11. (That it is necessary and it is hereby ordered that Winona Street from the west line of Westwood Road to the east line of Dover Drivg, in said city, be curbed, guttered, paved and graded to the established paving grade and paved between the guttering lines thereof. Section 12. That it is necessary and it is hereby ordered that Lewis Avenue from the north line of Mellinger Drive to the south line of Manor Road, in said city, be curbed, guttered, paved anis graded to the established paving grade and paved between the guttering lines thereof. Section 13. hat it is necessary and it is hereby ordered that Westwood Road from the south line of Cloud Street to the north line of Winona Streetkn said City, be curbed, I guttered, paved and graded to the established paving grade and paved between the guttering lines thereof. Section 14. That for the work and improvements herein provided for the City Engineer shall make and file with the City Clerk on or before the 9th day of July, 1957, complete plans and specifications for the curbing, guttering, paving and grading with excavation necessary therefore, of the streets described in Sections 1 to 13 of this ordinance, with the following type of improvements: Concrete combined curb and gutter on each side thereof 30 inches wide from back of curb to having line, curb 12 inches deep at back, gutter 6 inches deep, and the necessary grading of each to the established paving grade between the curb and gutter lines on each side thereof and within the limits of said street, as herein before described; and the necessary grading of each to the established paving grade, and the paving thereof, with two -inch hot mixed asphalt concrete over a aix — inch crushed rock stabalized base. and said Engineer si4all on or before the same date, submit to the Board of Commissioners under oath, detailed estimates of the cost of such work and improvements. Section 15. That after such plans and specifications have been made and prepared by the City Engineer and filed with the City Clerk as aforesaid, the Board of Commissioners may advertise by advertisement published in the official city paper of the City of Salina, Kansas- for three consecutive days for the receipt of sealed proposals for the improving of said streets with the kind of material named and specified in the preceeding section hereof, and for the excavation andrads g ng necessary for the completion of such work and after the ri CON SOLIDATED-S!V..SIYA i I receipt of such proposals, the said Board of Commissioners may and are hereby authorized and directed to let contracts for the improving of said streets with the materials selected by them to the lowest responsible bidder or bidders therefor, as determined by said Board of Commissioners, and for such excavation and grading, Said Board reserves the right to I reject any and all bids. Section 16. That for the improving of the above mentioned streets, such assessments shall be made for the full cost thereof according to law, on all lots and pieces of land to the center of the block on either side of the street to be improved according to the appraisers valuation thereof, without regard to the buildings or improvements thereon for the distance to be improved. Section 17. That after the passage and publication of this ordinance, the Board of Commissioners shall appoint three disinterested appraisers, householders, who after having i taken an oath to make a true and impartial appraisement of all lots and pieces of land i liable to assessment and taxation as aforesaid, as may be designated by the Board of i Commissioners of said City, without regard to the buildings or improvements thereon and after making such appraisement shall return to the Board of Commissioners of the City of Salina, and said Board of Commissioners shall designate a time and place for the hearing of any complaints' i that may be made as to the value of any lots and pieces of land appraised as aforesaid, of which I due notice shall be given in the official City paper, at which hearing the Board of Commissioners may alter any valuation of any lot or piece of land, if, in their opinion the same has been appraised too high or too low. Section 18. That for the purpose of paying the cost of the work and improvements i in this ordinance provided for, the Board of Commissioners are hereby authorized and directed to issue Internal Improvement Bonds of the City of Salina in an amount not to exceed the i contract price or cost of such improvements and to run for a period of ten years and be payable in ten equal installments,together with interest not to exceed five per cent (5%) per annum, which bonds shall be made payable at the Fiscal Agency of the State of Kansas and for the purpose of paying the principal and interest on said bonds as they severally become i i due and payable, the Board of Commissioners shall apportion and assess against the lots and pieces of land within the taxing district of such improvements special assessments covering I the cost of such improvements and the apportionment herein contained shall hold good for all j of the installments that are to be collected from the specific property chargeable with said improvements, such assessments and apportionment ordinance shall contain the total amounts of tax apportioned to each tract, piece or parcel of land within the taxing district and t shall state the number of annual installments in which such tax is to be collected; and thereafter the City Clerk shall annually at the same time other taxes are certified, certify I to the County Clerk of Saline County, Kansas a full list of all property liable for such I work and improvements, together with the respective amounts due on each of said tracts pieces i 1 1 1 or parcels of land, which amounts shall include the annual installments and interest on all I unpaid balances f r one year ht the rate of not to exceed five per cent per annum on such amounts so certif ed which shall be colleeted as other taxes are collected, PROVIDED, hhat for the purposeo defraying the cost of improving the intersections and areas formed by the crossing of s reets and alleys, and for the grading of said streets where the same is provided for in t 's ordinance as well as where the improvement is through or adjacent to property of the City for which the City is fable, the assessment will be made against I all taxable grope ty of the City and paid by the City at large.
