AN ORDINANCE providing for the construction of a pumping station for the purpose of pumping
the sewage of Lateral Sanitary Sewers Numbered 357s 3589 359 and 360 and extensions thereof
into the existing sewer located at the intersection of Highland Avenue and Wayne Avenue in
order to conduct the sewage of lateral Sanitary Sewers Numbered 3579 3589 359 and 360 to a
point of outlet and providing for the payment of the cost therof.
WHEREAS, the 6ity or Salina, has by ordinances provided for the construction, maintenance and
operation of its surer system and of Lateral Sanitary Sewers Numbered 3579 3589 359 and 360
for the purpose of disposing of sewage in such district, and
WHEREAS, on account'of the elevation it is impracticable and too expens6ve to excavate in
connection with such sewer so as to dispose of the sewage of said Lateral Sanitary Sewers
Numbered 357, 358, 3599 and 360, and
WHEREAS, in order to provide an outlet for the sewage of lateral Sanitary Sewers Numbered
375, 358, 359 and 3609 it is necessary in the judgement of the governing body of the City of
Salina to construct''a pumping station for the purpose of pumping the sewage of Lateral
Sanitary Sewers 3571, 358, 359 and 360 and extensions thereof into the existing sewer located
at the intersection of Highland Avenue and Wayne Avenue in order to conduct the sewage of
Lateral Sanitary Sewers Numbered 357, 3589 359 and 360 to a point of outlet, SO NOT, THEREFORE
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
Section 1_ That the preambles hereof are hereby incorporated herein, that a pumping
station for the purpose of pumping sewage of Lateral Sanitary Sewers Numbered 357, 358, 359
and 360 and extensions thereof into the existing sewer located at the intersection of Highland
Avenue and Wayne Avenue, be constructed in the manner provided by law.
Section 2. That the City Engineer shall on or before the 16th day of April, 19579
Prepare and file in the office of the City Clerlj, plans and specifications for the construction
of the pumping station provided for in Section 1 of this ordinance and shall be of the proper
character and at the proper location to pump the sewage of said lateral Sanitary Sewers
Numbered 3579 358, 359 and 360 and extensions thereof into the existing sewer located at the
intersection of Highland Avenue and Wayne Avene, so as to conduct the sewage of Lateral
Sanitary Sewers Numbered 357, 358, 359 and 360 and extensions thereof, to a point of outlet
as a part of the sewage disposal system of the City of Salina, Kansas, and shall on or before
said date prepare and subunit to the Board of Commissioners under oath detailed estimates of
the cost thereof and that thereafter the City Clerk shall advertise for three consecutive
days in the official city paper for sealed proposals for the building and construction of
such pumping station according to such plans and specifications, which proposals shall be filed
with the City Clerk on or before the time fixed in such notice, at which time the Board of
Commissioners may let a contract for the building and construction of such pumping station
to the lowest and best responsible bidder therefore; provided that such bids shall not
exceed the estimated cost thereof and provided further that said Board shall reserve the
right to reject any and all such proposals and that if no responsible bids shall be received
within said estimated cost said Board may proceed and build such pumping station within such
estimated cost.

Section I. That for the payment of the cost of such work the building and construction
of said pumping station, the Board of Commissioners of the City of Salina, Kansas, shall
issue improvement blonds of said City in the ammount not to exceed the total cost of such work
and improvements, to be payable in ten approximately equal annual installments and to bear
interest at not to exceed 5% per annum for the date of such bonds, and for the purpose of
paying such bonds and interest as they severally mature, the Board of Commissioners shall
annually levy a tax upon all real and personal property in the City of Salina in an amount

sufficient to pay the annual installment of such principal and interest, and pending issuance)
and sale of such bonds, temporary notes shall be issued according to law, to pay the cost of
such work.
Section 4. That before the pumping station herein provided for shall be constructed,
the plans and specifications therefore shall first be submitted to the department of the
Board of Health of the State of Kansas and be approved by such department.
Section 5. This ordinance shall take effect and be in full force from and after its
publication and adoption in the official city paper.
