Lot 19, Block 9 EASEMEI'IT FOR SEWER PIPE
For and in consideration of the sum of one dollar and other valuable
consideration, the receipt of which is hereby acknc~.~ledged, Duane E, Logback
and deannette M. Logback, grantors, do hereby grant to Darold G. Greene,grantee,
their successors, heirs, or assigns, the right of way to lay, maintain, repair,
inspect and operate a sewer line for the transportation of sewage and other
waste, water and other substances~ together with such valves, fittings, and
similar appurtenances as may be necessary or convenient to the operation of the
said sewer line, on, over, or through a certain lot si t uat~on in Saline
County, Kansas~ described as follows:
East 61 feet~ Lot 19, Block
Bonnie Ridge Subdivision of Sallne
Count~ ~ Kansas;
with ingress and egress to and from the same. The said grantors, ~heir heirs
and assigns hereby agree that no structure shall be effected over said sewer
line which witl interfere w~th its operation, but are othe~vise to fully use
and enjoy sa~d premises except fo~ the purposes hereinbefore g~anted to said
grantee, who hereby agrees to pay any damages which may arise to the land from
the laying,maintaining, operating~ and removing of said sewer line, said damage
if not mutually agreed upon~ to be ascertained and determined by three disin-
~ terested persons, one thereof to be appointed by the ~aid grantors~ heirs~ or
assigns, one by the said ~rantee~ successors or assigns, and the third by the
two appointed aforesaid, and the.award of thEee such persons shall be final
and conclus ive.
~ All sewer pipe under this grant shall be laid on a right of way which shall
be within the following described area as~follows: One. line from the North
boundary to the South boundary and 10' ~t from the~ boundary of Lot 19,
~lock 9, Bonnie Ridge Subdivision of Saline County, Kansas; and shall be buried
to such a depth as not to interfere with the ordinary use of the land.
This agreement is binding on the hei, rs, representatives, ~nd successors
and assigns of the respective parties thereto:
