ORDINANCE NUNBER 6126

AN ORDINANCE providing for and authorizing the issuance of Improvement Bonds of the City
of Salina, Kansas, in the sum of $213,537.45, to pay the cost of constructing main sanitary,
sewers and certain lateral sanitary sewers and storm sewers, in the City of Salina, Kansas,
which bonds shall be designated as Series 5-173.
WHEREAS, pursuant to proceedings duly had according to law, certain main and certain
lateral sanitary sewers and storm sewers have been constructed in the City of Salina, Kansas,
in main sewer districts and certain lateral sanitary sewer districts, as follows:
Lateral Sanitary Sewer District Number 315 as provided for and authorized by
Ordinance Number 5951•
Lateral Sanitary Sewer District Number 316 as provided for and authorized by
Ordinance Number 5954.
Lateral Sanitary Sewer District Number 317 as provided for and authorized by
Ordinance Number 5959•
Lateral Sanitary Sewer District Number 318 as provided for and authorized by
Ordinance Number 5962
Lateral Sanitary Sewer District Number 319 as provided for and authorized by
Ordinance Number 5964.
Lateral Sanitary Sewer District Number 320 as provided for and authorized by

CONSOLIDATED-SALINA
WHEREAS, the total cost of said sewers constructed in and as the sewer districts above
mentioned amounted to a total of $216,778.16.
WHEREAS, it is hereby found and determined that the sum of $27,469.76 is against property
belonging to said city and is to be paid by general taxes to be levied upon all taxable
property within said city, and the sum of $66,969.87 is to be paid by special assessments
levied upon lots and pieces of ground liable for the payment of said sewers in the sewer
districts mentioned, which amount as been heretofore duly assessed and apportioned to the
several lots and pieces of ground liable therefor according to law and as provided for in
the Ordinances of the City of Salina relating thereto, of which amount the sum of $3,240.71
has been paid by the owners of the property liable therefor, leaving a balance of $63,729.16,
for which bonds are to be issued; and
WHEREAS, the total cost of the said Storm Sewers has been ascertained In the amount of
$122,338.53 to be paid by general taxes to be levied upon all taxable property within said
city; and for which bonds are to be issued; and
WHEREAS, bonds in the aggregate sum of $213,537.45 are to be issued to pay the actual net
cost thereof; SO, NOW THEREFORE
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
Section 1. That the foregoing preambles are being hereby adopted and made a part of

i this ordinance add that for the purpose of providing funds to pay the cost of the
improvements, hereinbefore described, there shall be issued and there hereby are issued,
Internal Improvement Bonds of the City of Salina, Kansas, in the total principal sum of
$213,537.45, which issue shall consist of 213 bonds numbered from 1 to 213 inclusive, all
dated March 11957, bonds numbered 1 to 213 inclusive, to bear interest from date at the

per cent per annum, payable September 1, 1957 and thereafter semiannually on March 1st and

September lst of each year to be evidenced by interest coupons as herein
provided for, and
said bonds shall become due serially in denomination as follows:
Bonds Numbered 1 to 54 for $1,000 each except Number 1
is for $1,537.45 due September 1, 1958.
Bonds Numbered 55 to 107 for $1,000 each, due
September 1, 1959•
Bonds Numbered 108 to 160 for $1,000 each, due
September 1, 1960.
Bonds Numbered 161 to 213 for $1,000 each, due
September 1, 1961.
Section 2. Said bonds shall be signed by the Mayor and shall be attested by the
1 signature of the City Clerk and the corporate seal of the City shall be affixed thereto,

and shall have attached thereto interest coupons representing the interest thereon, which
coupons shall be in the form provided by law and shall bear the printed or lithographed
facsimile signatures of the Mayor and the City Clerk of said City and bonds and interest
coupons shall be registered in the offices of the City Clerk and the State Auditor as
required by law.
Section 3. Said bonds shall be designated as Series 5-173, and shall be in the form
and shall contain recitals substantially as follows, to -wit:

KNOW ALL MEN BY THESE PRESENTS, that the City of Salina, in the County of Saline, State of
Kansas, acknowledges itself to be indebted and for value received hereby promises to pay
the bearer the sura of DOLLARS in lawful
money of the United States of America, on the first day of September 19 with interest
thereon from the date hereof at the rate of Z f CIL �Z;o .
per cent per annum, payable Heptember 1, 1957 and thereafter semis nually on the first days
of March and September in each year, on presentation and surrender of the interest coupons
hereto affixed as said coupons severally become due, both principal and interest of this
bond being payable at the office of the State Treasurer of the State of Kansas, in the
City of Topeka, Kansas. And said City of Salina, Kansas, is held and firmly bound by these
presents and the full faith, credit and resources of said city are hereby irrevocable
pledged for the payment of said principal and interest at maturity.
This bond is one of a series of 213 bonds of like date and tenor, excepting denomination
and maturity, aggregating the principal sum of $213,537.45, issued by the City of Salina,
Kansas, for the purpose of paying the cost of constructing main sanitary sewers and certain
lateral sanitary sewers and storm sewers, in said city= by the authority of and in full
compliance with the provisions, restrictions and limitations of the constitution and laws
of the State of Kansas, including Sections 10-101 to 10-127, Sections 12-617 to 12-620,
Sections 12-626 to 12-629, and Sections 13-1013 to 13-1018, all in the General Statutes of
Kansas, 1949, and amendments thereto, and all other provisions of the laws of said state
applicable thereto and this bond and all other bonds of this series, and all interest
thereon, are to be paid by the City of Salina, Kansas.
And it is hereby declared and certified that all acts, conditions and things required to
be done and to exist precedent to and in the issuence of this bond have been properly
done and performed and do exist in due and regular form and manner as required by the
constitution and laws of the State of Kansas, and that the total indebtedness of said
city, including this series of bonds does not exceed any constitutional or statutory
limitations.
IN WITNESS WHEREOF, the said City of Salina, Kansas, has executed this bond by causing it
to be signed by its Mayor and its corporate seal to be hereto affixed attested by its City
Clerk and the coupons hereto attached to be signed Vi.th the facsimile signatures of said
officers, and this bond to be dated the first day of , 1957•

Section 4. The Mayor and the City Clerk are hereby authorized and directed to
prepare and execute the bonds hereinbefore described and to advertise tnd sell the same
in the manner provided by law, and when duly executed and registered, to deliver said
bonds to the purchaser or purchasers thereof.
Section 5. The full faith, credit and reaources of the City of Salina, Kansas, shall
be and the same are hereby irrevocable pledged for the prompt payment of said bonds and
all interest thereon. The Board of Commissioners of the City of Salina, Kansas, shall
annually make provisions for the payment of the principal and interest on said bonds, the
same become due by lavying taxes and assessments upon the property liable therefore as
provided by law.
Section 6. This ordinance shall take effect and be in force from and after its
publication once in the official city paper.
