ORDINANCE NO.
AN ORDINANCE AUTHORIZING THE ISSUANCE OF INTERNAL IMPROVEMENT BONDS OF
THE CITY OF SALINA, KANSAS, IN THE AMOUNT OF $666,000, FOR THE PURPOSE
OF PAYING THE COST OF IMPROVEMENTS CONSTITUTING A PART OF THE FLOOD
CONTROL SYSTEM OF SAID CITY AND THE DAMAGES OCCASIONED BY REASON THEREOF
AND THE COST OF RIGHT OF WAY CONSTITUTING A PART OF SAID SYSTEM.

WHEREAS, pursuant to the provisions of Sections 12-635 to
12-646a, General Statutes of Kansas, 1949, and all amendments thereto,
the governing body of said City has proceeded in conformity with law
to carry out a flood control system, and
HHEREAS, the costto the City of Salina, Kansas, of the im-
provements to said flood control system and the damages occasioned by
reason thereof and the cost of right of way constituting a part of said
system amount to $666,000 and the City is authorized to issue bonds pur-
suant to said statutory provisions to pay such cost,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS
OF THE CITY OF SALINA, KANSAS:
Section 1. That for the purpose of paying the cost of improve-
ments constituting a part of the flood control system of said City and
the damages occasioned by reason thereof and the cost of right of way
constituting a part of said system, there shall be issued and hereby are
issued Internal Improvement Bonds of the City of Salina, Kansas, in the

total principal amount of $666,000. Said issue shall constitute Series
FL -173, and shall consist of 666 bonds, numbered from 1 to 666, inclu-
sive, all of said bonds being in the denomination of $1,000 each. All
of said bonds shall be dated May 1, 1958, and said bonds shall be
numbered and shall become due serially, without option of prior payment,
as follows:

Bonds numbered 1 to 138, inclusive, shall bear interest at
the rate of three per cent (30) per annum; bonds numbered 139 to 204,
inclusive, shall bear interest at the rate of two per cent (20) per
annum; bonds numbered 205 to 336, inclusive, shall bear interest at the
rate of two and one quarter per cent (2 1/4j,) per annum; bonds numbered
1337 to 402, inclusive, shall bear interest at the rate of two and one
half per cent (2 1/2%) per annum; bonds numbered 403 to 501, inclusive,
shall bear interest at the rate of two and three quarters per cent
(2 3/4%) per annum and bonds numbered 502 to 666, inclusive, shall bear
interest at the rate of three per cent (30) per annum. Said interest
shall be payable March 1, 1959, and thereafter semiannually on September;
1 and March 1 in each year. Both principal of and interest on said
bonds shall be payable at the office of the State Treasurer of the
State of Kansas in the City of Topeka, Kansas.
Section 2. Said bonds shall be executed by the Mayor and
shall be attested by the City Clerk, and the corporate seal of the City
shall be affixed thereto. Said bonds shall have interest coupons

attached thereto representing the interest on said bonds, and said
interest coupons shall bear the facsimile signatures of the Mayor and
City Clerk of said City.
Section 3. Said bonds and interest coupons and the certifi-
cates to appear on said bonds shall be in substantially the following

the County of Saline, State of Kansas, acknowledges itself to be in-
debted, and for value received hereby promises to pay to the bearer, on

This bond is one of a series of 666 bonds of like date and
tenor, excepting interest rate and maturity, numbered from 1 to 666,
inclusive, and designated Series FL -178, aggregating the principal
amount of $666,000, issued by the City of Salina, Kansas, for the pur-
pose of paying the cost of improvements constituting a part of the floo$
control system of said City and the damages occasioned by reason thereof
and the cost of right of way constituting a part of said system, by theli
authority of and in full compliance with the provisions, restrictions
and limitations of the Constitution and Laws of the State of Kansas,
including Sections 10-101 to 10-127, inclusive, and 12-63� to 12-646a j
of the General Statutes of Kansas, 1949, and all amendments thereto,
and all other provisions of the laws of said State applicable thereto,
and this bond and all other bonds of said series, and all interest
thereon, are to be paid by said City of Salina, Kansas.

Section 4. The Mayor and City Clerk are hereby authorized and
;directed to prepare and execute the bonds hereinbefore described, and
to procure the proper registration thereof, and to deliver said bonds
to the purchaser thereof on payment of the purchase price therefor.
:The proceeds of said bonds shall be placed in the City treasury and
shall be applied for the sole purpose of paying; the cost of the improve-
ments hereinbefore described.
Section 5. The full faith, credit and resources of the City
of Salina, Kansas, shall be, and the same hereby are pledged for the
prompt payment of said bonds and all interest 'hereon, as the same
mature. The Board of Commissioners of the City of Salina, Kansas,
,shall annually make provision for the payment of the principal and
.interest on said bonds as the same become due, by levying and collecting
the necessary taxes therefor in the manner provided by law.
Section 6. This ordinance shall take effect and be in force
from and ager its passage and publication in the Salina Journal.
