6112 Storm Swr-Ingermanson HgtsS,'rn4.7F!)-S 4LRSA I ORDINANCE NUMBER 6112 (Published in The Salina Journal 11 c tiV'Li.1— 1956) AN ORDINANCE providing for the construction of a certain storm sewer and drainage in the City of Salina, Kansas, to be designated as Ingermanson Storm Sewer, and providing for the letting of contract for such construction and for the payment of the cost thereof. WBEREAS, at all times heretofore, the entire City of Salina, Kansas, has constituted a storm' sewer and drainage district and bonds issued to pay the cost thereof and payable by IL general tax as provided by law; and f BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: I Section 1. That the preamble of this ordinance is hereby incorporated herein. That � i the entire City of Salina is hereby determined to be the bedefit district for the purpose of !� the installation of a system of storm sewers and drainage in the said city. That the entire �I I limits of said city has always constituted one district for said purposes. Section 2. That it is necessary and it is hereby ordered that a storm sewer, which is hereby designated as Ingermanson Storm Sewer, together with all necessary inlets, inlet I i connections, manholes, connecting lines, sluice gates and other appurtenances, be constructed in the City of Salina along the following course, to -wit: a 60" pipe sewer beginning with a concrete storm sewer outfall located at the intersection of Dry Creek and 10' north of the east and west center line of the NNW ­,1 of Section 26, Township 14 South, Range 3 West of the 6th P. M. Saline County Kansas, thence east with a 60" storm Sewer on a line 10' north of the center line of the NW' of Section 26, Township 14 South, Range 3 West, to the center line of Roberts Avenue, Thence continuing east with a 54" storm sewer pipe to the canter line of Ingman Road, thence continuing east with a 4811 storm sewer pipe to the center line of Page Avenue, thence continuing east with a 36" storm j sewer pipe to the center line of Haskett Avenue, thence north i along the center line of Haskett Avenue with a 24" storm sewer I to hhe center line of Maple Avenue, thence continuing north with a 21" strom sewer to the center line of Willis Avenue, thence continuing north with an 18" storm sewer to the center line of Cloud Avenue, which will be the terminus of the storm sewer project. Section 3. That on or before the 18th day of December , 1956, the City Engineer i j shall prepare and file in the office of the City Clerk, detailed plans and specifications for the construction of the storm sewer provided for in Section 2 of this ordinance with vitrified and/or corrugated metal pipe, bituminous coated, and/or concrete sewer pipe or any combination of such typed of sewer pipe and on or before the same date shall prepare and file, in the office of the City Clerk, under oath, a detailed estimate of the cost thereof. After such plans and specifications and estimate of host shall have been filed, the City Clerk shall advertise by advertisements published in the official city paper for at least three consecutive days for sealed proposals for the building and construction of such storm sewer i jand at the time and place mentioned, the Board of Commissioners may let a contract with the lowest and best responsible bidder for the building and construction of such storm and drainage sewers, but the right to reject any and all bids shall be and it is hereby reserved, and provided further that if no responsible person shall purpose to enter a contract at a price not CON S TEE, SALINA exceeding the estimated cost, then the Board may proceed to construct said improvements within the estimated cost thereof and shall purchase the necessary tools, apparatus, and materials and employ the necessary labor for the purpose of constructing the sewer. i Section 4. That for the payment of the cost of said work, the Board of Commissioners shall issue General Obligation and Improvement Bonds of the City of Salina, Kansas, in an amognt not to exceed the total cost of such work and improvements, to be payable in ten approximately equal annual installments and to bear interest at not to exceed five per cent i per annum and from the date of such bonds, and for the purpose of paying such bonds and interest as they severally become due, the Board of Commissioners shall annually levy a tax upon all real and personal property in the City of Salina in an amount sufficient to pay the annual installments of such principal and interest, and that pending the issuance of such bonds, temporary notes shall be issued according to law, to pay the cost of such work. Section 5. This ordinance shall take effect and be in force from and after its publication in the official city paper.
