AN ORDINANCE creating and defining certain main and lateral sanitary sewer districts in the
City of Salina, Kansas, designated as Main Sewer District "AE" and Lateral Sanitary Sewer
Districts 357, 3581 359, and 360 and providing for the construction of a main sanitary Sewer
"AE" and lateral sanitary sewers in each of said lateral sanitary sewers districts numbered
357, 3589 359, and 360 so created, and providing for the payment of the cost thereof and for
I the levying of special assessments against the property in said districts for the payment of
the cost of such construction and for the issuing of bonds to pay the cost thereof.

BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
Section 1. Malin Sanitary Sewer District Number "AE". That there be and there is hereby'
created a main sanitary sewer district in the City of Salina, Kansas, which shall be and it

all the follows described •

A tract of land beginning at a point 200.0 feet west of the west line of
Broadway Boulevard and 200.0 feet south of the extension of the center line
of Garden Avenue; thence west along a line 200.0 feet Mouth of the center
line of said Garden Avenue to the extension of the east line of Haskett
Avenue; thence north 200.0 feet; thence east along the center line of
Garden Avenue to a point 200.0 feet west of the west line of Broadway
Boulevard; thence south on a line which is 200.0 feet west and paralled
to the west line of Broadway Boulevard to the place of beginning
Section Z. Its is necessary and it is hereby ordered that a ten inch V. C. P. Main
Sanitary Sewer with all necessary connections, manholes, flushing tanks and other appurtenances
be constructed and built in and to serve said main sanitary sewer district nhmber "AE" as
created by Section i of this ordinance along the following course, to -wit:
A ten inch clay pipe sewer bdginning at an existing manhole at the intersection
of Wayne Avenue and Highland Avenue; thence west along the center line of
easement at the south line of Lot 17, Block 11, Gebhart Manor Addition and
continuing west across Broadway Boulevard 457.0 deet where a manhole will be
constructed; thence north along a line 5 feet east of the west right -cif -way
line of said Broadway Boulevard 1020.0 feet where a manhole will be built;
thence north 70.0 feet with a 6 inch cast iron pressure line where a pump
station will be installed; thence continuing north 5 feet east of west line
of Broadway Boulevard with a 10 inch clay pipe sewer 1500.0 feet to a point
12.0 feet east of the west line of Hageman Avenue where a manhole will be
built; thence south along a line 12 feet south of the north line of Garden
Avenue where a manhole will be built which will be terminus of Main *'AE".
Benefit "strict: A tract of land beginning at the west right-of-way line
of Broa y Boulevard and 230.0 feet south of the center line of Wayne
Avenue which is the present city limits, thence west 200.0 feet, thence
in a northwesterly direction and following a line which is 200.0 feet west
of the west line of Broadway Boulevard to the intesection of a line which
is the extension of the center line of Garden Avenue; thence west along
said extended center line to the east line of Haskett Avenue; thence north
along the east line of Hageman Avenue to the south line of Cloud Avenue;
thence east 200.0 feet; thence south along a line which is 200.0 feet east
of Hageman Avenue to its intersection with a line 200.0 feet of the east
line of Broadway Boulevard; thence southwesterly along a line which is 200.0
feet east and parallel to the east line of Broadway Boulevard to the inter-
section of the west line of Ninth Street; thence south to the place of
beginning.

Section 3. Lateral Sanitary Sewer District Number 357. That there be and there is
hereby created Lateral Sanitary Sewer District in the City of Salina, Kansas, which shall be
and it is hereby designated at Lateral Sanitary Sewer District Number 357 and which
district shall include all the following described property in the City of Salina, Kansas,
to -wit;
Benefit District; That part of Lot 7 lying west of Broadway
Boulevard and Lots 8, 9, and 10 ofBlock 1, and that part
of Lot 5 lying west of Broadway Boulevard and Lots 1, S,
3, and 4 of Block 2, all in Lamer's lst Subdivision, City of
Salina, Saline County, Kansas.
Section 4. It is necessary and it is hereby ordered that an eight inch V. C. P.
Lateral Sanitary Sewer with all necessary connections, manholes, flushing tanks and other
appurtenances be constructed and built in and to serve said Lateral Sanitary Sewer
District Number 357 as created by Section 3 of this ordinance along the following course,
to -wit;
An 8 inch clay pipe sewer beginning at an existing manhole
at a point 5.0 feet south of the center line of Willis Avenue
and 5.0 feet east of the west line of Broadway Boulevard; thence
northwesterly following a line which is 5.0 feet east of the
west line of Broadway to a manhole which is 5.0 feet south
of the center line of Smith Avenue; thence west along a line
5.0 feet south of the center line of Smith Avenue 1075.0 feet
where a manhole will be built which will be terminus of Lateral

Section 5. Lateral Sanitary Sewer District Number 358. That there be and there is
hereby created Lateral Sanitary Sewer District in the City of Salina, Kansas, which shall be.
and it is hereby designated as Lateral Sanitary Sewer District Number 358 and which
district shall include all the following described property in the City of Salina, Kansas, to -wit;
Benefit District; Lots 6, 7, 8, 9, and 10 of Block 2 in
Lamer's 1st Subdivision and Lots 1, 2, 3, 4, and 5 of
Block 3 in Lamer's 2nd Subdivision, all in the City of Salina,
Saline County, Kansas.
Section 6. It is necessary and it is hereby ordered that an eight inch V. C. P.
Lateral Sanitary Sewer with all necessary connections, manholes, flushing tanks and other
appurtenances be constructed and built in and to serve said Lateral Sanitary Sewer District
Number 358 as created by Section 5 of this ordinance along the following course, to -wit;
An 8 inch clay pipe sewer beginning at an existing manhole
which is 5.0 feet east of the west line of Broadway Boulevard
and 5.0 feet Youth of the center line of Willis Avenue; thence
west 5.0 feet south of the center line of Willis Avenue 1250.0
feet where a manhole will be built which will be terminus of Lateral 358•
Section 7. Lateral Sanitary Sewer District Number 359• That there be and there is
hereby created Lateral Sanitary Sewer District in the City of Salina, Kansas, which shall be
and it is hereby designated as Lateral Sanitary Sewer District Number 359 and which district
shall include all the following described property in the City of Salina, Kansas, to -wit;
Benefit District; Lots 6, 7, 8, 9, and 10 of Block 3
and Lots 1, 2, 3, 4, and 5, of Block 4 all in Lamer's
2nd Subdivision, City of Salina, Saline County, Kansas.

Section 8. It is necessary and it is hereby ordered that an eight inch V. C. P.
Lateral Sanitary Sewer with all necessary connections, manholes, flushing tanks and
other appurtenances be constructed and built in and to serve said Lateral Sanitary Sewer
District Number 359 as created by Section 7 of this ordinance along the following course,
to -wit:
An 8 inch clay pipe sewer beginning at an existing manhole
which is 12.0 feet east of the west line of Hageman Avenue
and 5.0 feet south of the center line of Maple Avenue; thence
west along a line 5.0 feet south of the center line of Maple
Avenue 1250.0 feet where a manhole will be built which will
be terminus of Lateral 359
Section 9. Lateral Sanitary Sewer District Number 360. That there be and there is
hereby created Lateral Sanitary Sewer District in the City of Salina, Kansas, which shall be
and it is hereby designated as Lateral Sanitary Sewer District Number 360 and which district)
shall include all the following described property in the City of Salina, Kansas, to -wit:
Benefit District: All of Lots 6, 7, 8, 9, and 10 in
Block 4, Lamer's 2nd Subdivision in the City of Salina
Saline County, Kansas.
A tract of land beginning at a point 200 feet south
of the center line of Garden Avenue and on the west line
of Hageman Avenue Extended; thence west along a line 200.0
feet south of the center line of Garden Avenue to the east
line of Haskett Avenue; thence north 200.0 feet; thence
east along the center line of Garden Avenue to the west line
of Hageman Avenue; thence south 200.0 feet to the place of
beginning.
Section 10. It is necessary and it is hereby ordered that an eight inch V. C. P.
Lateral Sanitary Sewer with all necessary connections, manholes, flushing tanks and other
appurtenances be constructed and built in and to serve said Lateral Sanitary Sewer District
Number 360 as created by Section,9 of this ordinance along the following course, to -wit:
An eight inch clay pipe sewer beginning at an existing manhole
which is 12.0 feet east of the west line of Hageman Avenue and
5.0 feet south of the center line of Garden Avenue; thence west
along a line 5.0 feet north of the center line of Garden Avenue
1250.0 feet where a manhole will be built which will be terminus
of Lateral 360.
Section 11. That the City Engineer shall on or before April 16, 1957, prepare and
file in the office of the City Clerk, plans and specifications for the construction of the
sanitary sewers provided for in the preceding sections of this ordinance which shall
be of the proper character to serve the property lying within the district which such sewer
is to be constructed and shall on or before the same date prepare and submit to the Board
of Commissioners a detailed estimate under oath of the cost thereof. That thereafter the
City Clerk shall advertise for three consecutive days in the official city paper for sealed
proposals for the building and construction of such sewer according to such plans and
specifications, which proposals shall be filed with the City Clerk on or before the time
fixed in such notice, at which time hhe Board of Commissioners may let a contract for the
building and construction of such sewers to the lowest and best responsible bidder of
bidders

therefore, if there be any whose bids do not exceed the extimated Bost thereof, but said
Board shall reserve the right to reject any or all such proposals, and if no bids shall be
received within such estimate, the Board of Commissioners shall have the power to do such
in
work and make such improvements with/the estimated cost thereof as provided by law.
Section 12. That for the cost of building and constructing such sewer, special
assessments shall be made for the full cost thereof on all lots and pieces of land within
and for which such, sewer shall be built, according to the appraised value thereof, without
regard to the buildings or improvements thereon.
Section 13. After the passage and publication of this ordinance, the Board of Commissioners
shall appoint three disinterested appraisers, who after having taken an oath to make a true
and impartial appraisement of all lots and pieces of land liable to taxation for the cost of
such improvements, shall within five days after having been notified of their appointments
proceed to appraise all of the lots and pieces of land within the district liable to
assessment and taxation as aforesaid, without regard to the buildings or improvements thereon,
and after making thch appraisements, shall return to the Board of Commissioners of said
City and said Board shall designate a time for a special meeting of said Board for the
purpose of hearing any complaints that may be made as to the value of any lot or piece of
land appraised as aforesaid, of which special session due notice shall be given in the
official city paper, at which special session said Board may alter any valuation of any lot
or piece of land, if, in thdir opinion, the same has been appraised too high or too low.
Section 14. The special assessment herein provided for may be paid by the person liable
therefore in Ten approximately equal annual installments but the owner of any property
liable to such assessment may within thirty days from the date of d6bermining the amount
assessed against the property, pay the same in full and his property shall not be liable
for any assessments for the cost of such :4nprovements, and bonds as hereinafter provided for
shall be issued in the amount of the cost of such improvements remaining unpaid at the end
of the thirty days from the time such assessment is fixed.
Section 15. For the purpose of paying for the work and improvements in this ordinance
provided for, the Board of Commissioners may and are hereby authorized and directed to issue
improvement bonds of the City of Salina, Kansas, in an amount not to exceed the total cost
of such improvement, and to run for a period of ten years and be payable in ten approximately
equal annual installments, together with interest not to exReed five per cent per annum,
which bonds shall the issued and payable according to law; and for the purpose of paying the
principal and interest of said bonds as they severally become due and payable the Board
of Commissioners shall approtion and assess against the lots and pieces of land within the
taxing district of such improvements, special assessments covering the cost of such
improvement and apportion3pent therein contained shall hold good for all of the installments
that are to be collected from the specific property chargeable therefore, and with such

j improvements; such assessment and approtionment ordinance shall contain the total amount

of tax approtioned to each tract, piece or parcel of land within the taxing district and
shall state the number of annual installments in which such tas is to be collected; and

thereaftbr the City Clerk shall ann:4zally, at the same time that other taxes are certified,
certify to the County Clerk of Saline County, Kansas, a full list of all property liable

I for such work and improvement, together with the respective amounts due on each of said
J tracts, pieces or parcels of land, which amounts shall include the annual installment
and interest on all unpaid balances for one year at the rate of not to exceed five per cent
per annum on such amounts so certified, which amounts shall be collected as other taxes
are collected.
Section 16. This ordinance shall take effect and be in force from and after its
publication onee in the official city paper.
