AN ORDINANCE ratifying and confirming a contract with 0. D. Wilmoth Construction Company
for the construction of certain sidewalks in the City of Salina, Kansas, heretofore
designated as Engineering Job Number 362, and providing for the issuance of temporary notes
to pay the cost thereof, pending issuance and sale of bonds.

BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
Section 1. That the acceptance of the City of Salina, Kansas, of the proposal of 0. D.
Wilmoth Construction Company, hereinafter referred to the "Contractor" as submitted to the

Board of Commissioners on June 4, 19579 which is hereby found to be the lowest and best bid
jfor such work, and the contract awarded by the Board of Commissioners of said city to said

contractor and signed on behalf of the City by its Mayor on June 11, 1957, for the
i
construction of certain public improvements in the City of Salina, Kansas, to -wit:
West parking of Second Street in said city and abutting
iLot 4, Block 2, Van Trines Addition.
South parking of Prescott Avenue in said City and abutting Lots 1, 2,
3 and 49 Block 2, Van Trines Addition.
East parking of Thirej Street in said city and abutting Lot 1, Block 2

at and for the unit price for said work contained in said proposal, which proposal and
contract are hereby referred to and made a part of this ordinance, be and the same is hereby
ratified and confirmed, said proposal being within the estimated cost of said improvements
as shown by the sworn estimates of the City Engineer on file in the office of the City
Clerk, which estimate is hereby referred to and made a part of this ordinance.
Section 2. Said improvements shall be built and constructed in accordance with the
plans and specifications therefore prepared by the City Engineer on file in the office of
the City Clerk and in accordance with the proposal of said contractor and under the terms
of said contract, all of which are hereby referred to and made a part of this ordinance.
Section 3. That temporary notes signed by the Mayor and attested by the City Clerk be
issued from time to 'time as the work progresses in the manner and form as required by law,
the total amount thereof not to exceed the contract price of $242298.85 for such wont, such
notes to bear interest at not to exceed 5 per cent per annum and to mature not latter than
June 1, 1958, and to be issued in such amountsand at such times as may -the money for the
payment of the cost of such work be required, such notes to be issued to said contractor
and to be redeemed and cancelled at the time that Internal Improvements Bonds are issued
in lieu thereof.
Section 4. That this ordinance shall take effect and be in full force from and after
its publication once in the official city paper.
