and providing for the payment of the cost thereof, and kow the same shall be assessed and the manner of the payment of the coat thereof. i WHEREAS, by Resolution Numbers 1964, 1965, 1966, 1967, 1968, 1969, 1970, 1971, 1972, 1973) 1974, 1975, 1976, 1977, 1978, 1979, 1980, 1981 and 1982, duly adopted on April 1, 1958, by the Board of Commissioners of the City of Salina, Kansas, have declared that they deem it necessary to resurface College Avenue (37.5 feet wide from curb to curb) with hot mixed asphaltic concrete from the south line of Park Street to the north line of Walnut Street; resurface Mulberry (47.3 feet wide from curb to curb) with hot mixed asphaltic concrete from the west line of Santa Fe Avenue to the east line of Ninth Street; resurface Prescott Avenue (36 feet wide from curb to curb) with hot mixed asphaltic concrete from the west line of Fourth Street to the east line of Santa Fe Avenue; resurface Morrison Avenue (25 feet wide from curb to curb) with hot mixed asphaltic concrete from the west line of Ninth Street to the east line of Tenth Street; resurface Weil Place (28.5 feet wide from curb to curb) with hot mixed asphaltic concrete from the east line of Eighth Street to the west line of Seventh Street. 1 1 1 AL[NA WHEREAS, said Resolutions were published in The Salina Journal for six days, a daily news- peper, published in said City, and being the official city paper, and the majority of the resident property owners owning a majority of square feet of the lots or real estate liable to taxation for the cost of said improvements did not within twenty days from the date of the last publication thereof file with the City Clerk sufficient protest in writing against the making of said improvement, no protests of any kind having been filed, $0 NOW, THEREFORE, BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That it is necessary and it is hereby ordered that College Avenue, from the south line of Park Street to the north line of Walnut Street be resurfaced with hot mixed asphaltic concrete (37.5 feet wide from curb to curb) along with such grading as may be necessary therefore. Section 2. That it is necessary and it is hereby ordered that Mulberry, from the west line of Santa Fe Avenue to the east line of Ninth Street be resurfaced with hot mixed asphaltic concrete (47.3 feet wide from curb to curb) along with such grading as may be necessary therefore. Section 3. That it is necessary and it is hereby ordered that Prescott Avenue, from the west line of Fourth Street to the east line of Santa Fe Avenue be resurfaced with hot mixed asphaltic concrete (36 feet wide from curb to curb) along with such grading as may be necessary therefore. Section 4. That it is necessary and it is hereby ordered that Prescott Avenue, from the west line of Santa Fe Avenue to the east line of Highland Avenue be resurfaced with hot mixed asphaltic concrete (30.3 feet wide from curb to curb) along with such grading as may be necessary therefore. Section 5. That it is necessary and it is hereby ordered that Prescott Avenue , from the east line of Highland Avenue to the east line of Ninth Street be resurfaced with hot mixed asphaltic concrete (40.2 feet wide from curb to curb) along with such grading as may be necessary therefore. Section 6. That it is necessary and it is hereby ordered that Fifth Street, from the south line of Prescott Avenue to the north line of Republic Avenue be resurfaced with hot mixed asphaltic concrete (30 feet wide from curb to curb) along with such grading as may i I be necessary therefore. That it is necessary and it is hereby ordered that Ash Street, from the west line of Ninth Street to the Missouri Pacific Railroad Tracks be resurfaced with hot mixed asphaltic concrete (38.5 feet wide from curb to curb) along with such grading as may be necessary therefore. Section 11. That it is necessary and it is hereby ordered that Tenth Street from the south line of Ash Street to the north line of Iron Avenue be resurfaced with hot mixed asphaltic concrete (37.5 feet wide from curb to curb) along with such grading as may be necessary therefore. j I Section 12. That it is necessary and it is hereby ordered that Highland Avenue from the south line of Prescott Avenue to the north line of Republic Avenue be resurfaced with hot mixed asphaltic concrete (34.3 feet wide from curb to curb) along with such grading as i may be necessary therefore. That it is necessary and it is hereby ordered that Tenth Street from the southlline of Walnut Street to the north line of South Street be resurfaced with hot mixed asphaltic concrete (30 feet from to wide curb curb) along with such grading as may be necessary therefore. Section 14. That it is necessary and it is hereby ordered that South Street from the west line of Fourth Street to the west line of Eighth Street be resurfaced with hot mixed asphaltic concrete (37.2 feet wide from curb to curb) along with such grading as may be necessary therefdre. Section 16. That it is necessary and it is hereby ordered that Elm Street from the west line of Seventh Street to the east line of Ninth Street be resurfaced with hot mixed i asphaltic concrete (47.2 feet wide from curb to curb) along with such grading as may be necessary therefore. Section 17. That it is necessary and it is hereby ordered that Tenth Street from the i south line of South Street to the south line of Morrison Avenue be resurfaced with hot mixed asphaltic concrete (25.2 feet wide from curb to curb) along with such grading as may be necessary therefore. Section 18. That it is necessary and it is hereby ordered that Morrison Avenue from the west line of Ninth Street to the east line of Tenth Street be resurfaced with hot mixed i asphaltic concrete (25 feet wide from curb to curb) along with such grading as may be necessary therefore. i Section 19. That it is necessary and it is hereby ordered that Weil Place from the east line of Eighth Street to the west line of Seventh Street be resurfaced with hot mixed asphaltic concrete (28.5 feet wide from curb to curb) along with such grading as may be necessary therefore. Section 20. That for the work and improvements herein provided for the City Engineer shall make and file with the City Clerk on or before the 3rd day of June, 1958, complete plans and specifications for the resurfacing and grading with excavation necessary therefore, of the streets described in Sections 1 to 19, of this ordinance, with the following type of improvements Resurfacing with one or more courses, either binder, or surface, or both, of hot -mixed, hot laid asphaltic mixtures composed of asphalt cement and aggregate constructed on a prepared base or existing pavement in accordance with these specifications and in conformity with the lines, grades, widths, thicknesses and typical sections shown on the Plans. and said Engineer shall on or before the same date submit to the a � , Board of Commissioners under oath, detained estimates of the cost of such work and improvements. Section 21. That after such plans and specifications have been made and prepared by the City Engineer and filed with the City Clerk as aforesaid, the Board of Commissioners may advertise by advettisement published in the official city paper of the City of Salina, Kansas for three consecutive days for the receipt of sealed proposals for the improving of said streets with the kind of material named and specified in the preceding Section hereof, and for the excavation and grading necessary for the completion of such work and after the receipt of such proposals, the said Board of Commissioners may and are hereby authorized and directed to let contracts for the improving of said streets with the materials selected by them to the lowest responsible bidder or bidders therefore, as determined by the Board of Commissioners, and for such excavation and grading, said Board reserves the right to reject airy and all bids. Section 22. That for the improving of the above mentioned streets, such assessments shall be made for the full cost thereof according to law, on all lots and pieces of land to the center of the block on either side of the street to be improved according to:the appraisers valuation thereof, without regard to the buildings or improvements thereon for the distance to be improved. Section 23. That after the passage and publication of this ordinance, the Board of Commissioners shall appoint three disinterested appraisers, householders, who after having CONS. 17.1DATF.D-SALLNA 1 taken an oath to make a true and impartial appraisement of all lots and pieces of land liable to assessment and taxation as aforesaid, as may be designated by the Board of Commissioners of said City, without regard to the buildings or improvements thereon and after making such appraisement shall return to the Board of Commissioners of the City of Salina, and said Board of Commissioners shall designate a time and place for the hearing of any complaints that may be made as to the value of any lots and pieces of land appraised as aforesAid, of which due notice shall be given in the official city paper, at which hearing the Board of Commissioners may alter any valuation of any lot or piece of land, if, in their opinion the same has been appraised too high or too low. Section 24. That for the purpose of paying the cost of the work and improvements in this ordinance provided for, the Board of Commissioners are hereby authorized and directed to issue Internal Improvement Bonds of the City of Salina in an amount not to exceed the contract price or cost of such improvements and to run for a period of ten years and be payable in ten installments, together with interest not to exceed five per cent (5%) per annum, which bonds shall be made payable at the Fiscal Agency of the State of Kansas and for the purpose of paying the principal and interest on said bonds as they severally become due and payable, the Board of Commissioners shall apportion and assess against the lots and pieces of land within the taxing district of such improvements special assessments covering the cost of such improvements .► and the apportionment herein contained shall hold good for all of the installments that are to r ` be collected for the specific property chargeable with said improvements, such assessments and japportionment ordinance shall contain the total amounts of tax apportioned to each tract, piece or parcel of land within the taxing district and shall state the number of annual installments in which such tax is to be collected; and thereafter the City Clerk shall annually at the same -r` time other taxes are certified, certify to the County Cldrk of Salina County, Kansas, a full ?' list of all property liable for such work and improvements, together with the respective h ' I t- �u ✓ amounts due on each of said tracts, pieces or parcels of land, which amounts shall include the annual installments and interest on all unpaid balances for one year at the rate of not to exceed five per cent per annum on such amounts so certified which shall be collected as other taxes are collected, PROVIDED, that for the purpose of defraying the cost of improving the intersections and areas formed by the crossing of streets and alleys, and for the grading of said streets where the same is provided for in this ordinance as well as where the improvement is through or adjacent to property of the City for which the City is liable, the assessment will be made against all taxable property of the City and paid by the City at large.
