6122 Storm Swr - Gebhart ManorCons')cma.='Er-'SAUNA ORDINANCE NUMBER 6122 (Published in The Salina Journal% �'� , 1957) jAN ORDINANCE providing for the construction of a certain storm sewer and drainage in the ICity of Salina, Kansas, to be designated as Gehhart Manor Storm Sewer, and providing for the letting of contract for such construction and for the payment of the cost thereof. WHEREAS, at all times heretofore, the entire City of Salina, Kansas, has constituted a storm I sewer and drainage district and bonds issued to pay the cost thereof and payable by a general. tax as provided by law;,�nd BE IT ORDAINED By the Board of Commissioners of the City of Salina, Kansas: Section 1. That the preamble of this ordinance is hereby incorporated herein. That the entire City of Salina is hereby determined to be the benefit district for the purpose of the installation of a system of storm sewers and drainage in the said city. That the entire i limits of said city has biways constituted one district for said purposes. Section 2. That it is necessary and it is hhreby ordered that a storm sewer, which is I hereby designated as Gebhart Manor Storm Sewer, together with all necessary inlets, inlet i connections, manholes, connecting lines, sluice gates and other appurtenances, be constructed, in the City of Salina along the following course, to -wit: t Beginning at an existing manhole at the intersection of Norton Street and Wayne Avenue, which is 10 feet south of the center line II of Wayne Avenue and 10 feet east of the center line of Norton Street, I, thence west on a line 10 feet south of the center line of Wayne Avenue with a 48" storm sewer to the intersection of Wesley Street where a manhole will be constructed, thence west with a 42" storm sewer to the intersection of Quincy Street there a manhole will be constructed, thence continue west with a 36" storm sewer to the intersection of Fourth Street where a manhole will be built, thence continue west with a30" storm sewer to the intersection of Simmons Street where ` a manhole will be built, thence continue west with a 21" storm sewer ! to the intersection of Highland Avenue where a manhole will be built, thence running north with an 181 storm sewer on a line 10 feet east of the center line of Highland Avenue to the intersection of Highland ! Avenue and High Place where a manhole will be built, thence north with a 15" storm sewer to the intersection of Leslie Avenue where a manhole will be constructed which will be terminus of Job 356. Section 3. That on or before the 5th day of March , 1957, the City Engineer i shall perpare and file in the office of the City Clerk, detailed plans and specifications !f or the construction of the storm sewer provided for in Section 2 of this ordinance with I vitrified and/or corrugated metal pipe, bituminous coated, and/or concrete sewer pipe or any I combination of such typed of sewer pipe and on or before the same date shall prepare and file j i in the office of the City Clerk, under oath, a detailed estimate of the cost thereof. After such plans and specifications and estimate of cost shall have been filed, the City Clerk shall advertise by advertisements published in the official city paper for at least three consecutive days for sealed proposals for the building and construction of such strom sewer i and at the time and place mentioned, the Board of Commiasioners may let a contract with the lowest and best responsible bidder for the building and construction of such storm and drainage I i sewers, but the right to reject any and all bids shall be and it is hereby reserved, and I provided fufther that if no responsible person shall purpose to enter a contract at a price not ... CON SOLIDATED-SAI.INA 1 n n exceeding the estimated cost, then the Board may proceed to construct said improvements vtthin the estimated cost thereof and shall purchase the necessary tools, apparatus, and materials and employ the necessary labor for the pubpose of constructing the sewer. Section 4. That for the payment of the cost of said work, the Board of Commissioners shall issue General Obligation and Improvement Bonds of the City of Salina, Kansas, in an amount not to exceed the total cost of such werk and improvements, to be payable in ten approximately equal annual installments and to bear interest at not to exceed five per cent per annum and from the date of such bonds, and for the purpose of paying such bonds and interest as they severally become due, the Board of Commissioners shall annually levy a tax upon all real and personal property in the City of Salina in an amount sufficient to pay the annual installments of such principal and interest, and that pending the issuance of such bonds, temporary notes shall be issued according to law, to pay the cost of such work. Section 5. This ordinance shall take effect and be in force from and after its publication in the official city paper.
