ORDINANCE NUMBER 6116

AN ORDINANCE ratifying and confirming a contract with 0. D. Wilmoth doing business as
Wilmoth Construction Company for the construction of a storm sewer in the City of Salina
Kansas, heretofore designated as Ingermanson Storm Sewer, and providing for the issuance
of temporary notes to pay the cost thereof, pending the issuance and sale of bonds.
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
Section 1. That the acceptance of the City of Salina, Kansas, of the proposal of the
Wilmoth Construction Company, hereinafter referred to as the "Contractor" as submitted to
the Board of Commissioners on Janyry 15, 1957, which is hereby found to be the lowest and
best bite for such work, and the contract awarded by the Board of Commissioners of said City
to said contractor and signed on behalf of the City by its Mayor on January 22, 1957, for
the construction of certain public improvements in the City of Salina, Kansas, to -wit:
a 60 inch pipe sewer beginning with a concrete storm sewer
outfall located at the intersection of Dry Creek and 10 feet
north of the east and west center line of the NW4 of Section 26,
Township 14 South, Range 3 West of the 6th P. M. Saline County
Kansas, thence east with a 60 inch storm sewer on a line 10 feet
north of the center line of the NW4 of Section 26, Township 14
South, Range 3 West, to the center line of Roberts Avenue, thence
continuing east with a 54 inch storm sewer pipe to the center line
of Ingman Road, thence continuing east with a 48 inch storm
sewer pipe to the center line of Page Avenue, thence Continuing
east with a 36 inch storm sewer pipe to the center line of
Haskett Avenue, thence north along the center line of Haskett
Avenue with a 24 inch storm sewer pipe to the center line of
Maple Avenue, thence continuing north with a 21 inch storm sewer
pipe to the center line of Willis Avenue, thence continuing
north with an 18 inch storm sewer to the center line of Cloud
Avenue, which will be the terminus of the storm sewer project.
at and for the unit price for said work contained in said proposal, which proposal and
contract are hereby referred to and made a part of this ordinance, be and the same is
hereby ratified and confirmed, said proposal being within the estimated cost of said
improvements as shown by the sworn estimate of the City Engineer on file in the office
of the City Clerk which estimate is hereby referred to and made a part of this ordinance.
Section 2. Said improvements shall be built and constructed in accordance with the
plans and specifications therefore prepared by the City Engineer on file in the office of
the City Clerk and in accordance with the proposal of said contractor and under the terms
of said contract, all of which are hereby referred to and made a part of this ordinance.
Section 3. That temporary notes signed by the Mayor and attest by the City Clerk ba
issued from time to time as the work progressed in the manner and form as required by law,
the total amount thereof not to exceed the amount of $74,613.00 for such work, such notes
to bear interest at not to exceed 5 per cent per annum and to mature not later than
December 1, 1958, and to be issued in such amounts and at such times as may the money for
the payment of the cost of such work be required, such notes to be issued to said contractor
and to be redeemed and cancelled at the time that Internal Improvement Bonds are issued in
Lieu thereof.

Section 4. That this ordinance shall take effect and be in full force from and after
