AN ORDINANCE relating to and apportioning and levying special assessments on certain lots and,'
pieces of ground in the City of Salina, Kansas to pay the cost of construction of Main
Sanitary !lower District "AD" add. Lateral Sanitary Sewer Districts Numbered 354, 355, and 356,
and relating to and providing for the collection and payment of such assessments.

BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
Section 1. That for the purpose of paying for the cost of building and constructing
Main Saxi.tary Sewer District "AD" and Lateral Sanitary Sewer Districts Numbered 354, 355,

and 356 and as authorized by the provisions of Ordinance Numbers 6115 and 6119, the cost of
which has been duly ascertained as shown by the City Engineer's final estimate of cost, which
has been duly approved by the Board of Commissioners, there are hereby levied and assessed

on the property liable therefor, being all the lots and pieces of ground lying in the sewer

district mentioned above as created by Ordinances 6115 and 6119, according to the appraised
value of such lots and pieces of ground without regard to the buildings or improvements
thereon, special assessments covering the cost of such improvements constructed in said
sewer district, said special assessments being based on the special valuation and appraisemeO
made by three disinterested appraisers appointed by the Board of Commissioners of the City of;
Salina, Kansas, which said appraisement is hereby referred to and made a part of this ordinance
and the several amounts levied, and apportioned against the cost of improvements constructed

in such district being hereby found and determined to be as set forth in the fbllovi ng sections
of this ordinance.
Section 2. That for the purpose of the payment of the cost of construction of Main
Sanitary Sewer "AD"y a ten inch clay pipe sewer beginning at a manhole that will be constructed
at the end of Branch 1, Lateral Sewer 354, which will be 101 north of the center line of
Wayne Avenue, and the center line of first easement west of Norton Avenue, thence west along
a line 101 north of the center line of Wayne Avenue to a point 101 east of the center line of
Highland Avenue which will be terminus of Main "AD", the amount levied, apportioned and
assessed against the lots and pieces of ground in said district are found and determined to
be as follows:

20 feet west of an existing manhole which is 20 feet east of the west line of Norton Street and 52
feet south of the north line of Leslie Avenue; thence west 128.1 feet where a manhole will be
built; thence south along a line which is one foot west of the east line of eas*m ht for
utilities to the center line of Wayne Avenue where a manhole will be built which will be the
terminus of Branch 1 of Lateral 354, Branch 2. a ten inch clay pipe sewer beginning at a 10
inch stub line 40 feet east of an existing manhole which is 20 feet east of the west line of
Norton Street and 52 feet south of the north line of Leslie Avenue; thence east 141.6 feet where
a manhole will be built; thence south with an eight inch clay pipe sewer one foot west of the (east
line of the easiment for utilities to the center line of Wayne Avenue where a manhole will be
built which will be, the: terminus of Branch Q of Lateral 354, the amount levied, apportioned

Section 6. Said amounts levied, apportioned and assessed as aforesaid shall be due
acid collectible in Ten equal installments, the first becomming due with the taxes levied
for 1957, and one of said installments falling due each and every year thereafter until all j

are paid, all to be collected with interest as in this ordinance provided for, however, that!
I
the owner of any piece or parcel of property liable for any such assessment may .redeem his j
property from anyisuch assessment liability by paying into the City Treasury the entire
I
amount chargeable against the same as in phis ordinance designated at any time ltithin thirty!
days from the publication of this ordinance, and before the issuance of bonds of said city,

in payment of the cost of said improvements, and his property so paid shall not thereafter
be liable for any further assessment for the cost of said improvements nor for any part of
said bonds.
Section 7. Where is hereby levied and assessed further against such lots and pieces
of gvound as described in this ordinance., interest at such rate per annpm as shall be borne
by the bonds herealfter to be issued for the payment of the remaining unpaid cost of such
improvements, such; rate to be hereafter determined and fixed by ordinances when such bonds are
issued, on all of 'said installments mentioned and provided for in this ordinance, fnaal the
date of the bonds which may be issued at the end of thirty days, as wpecified in the
preceding section hereof as by law provided, to the time of collection of the last installment
as provided by law, which said interest shall be collected annually at the same time and in the
same manner as said installments are collected, and after the taking effect of this ordinance
and the fixing of 'the interest rate when such bonds are authorized and issued, it shall be
the duty of the City Clerk of said City to annually at the same tie other taxes are certified,

to certify to the County Clerk of Salina County, Kansas, a full list of all property liable
to assessment and taxation for such work and improvements, except such property on which the
special assessments aforesaid have been paid in full as hereinbefore provided, together with
the respective amounts due on each of such lots and pieces of ground, which amounts shall
include the annual installments of such special assessments together with the interest at one,

year at the rate to be fixed and provided for in this ordinance, being the rate borne by the'
bonds to be issued on all unpaid balances of such assessments and such amounts so certified
as herein provided shall be placed upon the tax roll by the County Clerk of Saline County.,
Kansas, and collected as all other taxes are collected..
Section8 - That this ordinance shall be in effect and force from and after its
publication once in the official city paper.
