WHEREAS, by resolution Numbers 1764, 1788, 1791, 1763, 1776, 1786, 1787, 1790, 1792, 1752, 1789, 1785, 1784, 1783 duly adopted on October 23, 1956, January 15, 1957, November 27, 1956, October 2, 1956, by the Board of Commissioners of the City of Salina, Kansas, have declardd that they deem it necessary to curb utter, and , g , grade the north side of Beloit Avenue from the center line of Lewis Avenue to the center line of Roach Street; and pave and grade Beloit Avenue (twenty-eight (20) feet wide toe of gutter to toe of gutter) with two (2) inch hot asphalt mix over a six () inch crushed rock base, from the east line of Roach Street to the east line of Lewis Avenue; curb, gutter, grade and pave Haskett Avenue (thirty-two (32) feet wide from face of curb to face of curb) with two(2)inch hot asphalt I mix over a six (6) inch crushed rock base, from the south line of Cloud Street tib the south line of Willis Avenue; curb, gutter, pave and grade Ingman Road (thirty-two (32) feet wide from face of curb to face of curb) with two (2) inch hot asphalt mix over a six (6) inch crushed rock base, from the west line of Page Avenue to the south line extended of Lot 18, Block 6, Ingermanson Heights, City of Salina, Kansas; pave and grade Lewis Avenue (twenty-eight 28) feet wide toe of gutter to toe of gutter) with two (2) inch hot asphalt mix over a six6 inch crushed rock base, from the south line of Claflin Avenue ) to the south line of Russell 1 Avenue; pave and grade Lewis Avenue (twenty-eight (28) feet wide toe of gutter to toe of gutter) with two (2) inch hot asphalt mix over a six (6) inch rock base, from the north line of Ellsworth Avenue to the south line of Minneapolis Avenue; gave and grade Mellinger Drive (twenty-eight (28) feet wide from toe of gutter to toe of gutter) with two 2 inch I hot asphalt mix over a six (6) inch crushed rock base, from the east line of Lewis Avenue I to the west line of Ohio Avenue; curb, gutter, pave and grade Norton Street (thirty-two (32) feet wide from face of curb to face of curb)with two (2) inch hot asphalt mix over a six (6) inch crushed rock base, from the south line of Leslie Avaue to the north line of Wayne Avenue; curb, gutter, ave and g (thirty-two (32) feet wide from face of curb to r , p grade Page Avenue thin two Mace of curb) with two (2) inch Hot asphalt mix over a six (6) inch crushed rock base, from the north line of Willis Avenue to the east line of Roberts Avenue; curb, gutter and pave CON SOLIDATED-SALINA C7 and grade Roberts Avenue (thirty-two (32) feet wide from face of curb to face of curb) with two (2) inch hot asphalt mix over a six (6) inch crushed rock base, from the south line of Cloud Street to the south line extended of Lot 2, Block 1, Ingermanson Heights, City of Salina, Kansas; pave and grade Russell Avenue (twenty-eight (28) feet wide toe of gutter to toe of gutter) with two (2) inch hot asphalt mix over a six (6) inch rolled rock base, from the east line of Lewis Avenue 298.73 feet east; curb, gutter and pave and grade Willis Avenue (thirty-two (32) feet wide from face of curb to face of curb) with two (2) inch hot asphalt mix over a six (6) inch crushed rock base, from the west line of Haskett Avenue to the west line of Page Avenue; resurface Crawford Avenue with two (2) inch hot mixed asphaltic concrete from the west line of Santa Fe Avenue to the east line of Ninth Street; resurface Ninth Street with two (2) inch hot mixed asphaltic concrete from the south line of Republic Avenue to the south line of Jewell Avenue; resurface Santa Fe Avenue with two (2) inch hot asphaltic concrete from the north line of Crawford Avenue to the north line of Claflin Avenue. WHEREAS, said resolutions were published for six days in the Salina Journal, a daily newspaper, published in said city, and being the official city paper, and the majority of the resident property owners owning a majority of square feet of the lots or real estate liable to taxation for the cost of said improvements did not within twenty days from the date', of the last publication thereof file with the City Clerk sufficient protest in writing against the making of said improvement, no protests of any kind having been filed, SO, NOW THEREFORE, BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 3. That it is necessary and it is hereby ordered that InAman Road from the west line of Page Avenue to the south line extended of Lot 18, Block 6, Ingermanson Heights, City of Salina, be curbed, guttered, paved and graded to the established paving grade and paved between the guttering lines thereon. Section 4. That it is necessary and it is hereby ordered that Lewis Avenue from the south line of Claflihn Avenue to the south line of Russell Avenue, in said City, be paved and graded to the established paving grade and paved between the guttering lines thereof. Section 5. That it is necessary and it is hereby ordered that Lewis Avenue from the north line of Ellsworth Avenue to the south line of Minneapolis Avenue, in said city, be paved and graded to the established paving grade and paved between the guttering lines thereof. Section 1. That it is necessary and it is hereby ordered that Beloit Avenue on the the east line of Lewis Avenue to the west line of Ohio Avenue, in said city, north side from the center i line of Lewis Avenue to the center line of Roach Street, in said thereof. city, be curbed, guttered, and graded to the established paving grade and paved between the guttering lines thereof; and that Beloit Avenue from the east line of Roach Street to the east line of Lewis Avenue, in said city, be paved and graded to the established paving gradepandi (lines thereof. between the guttering lines thereof. Section 2. That it is necessary and it is hereby ordered that Haskett Avenue from the south line of Cloud Street to the south line of Willis Avenue, in said city, be curbed, guttered, paved and graded to the established paving grade and paved between the guttering lines thereof. Section 3. That it is necessary and it is hereby ordered that InAman Road from the west line of Page Avenue to the south line extended of Lot 18, Block 6, Ingermanson Heights, City of Salina, be curbed, guttered, paved and graded to the established paving grade and paved between the guttering lines thereon. Section 4. That it is necessary and it is hereby ordered that Lewis Avenue from the south line of Claflihn Avenue to the south line of Russell Avenue, in said City, be paved and graded to the established paving grade and paved between the guttering lines thereof. Section 5. That it is necessary and it is hereby ordered that Lewis Avenue from the north line of Ellsworth Avenue to the south line of Minneapolis Avenue, in said city, be paved and graded to the established paving grade and paved between the guttering lines thereof. Section 6. That it is necessary and i t I is hereby ordered that Mellinger Drive, from the east line of Lewis Avenue to the west line of Ohio Avenue, in said city, be paved and graded to the established paving grade and paved I between the guttering lines thereof. Section 7. That it is necessary and it is I hereby ordered that Norton Street from the south line of Leslie Avenue to the north line of Wayne Avenue, in said city, be curbed, guttered, paved and graded to the established paving grade and paved between the guttering (lines thereof. That it is necessary and it is hereby ordered that Page Avenue from the north line of Willis Avenue to the east line of Roberts Avenue, in said city, be curbed, guttered paved and graded to the established paving grade and paved between the guttering lines thereof. Section 9. That it is necessary and it is hereby ordered that Roberts Avenue from the south line of Cloud Street to the south line extended of Lot 2, Block 1, Ingermanson Heights, in said city, be curbed, guttered and paved and graded to the established paving grade between the guttering lines thereof. Section 10. That it is necessary and it is hereby ordered that Russell Avenue from the east line of Lewis Avenue 298.73 feet east, in said city be paved and graded to the established paving and grade and paved between the guttering lines thereof. Section 11. That it is necessary and it is hereby ordered that Willis Avenue from the west line of Haskett Avenue to the west line of Page Avenue in said city, be curbed guttered paved and graded to the established paving grade and paved between guttering lines thereof. Section 12. That it is necessary and it is hereby ordered that Crawford Avenue from the west line of Santa Fe Avenue to the east line of Ninth Street be resurfaced with two- inch hot mixed asphaltic concrete between the guttering lines thereof. Section 13. That it is necessary and it is hereby ordered that Ninth Street from the south side of Republic to the south line of Jewell be resurfaced with two-inch hot mixed asphaltic concrete between the guttering lines thereof. Section 14. That it is necessary and it is hereby ordered. that Santa Fe Avenue from the north line of Crawford Avenue to the north line of Claflin Avenue be resurfaced with two-inch hot mixdd asphaltic concrete between the guttering lines thereof. I Section 15. That for the work and improvements herein provided for the City Engineer shall make and file with the City Clerk on or before the 19th day of March 1957, complete plans and specifications for the curbing, guttering, paving and grading with excavation necessary therefore, of the streets described in Sections 1 to 14 of this ordinance, with the following type of improvement; Concrete combined curb and gutter on each side thereof 30 inches wide from back of curb to paving line, curb 12 inchs deep at back gutter 6 inch deep; and the necessary grading of each to the A established paving grade between the curb and gutter lines on each side thereof and within the limits of said street, as herein before described; and the necessary grading of each to the established paving grade, and the paving thereof, with two-inch j hot mixed asphaltic concrete over a six-inch rock stablized base. I and said Engineer shall on or before the same date, submit to the Board of Commissioners under oath, detailed estimates of the cost of such work and improvements. CONSOLIDATED-SALINA 1 F - 1 Section 16, That after such plans and specifications have been made and prepared by the City Engineer and filed with the City Clerk as aforesaid, the Board of Commissioners may advertise by advertisement published in the official city paper of the City of Salina, Kansas, for three consecutive days for the receipt of sealed proposals for the improving of said streets with the kind of material named and specified in the preceeding sections thereof, and for the excavation and grading necessary for the completion of such work, and after the'; receipt of such proposals, the said Board of Commissioners may and are hereby authorized and directed to let contracts for the improving of said streets with the materials selected by them to the lowest responsible bidder or bidders therefor, as determined by said Board of Con ni.ssioners, and for such excavation and grading. Said Board reserves the right to reject any and all bids. Section 17. That for the improving of the above mentioned streets, such assessments shall be made for the full cost thereof according to law, on all lots and pieces of land to the center of the block on either side of the street to be improved according to the appraisers valuation thereof, without regard to the buildings or improvements thereon for the distance'. to be improved. Section 18. After the passage and publication of this ordinance, the Board of Co miiss oners shall appoint three disinterested appraisers, householders, who after having taken an oath to make a true and impartial appraisement of all lots and pieces of land liable to assessment and taxation as aforesaid, as may be designated by the Board of Commissioners of said City, without regard to the buildings or improvements thereon and after making such appraisement shall return to the Board of Commissioners of said City, and said Board of Comtai.ssioners $hall designate a trime and place for the hearing of any complaints that may be made as to -khe value of any lots and pieces of land appraised as aforesaid, of which due notice shall be given in the official city paper, at w1iich hearing the Board of Commissioners may alter any valuation of any lot or piece of land, if, in their opinion, the same has been appraised too high or too low. Section 19. That for the purpose of paying the cost of the work and improvements in this ordinance provided for, the Board of Cormdssioners are hereby authorized and directed to issue Internal Improvement Bonds of the City of Salina in an amount not to exceed the contract price or cost of such improvements and to run for a period of ten years and be payable in ten equal installments, together with interest not to exceed five per cent per annum, which bonds shall be made payable at the Fiscal Agency of the State of Kansas and for the purpose of paying the principal and interest on said bonds as they severally become due and payable, the Board of Commissioners shall apportion and assess against the lots and pieces of land within the taxing district of such improvements special assessments covering the cost of such improvements and the apportionment herein contained shall hold good for all CO` SOMrATED-SALINA 1 1 of the installments that are to be collected fr6m the specific property chargeable with said improvements, such assessments and apportionment ordinance shall contain the total amounts of tax approtioned to each tract, piece or parcel of land within the taxing district and shall state the number of annual installments in which such tax is to be collected; and thereafter the City Clerk shall annually at the same time other taxes are certify to the County Clerk of Saline County, Kansas a full list of all property liable fors such work and improvements, together with the reppective amounts due on each of said tracts' pieces or parcels of land, which amounts shall include the annual installments and interest on all unpaid balances for one year at the rate of not to exceed five per cent per anmum on such amounts so certified which shall be collected as other taxes are collected, PROVIDE, that for the purpose of defraying the cost of improving the intersections and areas formed by the crossing of streets and alleys, and for the grading of said street where the same is provided for in this ordinance as well as where the improvement is through or adjacent to property of the City for which the city is liable, the assessment will be made against all taxable property of the City and paid by the City at large. Section 20. This ordinance shall take effect and be in force from and after its publication once in the official city paper.
