AN ORDINANCE relating to and apportioning and levying special assessments on certain lots and:,
pieces of ground in the City of Salina, Kansas, to pay the cost of paving and grading
Charlotte Street with concrete (twenty-eight (28) feet wide from toe of gutter tO toe of gutter)
from the east line,of Gebhart Street to the west line of Fourth Street; curbing, guttering
and grading of Crawford Avenue, on the north side, from the center line of Viemont Avenue west
to the City Limits;paving and grading of Connecticut Street with concrete (twenty-eight (28)!
feet wide from toe of gutter to toe of gutter) from the north line of Gypsum Avenue to the
north line of Stapler Avenue; paving and grading of Eleventh Street with concrete (twenty-
eight (28) feet wide from toe of gutter to toe of gutter) from the south line of Jewell Avenue
to the north line bf Kirwin Avenue; paving and grading of Grand Avenue with concrete (twenty-
eight (28) feet wide toe of gutter to toe of gutter) from the west line of Thirteenth Street
to the center line of Broadway Boulevard; paving and grading of Haven Avenue wihh concrete
(twenty-eight (28) feet wide toe of gutter to toe of gutter) from the east line of Viemont
Avenue to the west line of Whittinghill Avenue; curbing, guttering and grading of the west
side of Roach, from the center line of Carl Avenue to the center line of Leslie Avenue;
paving and grading of Sherman Street (twenty-eight(28) feet wide toe of gutter to toe of
gutter) with concrete from the north line of Republic Avenue to the north line of Wilson
Street; paving and grading of Sherman Street with concrete (twenty-eight (28) feet wide toe ii

of gutter to toe of gutter) from the north line of Franklin Street to the south line of
Wilson Street; paving and grading of Tenth Street with concrete (twenty-eight (28) feet wide
toe of gutter to toe of gutter) from the south line of Pacific Avenue to the center line of
Broadway Boulevard; paving and grading of Twelfth Street with concrete from the south line
of Washington Street to the norhh line of Prescott Avenue; and realting to and providing
for the collection and payment of such assessments.
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
Section 1. For the purpose of paying for that part of the cost of improvements in
certain portions of certain streets as hereinafter set forth in the following sections of
this ordinance which is chargeable in the provate property in the assessment districts for each
of such improvements, respectively, as set forhh in the following sections of this ordinance
with respect to each of such improvements, there are hereby levied and assessed on the
property liable, respectively, to the middle of the block for the distance improved with
respect to the improvements mentioned in Sections 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12 of this i
ordinance, according to the appraised value of such lots and pieces of ground with respect to each

improvement, without regard to the building or improvements thereon, special assessments
covering the cost of such work and improvements, said special assessments being based on the
special valuation and appraisement of said lots and pieces of ground heretofore made by
three disinterested appraisers appointed by the Board of Commissioners of the City of Salina,
Kansas, with respect to each such improvement, which said appraisments are hereby referred to
and made a part of this ordinance, and the several amounts so levied, apportioned and
assessed against the lots and pieces of ground for each such improvements, respectively, for
the purpose aforesaid, are hereby found and determined to be the amounts set forhh in the
following sections of this ordinance with respect to each of said improvements,

Section 2. For that part of the cost of paving and grading of Charlotte Street
with concrete (twenty-eight (28) feet wide from toe of gutter to toe of gutter) from the
east line of Gebhart Street to the west line of Fourth Street, which is chargeable against
the private property within the district chargeable therefor, and which cost is hereby
determined to be $2,214.14, there is hereby levied, apportioned and assessed against the

Section 13. Said amounts so levied, apportioned and assessed as af6resaid will be due

and collectible in ten equal installments, the first becoming due with the taxes levied
i
for the year 1957, and one of said installments falling due each and every year thereafter
until all are paid and all to be collected with interest as in this ordinance provided,
HOWEVER, that the owner of any piece of property liable for any such assessment may redeem
i
his property from such liability by paying to the City Treasury the entire amount chargeable
against the same, as in this ordinance provided, at any time within thirty days after the
publication of this ordinance and before the issuance of bonds of said city in payment of thele
balance of the cost of said improvements, the property so paid on shall not hereafter be
liable for any further assessments for the.cost of said improvements nor for any part of said
bonds.

Section 14. 'Deere is hereby levied further and assessed against such lots and pieces of
ground described in this ordinance, interest at such rate per annum as shall be borne by the 1
bonds hereafter to,be issued for the payment of the remaining unpaid cost of such improvement's,
to be hereafter d4exvdned and fixed by ordinance when such bonds are issued, on all of said
installments mentioned and provided for in this ordinance, from the date of the bonds which
may be issued at the end of thirty days as specified in the preceding sections thereof, as by,
law provided, to the time of the collection of the installment as provided by law, which said,,
interest shall be collected annually at the same time and in the same manner as said install -I
ments are collected and after the taking effect of this ordinance and the fixing of the said
interest rate whensuchbonds are authorized and issued, it shall be the duty of the City Cle$-k
of said City to an�Yally at the same time other taxes are certified and until all of said
assessments so apportioned and levied have been certified to the County Clerk of Saline Counter,
Kansas,a full listlof all property liable to assessment and taxation for such work and improv�-

went, except such property on which the special assessments aforesaid have been paid in full �s
hereinbefore provided, together with the respective amounts due on each of said lots and
I
pieces of ground which amounts shall include the annual installments of such special assessments
together with the interest for one year at the rate to be fixed as provided for in this
ordinance, an all unpaid balances of such assessments, and such amounts so certified as
herein provided shall be placed upon the tax roll by the County Clerk of Saline County, Kansas,
and collected as other taxes are collected.
Section 15. this ordinance shall take effect and be in force from and after its publication
once in the official city paper.
