6233 Street Improvements1 1 AN ORDINANCE ratifying and confirming a contract with the 0. D. Wilmoth Construction Company for the construction of certain curbing, guttering, paving and grading improvements on certain streets in the City of Salina, Kansas, and providing for the issuance of temporary notes to pay the oost thereof pending the issuance and sale of bonds. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That the acceptance by the City of Salina, of the proposal of the 0. D. Wilmoth Construction Company, hereinafter referred to as the "Contractor" as submitted to the Board of Commissioners on April 29, 1958, which is hereby found to be the lowest and best bid for such work, and the contract awarded by the Board of Commissioners of said City to said Contractor and signed on behalf of the City by its Mayor on May 6, 1958, for the construction of certain public improvements in the City of Salina, Kansas, to -wit: Curbing, guttering, paving, and grading of Beverly Drive with concrete (thirty-three (33) feet wide from back of curb to back of curb) from the east line of Duvall Avenue to the west line of Whi.ttinghill Avenue, as provided for by Resolution Number 1915 and Ordinance Number 6222. Paving and grading of Charles Street with concrete (twenty- eight (28) feet wide from toe of gutter to toe of gutter) from the east line of Montrose Street to the east line of Phillips Street, as provided for by Resolution Number 1920 and Ordinance Number 6222.. Paving and grading of Franklin Avenue with concrete (twenty- eight (28) feet wide from toe of gutter to toe of gutter) from the west line of Eleventh Street to the east line of Sherman Street, as provided for by Resolution Number 1924 and Ordinance Number 6222. Paving and grading of Franklin Avenue with concrete (twenty- eight (28) feet wide from toe of gutter to toe of gutter) from the vest line of Ninth Street to the east line of Tenth Street, as provided for:°by Resolution Number 1925 and Ordinance Number 6222. COSSCiL TDA'^D-SALTNA 1 1 1 at and for the unit price for said work contained in said proposal,which proposal and contract are hereby referred to and made parts of this ordinance, be and the same is hereby ratified and confirmed, said proposal being within the estimated cost of said improvements as shown by the sworn estimates of the City Engineer on file in the office of the City Clerk, which estimates are hereby referred to and made a part of this ordinance. Section 2. Said improvements shall be built and constructed in accordance with the plans and specifications therefore prepared by the City Engineer on file in the office of the City Clerk and in accordance with the proposal of said contractor and under the terms of said contract, all of which are hereby referred to and made a part of this ordinance. Section 3. That temporary notes signed by the Mayor and attested by the City Clerk be issued from time to time as the work progresses in the manner and form as required by law, the total amount thereof not to exceed the amount of $131,940.00 for such work, such notes to bear interest not to exceed 5 per cent per annum and, to mature not later than December 1, 1959, and to be issued in such amounts and at such times as money for the payment of the cost Of such notes being issued to said contractor and to be redeemed and cancelled at the time that permanent bonds are issued in lieu thereof. i Section 4. This ordinance shall take effect and be in force from and after its adoption and publication once in the official city paper.
