03-13-1978 Minutes76 City of Salina, Kansas Regular Meeting of the Board of Commissioners March 13, 1978 The Regular Meeting of the Board of Commissioners met in the CommissioneN Room, City -County Building, on Monday, March 13, 1978, at four o'clock P.M. The Acting Mayor asked everyone to stand for the opening ceremony. There were present: Acting Mayor Gerald F. Simpson, Chairman presiding Commissioner Dan S. Geis Commissioner Karen M. Graves comprising a quorum of the Board, also: L. 0. Bengtson, City Attorney Norris D. Olson, City Manager M. E. Abbott, Acting City Clerk Absent: Mayor Keith G. Duckers Commissioner Jack Weisgerber D. L. Harrison, City Clerk The Minutes of the Regular Meeting March 6, 1978 were approved as printed. THE ACTING MAYOR PROCLAIMED the Week of March 19 through 25, 1978 - ''HOLY WEEK''. The proclamation was read by Rev. Herman VanArsdale, First Baptist Church. The Acting Mayor congratulated the boys and girls basketball teams of South High and the boys basketball team of Sacred Heart High for their representat of their schools and the city at the State Basketball Tournament. STAFF AGENDA THE COMMISSIONERS considered an ordinance for second reading providing for the rezoning of Lot 3, Block 1, Tolle Subdivision from District RS to R-2/P.D. requested in Zoning Application 77-20A, filed by James Ward. PETITION NUMBER 3688 was filed by residents within 200 feet of the proposed rezoning. A motion was made by Commissioner Graves, seconded by Commissioner Geis to table the matter for one week so all the Commissioners can be present. Ayes: (3). Nays: (0). Motion carried. AN ORDINANCE was introduced for second reading entitled: ''AN ORDINANCE providing for the amendment of Ordinance Number 8526, the same being Chapter 36 of the Salina Code, and the Zoning District Map therein and thereby adopted and providing for the rezoning of certain property within the City and prescribing the proper uses thereof.'' [Z78-1 filed by Leonard and Lorieta Loy for the rezoning of the West 210 feet of the South 65 feet of Lot 2, Block 1, Tolle Subdivision from District RS to R-1 (Single Family Residential).] A motion was made by Commissioner Geis, seconded by Commissioner Graves to adopt the ordinance as read and the following vote was had: Ayes: Geis, Graves, Simpson (3). The ordinance was introduced for first reading February 27, 1978. AN ORDINANCE was introduced for second reading entitled; "AN ORDINANCE creating and establishing the Salina Park Advisory Board; providing for the appointment of its members; and defining its duties, enacting Article IV of Chapter 25 of the Salina Code." A motion was made by Commissioner Geis, seconded by Commissioner Graves to adopt the ordinance as read and the following vote was had: Ayes: Geis, Graves, Simpson (3). Nays: (0). Commissioner Weisgerber and Mayor Duckers absent. Carried. The Acting Mayor approved the ordinance and it is numbered 8626. The ordinance was introduced for first reading March 6, 1978. AN ORDINANCE was introduced for second reading entitled: "AN ORDINANCE providing for the vacation of Jewell Avenue and an unnamed street in Nazarene Addition to the City of Salina, Saline County, Kansas." A motion was made by Commissioner Graves, seconded by Commissioner Geis to adopt the ordinance as read and the following vote was had: Ayes: Geis, Graves, Simpson (3). Nays: (0). Commissioner Weisgerber and Mayor Duckers absent. Carried. The Acting Mayor approved the ordinance and it is numbered 8627. The ordinance was introduced for first reading March 6, 1978. THE CITY ENGINEER reported on the sufficiency of Petition Number 3684, filed by G & K, Inc. for street and utility improvements to serve Lots 16 through 22, Block 8, Replat of Lot 22, Block 3 and Lot 9, Block 6, Dow Addition, that the petition is sufficient as the petitioner owns 55% of the property within the benefit district. A motion was made by Commissioner Geis, seconded by Commissioner Graves to accept the City Engineer's report and approve the petition. Ayes: (3). Nays: (0). Motion carried. THE CITY ENGINEER reported on the sufficiency of Petition Number 3685, filed by George Etherington for street and utility improvements in Georgetown Addition, that the petition is sufficient as the petitioner owns 51% of the property within the benefit district. A motion was made by Commissioner Graves, seconded by Commissioner Geis to accept the City Engineer's report and approve the petition. Ayes: (3). Nays: (0). Motion carried. THE CITY ENGINEER reported on the sufficiency of Petition Number 3686, filed by William Chaffee for street and utility improvements in Georgetown Addition, that the petition is sufficient as the petitioner owns 51% of the property in the benefit district. A motion was made by Commissioner Geis, seconded by Commissioner Graves to accept the City Engineer's report and approve the petition. Ayes: (3). Nays: (0). Motion carried. ARCHITECT, R. Kenneth Bieberly, Architectural Services Plus, filed plans and specifications for Carver Neighborhood Center. A motion was made by Commissioner Graves, seconded by Commissioner Geis to accept the plans and specifications as filed. Ayes: (3). Nays: (0). Motion carried. A MOTION was made by Commissioner Graves, seconded by Commissioner Geis to set the date of April 3, 1978 as the date to receive bids on the Carver Neighborhood Center, and instruct the City Clerk to advertise for bids. Ayes: (3). 'Nays: (0). Motion carried. t -4Q to A RESOLUTION was introduced and passed entitled: "A RESOLUTION determini� the advisability of curbing, guttering, paving, grading, water main and services, sanitary sewer improvements, estimating the cost thereof, defining the boundaries i of the improvement district, method of assessment, and apportioning the cost between the improvement district and the City -at -large." (Engineering Project 78-634 - Country Club Estates Addition Number 3, requested in Petition Number 3675 filed by Roy Presley). A motion was made by Commissioner Geis, seconded by Commissioner Graves, to adopt the Resolution as read and the following vote was had: Ayes: Geis, Graves, Simpson (3). Nays: (0). Commissioner Weisgerber and Mayor Duckers absent. Carried. The Acting Mayor approved the Resolution and it is numbered 3355• A RESOLUTION was introduced and passed entitled: "A RESOLUTION granting assurances to the U. S. Department of Housing and Urban Development that the City of Salina will comply with certain Federal laws hereinafter set forth." (For the Fourth Year Community Block Grant Program application). A motion was made by Commissioner Graves, seconded by Commissioner Geis to adopt the Resolutior as read and the following vote was had: Ayes: Geis, Graves, Simpson (3). Nays: (0). Commissioner Weisgerber and Mayor Duckers absent. Carried. The Acting Mayor approved the Resolution and it is numbered 3356• A RESOLUTION was introduced and passed entitled: "A RESOLUTION authorizing the preparation and filing with the Department of Housing and Urban Development of a Fourth Year Community Development Block Grant Program application designating the City Manager as the authorized representative of the City of II Salina to act in connection with the application; and to provide such additional information as may be requested." A motion was made by Commissioner Geis, seconded by Commissioner Graves to adopt the Resolution as read and the following; vote was had: Ayes Geis, Graves, Simpson (3). Nays: (0). Commissioner WeisgerbeJ and Mayor Duckers absent. Carried. The Acting Mayor approved the Resolution and it is numbered 3357• A LETTER was received from the City Planning Commission recommending il the approval of Zoning Application 77-25, as amended, filed by Salina Mobile Homes, Inc., by Joe Kroneberger, for amendment of the zoning ordinance to includelj mini -warehouses as a conditional use in Districts C-3 and C-5, and as a permittedii ;) use in Districts C-4, C-6, 1-1, 1-2, and 1-3. A motion was made by Commissioner Graves, seconded by Commissioner Geis to accept the recommendation of the City Planning Commission and approve the request, and to introduce an ordinance for I� first reading to amend Chapter 36 of the Salina Code. I Ordinance Passed: Number: A LETTER was received from the City Planning Commission regarding County Zoning Request CZ78-2, filed by Ken Nordboe, and recommended that Tract #1 (west of Dry Creek) be rezoned to "F" (Light Industrial) or "IL(FP) (Light Industrial - Flood Plain) subject to platting and adoption of the new County Zoning Regulations and maps; and recommended that Tract #2 be denied at the request of the applicant. A motion was made by Commissioner Geis, seconded by Commissioner Graves to accept the recommendation of the City Planning Commission and recommend that Tract #1 be approved, and Tract #2 be denied in County Zoning Application CZ78-2. Ayes: (3). Nays: (0). Motion carried. A LETTER was received from the City Planning Commission recommending that the City Commission instruct the Engineering Department to begin acquisition of additional right-of-way on North Oakdale Avenue between Johnstown and Ash; and that the City Commission initiate a project of design and construction of street improvements to Ohio Street from Greeley to Elm. A motion was made by Commissioner Graves, seconded by Commissioner Geis to accept the letter from the City Planning Commissioner. Ayes: (3)• Nays: (0). Motion carried. 1 1 PUBLIC AGENDA PETITION NUMBER 3687 was filed by David Werth for the vacation of Country Hills Court and Country Hills Terrace in Block 1, Country Hills Addition Number 2. A motion was made by Commissioner Geis, seconded by Commissioner Graves to refer the petition to the City Engineer for a recommendation. Ayes: (3)• Nays: (0). Motion carried. PETITION NUMBER 3689 was filed by Charles Howison for the approval of the plat of Howison Subdivision in the Southwest Quarter of Section 13, Township 13 South, Range 3 West. A motion was made by Commissioner Graves, seconded by Commissioner Geis to refer the petition to the City Planning Commission. Ayes: (3)• Nays: (0). Motion carried. COMMISSION AGENDA A motion was made by Commissioner Graves, seconded by Commissioner Geis,'.. to add appointments to boards and commissions to the agenda for consideration. Ayes: (3). Nays: (0). Motion carried. THE ACTING MAYOR, with the approval of the Commissioners, made the following appointment: Salina Arts Commission Charles Roth appointed to succeed Ken Klostermeyer for a 3 year term to March 10, 1981. The Commissioners brought the following items to the floor for discussion: Commissioner Simpson asked that a report by the City Engineer be placed on the agenda March 20, 1978, on the drainage problem in Country Club Heights # 5• Commissioner Graves asked about the status of the Kanopolis Water District. Mr. Bengtson reported it is premature at this time to assume the district will be dissolved, but the city should be thinking about alternatives in the event; this should happen. Commissioner Geis asked about the status of the Hay Report. Mr. Olson reported that a meeting between Hay Associates and the Commissioners is tentatively scheduled for March 21, 1978 in the afternoon. A MOTION was made by Commissioner Geis, seconded by Commissioner Graves that the Regular Meeting of the Board of Commissioners be adjourned. Ayes: (3). Nays: (0). Carried.
