6145 Levy AssessmentsCONSOLIDATED -SAUNA OIWINANCE NUMBER 6145 (Published in!the Salina Journal �`%�(4 , 1957) j AN ORDINANCE RElatiing to and apportioning and levying special assessments on certain lots and pieces of ground in the City of Salina, Kansas, to pay the cost of paving and grading of Ellsworth Avenue (twenty-eight (28) feet wide from toe of gutter to toe of gutter) with two 22} inch hot asphalt mix over a six (6) inch rolled rock base, from the west line of Sunrise Drive to the east line of Norton Street; curbing, guttering and paving and grading of Morrison Avenue '(thirty-three (33) feet wide from back of curb to back of curb) with two (2) inch hot mix over a six (6) inch crushed rock base, from the east line of Montrose to the west line of College Avenue; curbing, guttering, paving and grading of Twelfth Street (thirty- three (33) feet wide back of curb to back of curb) with two (2) inch hot asphalt mix over a six (6) inch crushed rock base, from the north line of Broadway Boulevard to the south line of Woodland Avenue; curbing, guttering, paving and grading of Twelfth Street (thirty-three (33) feet wide from back of curb to back of curb) with two (2) inch hot asphalt mix over a six (6) inch rolled rock base, from the south line of Woodland Avenue to the north line of Pacific j Avenue, curbing, guttering, paving and grading of Woodland Aaenue (thirty-three (33) feet wide back of curb to back of curb) with two (2) inch hot asphalt mix over a six (6) inch crushed rock base, from the west line of Broadway Boulevard to the west line of Twelfth Street; paving and grading of Antrim Avenue (titenty-eight (28) feet wide toe of gutter to toe of guttler) with two (2) inch hot asphalt mix over a six (6) inch rolled rock base, from the east line of!' Ninth Street to the'west line of Eighth Street, and relating to and providing for the collection and payment of suchassessments. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. For the purpose of paying for that part of the cost of improvements in certain portions of certain streets as hereinafter set forth in the following section of this ordinance which is chargeable to the private property in the assessment district for such I improvements as set, forth in the following sections of this ordinance with respect to such improvements there are hereby levied, and assessed on the property liable therefor, being all the lots and pieces of ground lying on either side of said street so improved, to the middle of the block for the distance improved, with respect to the improvements mentioned in Section 2, 3, 4, 5, 6, and 7 of this ordinance, according to the appraised value of such lots and pieces of ground with respect to such improvements, without regard to the buildings or improvements thereon, special assessments covering the cost of such work and improvements, said special assessments being based on the special valuation and appraisement of said lot and pieces of ground heretofore made by three disinterested appraisers appointed by the Board of Commissioners of the City of Saliba, Kansas, with respect to such improvements, which said appraisement is hereby referred to and made a part of this ordinance, and the several amounts so levied, apportioned and assessed against the lots and pieces of ground for such improvement, for the purpose aforesaid, and hereby found and determined to be the amounts set forth in the following sections of this ordinance with respect to each of said improvements. Section 2. S4id amounts so levied, apportioned and assessed as aforesaid shall be due I and collectible inl'ten equal installments, the first being due with the taxes levied for the year 1957, and one'of said installments falling due each and every year thereafter until all are paid, and all to be collected with interest as in the ordinance provided, However, that the owner of any piece or pieces of property liable for any such assessment may redeem his property from such liability by paying into the City Treasury the entire amount chargeable against the same, as in this ordinance designated, at any time within thirty days after the publication of this ordinance and before the issuance of bonds of said city in payment of the! balance of the cost of said improvements, the property so paid on shall not thereafter be liable for any further assessments for the cost of said improvements nor for any part of said bonds. There is hereby levied further and assessed against such lots and pieces of, ground described in this ordinance, interest at such rate per annym. as shall be borne by the: bonds hereafter to be issued for the payment of the remaining unpaid cost of such improvements, to be hereafter determined and fixed by ordinance when such bonds are issued, on all of said: installments mentioned and provided for in this ordinance, from the date of the bonds which may be issued at the end of thirty days as specified in the preceding sectiona hereof,as by law provided, to the time of the collection of the installment as provided by law, which said interest shall be collected annually at the same time and in the same manner as said install- ments are collected and after the taking effect of this ordinance and the fixing of said interest rate when such bonds are authorized and issued, it shall be the duty of the City Clerk of said city to annually at the same time other taxes are certified and until all of said assessments so apportioned and levied have been certified to the County Clerk of Salina.. County, Kansaf, a full list of all property liable to assessment and taxation for such work and improvement except such property on which the special assessments aforesaid have been paid in full as hereinbefore provided, tbgether with the respective amounts due on each of such lots and pieces of ground which amounts shall include the annual installments of such special assessments together with the interest for on a year at the rate to be fixed as provided for in this ordinance, on all unpaid balances of such assessments, and such amounts iso certified as herein provided shall be placed upon the tax roll by the County Clerk of Salina County, Kansas, and collected as other taxes are collected. Section 10. This ordinance shall take effect and be in force from acid after its adoptions and publication once in the official city paper.
