AN ORDINANCE cond mning an easement in certain land within Saline County, Kansas, for the
use of the City of Salina, Kansas, in constructing, extending, installing and maintaining
a certain eanita sewer force main across Tracts Seven (7) and Eight (8) of the Subdivision.
of the Thos. White Farm located in Section Seven (7), Township Fourteen (14) South, Range
Two (2) West of the Sixth Principal Meridian, Saline County, Kansas, and providing for the
payment thereof.
WHEREAS, the governing body of the City of Salina, Kansas, at its regular meeting on the
4th day of June, 957, by Resolution Number 1849, found tt necessary to appropriate an
easement in certain private property in Saline County, Kansas, for the use of said City @or
the construction, extension, installation and maintenance of a certain sanitary sewer force
main across Tracto Seven (7) and Eight (8) of the Subdivision of the Thos. White Farm located
in Section Seven (7), Township Fourteen (14) South, Range Two (2) West of the Sixth Principal;
Meridian, Saline County, Kansas, and directed the City Engineer of Salina, Kansas, to file a'
survey and description of the easement so required; and
WHEREAS, on the llh day of June, 1957, a survey and description of the land so required was;
duly filed with the City Clerk, S0, NOW THEREFORE,
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
Section 1. The following described easement is hereby condemned and appropriated for j

installation and maintenance of a certain sanitary sewer fmuce main across Tracts Seven (7)
and Eight (8) of the Subdivision of the Thos. White Farm located in Section Seven (7),
Township Fourteen (14) South, Range Two (2) West of the Sixth Principal Meridian, Saline County,
Kansas, to -wit:
A permanent easement for the construction, extension, installation and maintenance of a
sanitary sewer forge main across Tracts Seven (7) and Eight (8) Of the Subdivision of the
Thos. White Farm located in Section Seven (7), Township Fourteen (14) South, Range Two (2)
West of the Sixth Principal Meridian, Saline County, Kansas, and described as follows:
A tract of land twenty (20) feet in width, the center
line beginning on the west line of tract Seven (7) and
Two Hundred Fifty (250) feet north of the southwest
corner of Tract Seven (7) thence in a northeasterly
direction across tract Seven (7) and Tract Eight (8)
to a point on the east line of Tract Eight (8); said
point being fifty (50) feet south of the northeast
corner of tract Eight (8). The Length of the center
line of said easement being one Thousand five hundred
fifty (1550) feet pore or less.

A construction Easement for the construction, extension,
installation and maintenance of a sanitary sewer force
main across Tracts Seven (7) and Eight (8), of the Subdivision
of the Thos. White Farm located in Section Seven (7),
Township Fourteen (14) South, Range Two (2) West of the
Sixth Principal Meridian, Saline County, Kansas, and
described as follows:
A tract of land One Hundred (100) feet in Width, the
center line being on the west line of Tract Seven (7) and
two Hundred fifty (250) feet north of the southwest
corner of Tract Seven (7), thence in a northeasterly
direction across Tract Seven (7) and Tract Eight (8) to
a point on the east line of Tract Eight (8); said point
being fifty 50) feet south of the northeast corner of said
Tract Eight 8). The length of the center line of said easement being
one thousand five hundred fifty (1550) feet more or less.
This easement excepts the permanent easement of Twenty (20)
feet in width and described above. The termof the construction
easement to be from October 1, 1957 to October 1, 1958.

Section 2. hat Rudolph Barta, City Attorney, is hereby ordered to forthwith prepare
and present in the name of the Board of Commissioners of the City of Salina, Kansas, a
written application to the Judge of the District Court of Saline County, Kansas, praying
for an order appointing cormnissioners to make appraisement and assessment of damages arising)
for the taking and condemnation of said easement in said real estate descrIbbed in Section 1
hereof, and do and perform all things in and about procuring and recording of said order of
appointment as required by law.
Section 3. That for the payment of the cost thereof, the Board of Commissioners shall
issue general obligation and improvement bonds of the City of Salina, Kansas, in an amount
not to exceed the total cost of such work and improvements, except as herein provided, to bei
payable in ten appproximately equal installments and to bear interest at not to exceed five
(5%) per cent per (annum and from the date of such bonds, and for the purpose of paying such
bonds and interestlas they severally mature, the Board of Commissioners shall annually levy
a tax upon all real and personal property in the City of Salina, Kansas, in an amount
sufficient to pay the annual installments of such principal and interest, and that panding
the issuance of such bonds, temporary notes shall be issued according to law, to pay the cos'
of such work.
Section 4. This ordinance shall take effect and be in force from and after its
publication in the official city paper.
