6115 Utility ImprovementsCOP780LMAJ En-SALrxn 1 L 1 ORDINANCE NUMBER 6115 (Published in The Salina Journal `=_Y,.. , 1957) AN ORDINANCE creating and defining certain main and lateral sanitary sewer districts in the City of Salina, Kansas, designated as Main Sanitary Sewer District "AD" and Lateral Sanitary; Sewer Districts Numbered 354, 355, and 356 and providing for the construction of a main sanitary Sewer "AD" and lateral sanitary sewers in each of said lateral sanitary sewer districts numbered 354, 355, and 356, so created, and providing for the pay3pent of the cost thereof and for the levying of special assessments against the property in said districts for the payment of the cost of such construction and for the issuing of bonds to pay the cost thereof. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. Main Sanitary Sewer District Number "AD". That there be and there is hereby created a main sanitary sewer district in the City of Salina, Kansas, which shall be and it is hereby designated as Main Sanitary Sewer District Number "AD" and which district shall include tal the following described property in the City of Salina, Kansas, to -wit: Benefit District. Gebhart Manor Addition to the City of Salina, Kansas, and that part of the NW of Section 25-14-3 lying north of Wayne Avenue, east of the west line of Union Pacific Railroad right-of-way and south of Leslie Avenue. Section 2. It is necessary and it is hereby ordered that a ten inch V. C. P. main sanitary Sewer with all necessary connections, manholes, flushing tanks and other appurtenances be constructed and built in and to serve said main sanitary sewer district number "AD" as created by Section 1 of this ordinance along the following course, to -wit: A ten inch clay pipe sewer beginning at a manhole that will be constructed at the end of Branch l,;,teral Sewer 354, which will be 10 feet north of the center line of Wayne Avenue, and the center line of first easement west of Norton Avenue, thence west along a line 10 feet north of the center line of Wayne Avenue to a point 10 feet east of the center line of Highland Avenue which will be terminus of Main "AD". Section 3. Lateral Sanitary Sewer District Number 354. That there be and there is hereby created Lateral Sanitary Sewer District in the City of Salina, Kansas, which shall be and it is hereby designated as Lateral Sanitary Sewer District Number 354 and which district shall include all the following described property in the City of Salina, Kansas, to -wit: Benefit District Blocks 2 and 3, Southfield Addition, City of Salina, County of Saline, Kansas. Section 4. It is necessary and it is hereby ordered that a ten inch V. C. P. Lateral sanitary sewer with all necessary connections, manholes, flushing tanks and other appurtenances be constructed and built in and to serve said Lateral Sanitary Sewer District Number 354 as created by Section 3 of this ordinance along the following course, to -wit: Branch 1. A ten inch clay pipe sewer beginning at a 10 inch stub line 20 feet west of an existing manhole which is 20 feet east of the west line of Norton Street and 52 feet south of the north line of Leslie Avenue; thence west 128.1 feet where a manhole will be built; thence south along a line which is one foot west of the east line of easement for utilities to the center line of Wayne Avenue where a manhole will be built which will be the terminus of Branch 1 of Lateral 354. A ten inch clay pipe sewer beginning at a 10 inch stub line 40 feet east of an existing manhole which is 20 feet east of the west line of Norton Street and 52 feet south of the north line of Leslie Avenue; thence east 141.6 feet where a manhole will be built; thence south with an eight inch clay pipe sewer one foot west of the east line of the easement for utilities to the center line of Wayne Avenue where a manhole will be built which will be the terminus of Branch 2 of Lateral 354. Section 5. Lateral S8nitary Sewer District Number 355. That there be and there is hereby created, Lateral Sanitary Sewer District in the City of Salina, Kansas, which shall be and it is hereby designated as Lateral Sanitary Sewer District Number 355 and which district shall include all the following described Property in the City of Salina, Kansas, to -wit: Benefit District. Lots 1, 2, 3, 6, and 7, Block 3, Countryside Addition, City of Salina, Saline County, Kansas. Section 6. It is necessary and it is hereby ordered that an eight inch V. C. P. lateral sanitary Sewer with all necessary connections, manholes , flushing tanks, and other appurtenances be constructed and built in and to serve said Lateral Sanitary Sewer District Number 355 as created by Section 5 of this Ordinance along the following course, to -wit: An eight inch Clay pipe sewer beginning at an existing manhole which is on easement first north of Russell Avenue and in Block 1, Countryside Addition , 25 feet east of the west line of Lot 5, in &aid block; thence east 43 feet; thence north 31 feet thence east 157 feet where a manhole will be constructed which will be terminus of Lateral 355• Section 7. Lateral Sanitary Sewer District 356. That there be and there is hereby created lateral sanitary sewer District in the City of Salina, Kansas, which shall be and it is hereby designated as Lateral Sanitary Sewer District Number 356 and which district shall include all the following described property in the City of Salina, Kansas, to -wit: Benefit District. Block 1, and west half of Blocks 2 and 3, Gebhart Manor Addition to the City of Salina, Saline County, Kansas. Section 8. It is necessary and it is hereby ordered that an eight inch V. C. P. lateral sanitary sewer with all necessary connections, manholes, flushing tanks and other appurtenances be constructed and built in and to serve said Lateral Sanitary Sewer District Number 356, as created by Section 7. of this ordinance along the following course, to -wit: An eight inch clay pipe sewer beginning at a manhole that will be constructed at the end of Main "AD" which will be 10 feet north of the center line of Wayne Avenue and 10 feet east of the center line of Highland Avenue, thence north on a line 10 feet east of the center line of Highland Avenue to a point 22 feet south of the center line of Leslie Avenue where a manhole will be constructed, thence west on a line 22 feet south of -the center line of Leslie Avenue to a point due north of the NE corner of Lot 1, Block 1, Gebhart Manor Addition to the City of Salina, Kansas, where a lamp hole will be construdted which will be terminus of Lateral 356. That the City Engineer shall on or before January 22, 1957, prepare and file in the office of the City Clerk, plans and specifications for the construction of the sanitary sewers provided for in the preceeding sections of this ordinance which shall be of the proper character to serve the property lying within the district which such sewer is to be constructed and shall on or before the same date prepare and submit to the Board Of Commissioners a detailed estimate under oath of the cost thereof. That thereafter the City Clerk shall advertise for three consecutive days in the official city paper for sealed proposals for the building and construction of such sewer according to such plans and specifications, which proposals shall be filed with the City Clerk on or before the time fixed in such notice, at which time the Board of Commissioners may let a contract for the building and construction of such sewers to the lowest and best responsible bidder or bidders therefore, if there be any whose bids do not exceed the estimated cost thereof, but said Board shall reserve the right to reject any or all such proposals, and if no bids shall be received within such estimate, the Board of Commissioners shall have the power to do such work and make such improvements with the estimated cost thereof as provided by law, Section 10. That for the cost of building and construction of such sewer, special assessments shall be made for the full cost thereof on all lots and pieces of land within and for which such sewer shall be built, according to the appraised value thereof, without regard to the buildings or improvements thereon. Section 11. After the passage and publication of this ordinance, the Board of Commissioners shall appoint three disinterested appraisers, who after having taken an oath to make a true and impartial appraisement of all lots and pieces of land liable to taxation for the cost of such improvements, shall within five days after having been notified of their appointumnts proceed to appraise all If the lots and pieces of land within the district liable to assessment and taxation as aforesaid, without regard to the buildings or improvements thereon, and after making such appraisements, shall return to the Board of Commissioners of said city and said Board shall designate a time for a special meeting of said Board for the purpose of hearing any complaints that may be made as to the value of any lot or piece of land appraised as aforesaid, of which special session due notice shall be given in the official city paper, at which special session said Board may alter any valuation of any lot or piece of land, if, in their opinion, the same has been appraised too high or too low. Section 12. The special assessment herein provided for may be paid by the person liable therefore in Ten approximately equal annual installments but the owner of any property liable to such assessment may within thirty days from the date of d6terMining the amount assessed against the property, pay the same in full and his property shall not be liable for any assessments for the cost of such improvements, and bonds as hereinafter provided for shall be issued in the amount of the cost of such improvements remaining unpaid at the end of the thirty days from the time NX such assessment is fixed. For the purpose of paying for the work and improvements in this ordinance provided for, the Board of Commissioners may and are hereby authorized and directed to issue' improvement bonds of the City of Salina, Kansas, in an amount not to exceed the total cost of such improvement, and to run for a period of ten years and be payable in ten approximately equal annual installments, together with interest not to exceed five per cent per annum, which bonds ahall be issued and payable according to law; and for the purpose of paying the principal and interest on said bonds as they severally become due and payable the Board of Commissioners shall apportion and assess against the lots and pieces of land within the taxing district of such improvements, special assessments covering the cost of such improvement and apportionment therein contained shall hold good for all of the installments that are to be collected from the specific property chargeable therefore, and with:. such improvementa; such assessment and apportionment ordinance shall contain the total amount of tax apportioned to eaehtract, piece or parcel of land within the taxing district and shall state the number of annual installments in which such tax is to be collected; and thereafter the City Clerk shall annually, at the same time that other taxes are certified, certify to the County Clerk of Saline;County, Kansas, a full list of all property liable for such work and improvement, #o. -ether with the respective amounts due on each of said tracts, pieces or parcels of land, which amounts ahall include the annual installment and interest on all unpaid. balbaces for one year at the rate of not to exceed five per cent per annum on such amounts so certified, which amounts shall be collected as other taikes are collected.
