AN ORDINANCE providing for the curbing, guttering, paving and grading of Carlton Place
(thirty-three (33) feet wide from back of curb to back of curb) with two 2 inch hot asphalt
mix over a six (6) inch crushed rock base, from the west line of Page Avenue to the west
side of Ingman Road; Curbing, guttering, paving and grading of Claremont Drive (thirty-
one (31) feet wide from back of curb to back of curb) with two (2 inch hot asphalt mix
over a six (6) inch crushed rock base, from the south line of Greeley Avenue to the south
line of Ruskin Road; curbing, guttering, paving and grading of Edgehill Road (thirty-
three (33) feet wide from back of curb to back of curb) with two inch hot asphalt mix
over a six (6) inch crushed rock base, from the south line of Knollcrest Drive to the east
line of Seitz Drive; curbing, guttering, paving and grading of Fairdale Road (thirty-three
(33) feet wide from back of curb to back of curb) with two (2) inch hot asphalt mix over a
six (6) inch crushed rock base, from the north line of Edgehill Road to the south line of
Melrose Lane; curbing, guttering, paving and grading of Fairdale Road with concrete
(thirty-three (33) feet wide from back of curb to back of curb) from the south line of
Melrose Lane to the south line:of Overhill Road; paving and grading of Franklin Street
(twenty-eight (28) feet wide from toe of gutter to toe of gutter) with two 2 inch hot
asphalt mix over a six (6) inch crushed rock base, from the west line of Hancock Street to
the east line of Merrill Street; curbing, guttering, paving and grading of Hilldale Road
(thirty-three (33) feet wide from back of curb to back of curb) with reinforced concrete
from the north line of Melrose Lane to the north line of Lot 6, Block 4, of Country Club
Heights Addition Number three; curbing, guttering, paving and grading of Ingman Road
(thirty-three (33) feet wide from back of curb to back of curb) with two (2) inch hot
asphalt mix over a six (6) inch crushed rock base, from the north side of Carlton Place to
the north side of Lot 2, Block 7, Ingermanson Heights Addition; curbing, guttering, paving
and grading of Knollcrest Drive (thirty-three (33) feet wide from back of curb to back of
curb) with two 2 inch hot asphalt mix over a six (6) inch crushed rock base, from the east
line of Marymount Road to the west line of Melrose Lane; curbing, guttering, paving and
grading of Meadow Lane (thirty-three (33) feet wide from back of curb to back of curb) with
concrete from the east line of Fairdale Road to the west line of Hilldale Road; curbing,
guttering, paving and grading of Melrose Lane (thirty-three (33) feet wide from back of
curb to back of curb) with two (2 inch hot asphalt mix over a six (6) inch crushed rock
base, from the north line of Knollcrest Drive to the east line of Seitz Drive; resurfacing i
of Ninth Street with two (2) inch hot mixed asphaltic concrete from the south line of North
Street to the south line of Pacific Avenue; curbing, guttering, paving and grading of Page
Avenue (thirty-three (33) feet wide from back of curb to back of curb) with two (2) inch
hot asphalt mix over a six (6) inch crushed rock base, from the south line of Willis Avenue
to the south line of Carlton Place; paving and grading of Roach Street(twenty-eight (28)
feet wide from toe of gutter to toe of gutter) with two (2) inch hot asphalt mix over a
six (6) inch crushed rock base, from the south line of Cl.aflin Avenue to the north line
of Cloud Street; curbing, guttering, paving and grading of Ruskin Road (thirty-one (31)
feet wide from back of curb to back of curb) with two (2) inch hot asphalt mix over a six
(6) inch crushed rock base, from the east line of Claremont Drive to the west line of
Marymount Road; and providing for the payment of the cost thereof, and how the same shall be
assessed and the manner of the payment of the cost thereof.
WHEREAS, by Resolution Numbers 1890, 1943, 1882, 1899, 1900, 1872, 1885, 1891, 1880, 1886,
1881, 1916, 1892, 1910, 1944, duly Adopted -6n October 8, 1957, March 11, 1958, October 1,
1957, October 29, 1957, August 27, 1957, February 11, 1958, January 7, 1958, by the
Board of Commissioners of the City of Salina, Kansas, have declared that they deem it
necessary to curb, gutter, pave and grade Carlton Place with two (2) inch hot mix asphalt
over a six (6) inch crushed rock base, from the west side of Page Avenue to the west side
of Ingman Road; curb, gutter, pave and grade Claremont Drive (thirty-one (31) feet wide
from back of curb to back of curb) from the south line of Greeley Avenue to the south line
of Ruskin Road; curb, gutter, pave and grade Edgehill Road (thirty-three (33) feet wide
from back of curb to back of curb) with two (2) inch hot asphalt mix over a six (6) inch
crushed rock base, from the south line of Knollcrest Drive to the east line of Seitz Drive;
curb, gutter, pave and grade Fairdale Road (thirty-three (33) feet wide from back of curb
to back of curb) with two (2) inch of asp alt mix over a six (6) inch crushed rock base, from
the north line of Edgehill Road to the south line of Melrose Lane; curb, gutter, pave and
grade Fairdale Road with concrete (thirty-three (33) feet-mide from back of curb to back

WHEREAS, said Resolutions were published in The Salina Journal for six days, a daily news-
paper, published in said City, and being the official city paper, and the majority of the
resident property owners owning a majority of square feet of the lots or real estate liable
to taxation for the cost of said improvements did not within twenty days from the date of
the last publication thereof file with the City Clerk sufficient protest in writing against
the making of said improvement, no protests of any kind having been filed, SO NOW., THEREFORE,
j BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:

Section 1. That it is necessary and it is hereby ordered that Carlton Place, from
the west side of Page Avenue to the west side of Ingman Road, in said city, be curbed,
guttered, paved and graded to the established paving grade (thirty-three (33) feet wide
from back of curb to back of curb) with two (2) inch hot asphalt mix over a six (6) inch
crushed rock base, and paved between the guttering lines thereof.

Section 2. That it is necessary and it is hereby ordered that Claremont Drive, from
the south line of Greeley Avenue to the south line of Ruskin Road, in said city, be curbed,
guttered, paved and graded to the established paving grade (thirty-one (31) feet wide
from back of curb to back of curb) with two (2) inch hot asphalt mix over a six (6) inch

crushed rock base, and paved between the guttering lines thereof.

Section 3. That it is necessary and it is hereby ordered that Edgehill Road, from
the south line of Knollcrest Drive to the east line of Seitz Drive, in said city, be curbed,
guttered, paved and graded to the established paving grade (thirty-three (33) feet wide
from back of curb to back of curb) with two (2) inch hot asphalt mix over a six (6) inch
crushed rock, base, and paved between the guttering lines thereof.
Section 4. That it is necessary and it is hereby ordered that Fairdale Road, from
the north line of Edgehill Road to the south line of Melrose Lane, in said city, be curbed,
guttered, paved and graded to the established paving grade (thirty-three (33) feet wide
from back of curb to back of curb) with two (2) inch hot asphalt mix over a six (6) inch
crushed rock base, and paved between the guttering lines thereof.
■ Section 5. That it is necessary and it is hereby ordered that Fairdale Road, from

the south line of Melrose Lane to the south line of Overhill Road, in said city, be curbed,
guttered, paved and graded with concrete (thirty-three (33) feet wide from back of curb to
back of curb) with excavation necessary therefore, and paved between the guttering lines
thereof.
Section 6. That it is necessary and it is hereby ordered that Franklin Street, from
the west line of Hancock Street to the east line of Merrill Street, in said city, be paved
and graded to the established paving grade (twenty-eight (28) feet wide from toe of gutter
to toe of gutter) with two (2) inch hot asphalt mix over a six (6) inch crushed rock base,
and paved between the guttering lines thereof.
Section 7. That it is necessary and it is hereby ordered that Hilldale Road, from
the north line of Melrose Lane to the north line of Lot 6, Block 4, Country Club Heights
Addition Plumber three, in said city, be curbed, guttered, paved and graded to the
established paving grade (thirty-three (33) feet wide from back of curb to back of curb)
with reinforced concrete, and paved between the guttering lines thereof.
Section 8. That it is necessary and it is hereby ordered that Ingman Road, from
the north side of Carlton Place to the north side of Lot 2, Block 7, Ingermanson Heights
Addition, in said city, be curbed, guttered, paved and graded to the established paving
grade (thirty-three (33) feet wide from back of curb to back of curb) with two (2) inch
hot asphalt mix over a six (6) inch crushed rock base, and paved between the guttering lines',
thereof.
Section 9. That it is necessary and it is hereby ordered that Knollcrest Drive, from
the east line of Marymount Road to the west line of Melrose Lane, in said city, be curbed,
guttered, paved and graded to the established paving grade (thirty-three (33) feet wide
from back of curb to back of curb) with two (2) inch hot asphalt mix over a six (6) inch
crushed rock base, and paved between the guttering lines thereof.
Section 10. That it is necessary and it is hereby ordered that Meadow Lane, from
the east line of Fairdale Road to the west line of Hilldale Road, in said city, be curbed,
guttered, paved and graded to the established paving grade (thirty-three (33) feet wide
from back of curb to back of curb) with concrete, and paved between the guttering lines
thereof.
Section 11. That it is necessary and it is hereby ordered that Melrose Lane, from
the north line of Knollcrest Drive to the east line of Seitz Drive, in said city, be curbed,
guttered, paved and graded to the established paving grade (thirty-three (33) feet wide from
back of curb to back of curb) with two (2) inch hot asphalt mix over a six (6) inch crushed
rock base, and paved between the guttering lines thereof.

Section 12. That it is necessary and it is hereby ordered that.Ninth Street, from
the south line of North Street to the south line of Pacific Avenue, in said City, be
resurfaced with hot mixed asphaltic concrete, with such grading as may be necessary for
the completion of said work.
Section 13. That it is necessary and it is hereby ordered thatPage Avenue, from the
south line of Willis Avenue to the south line of Carlton Place, in said city, be curbed,
paved and
guttered p graded to the established paving grade (thirty-three (33) feet wide from
back of curb to back of curb) with two (2) inch hot asphalt mix over a six (6) inch crushed
rock base, and paved between the guttering lines thereof.

Section 14. That it is necessary and it is hereby ordered that Roach Street, from
the south line of Claflin Avenue to the north line of Cloud Street, in said city, be paved

and graded to the established paving grade (twenty-eight (28) feet wide from toe of gutter

to toe of gutter) with two (2) inch hot asphalt mix over a six (6) inch crushed rock base,
and paved between the guttering
lines thereof.
Section 15. That it is necessary and it is hereby ordered that Ruskin Road, from the
east line of Claremont Drive to the 'last line of Marymount Road, in said city, be curbed,
guttered, paved and graded to the established paving grade (thirty-one (31) feet wide from
back of curb to back of curb) with two (2) inch hot asphalt mix over a six (6) inch crushed
rock base, and paved between the guttering lines thereof.

Section 16. That for the work and improvements herein provided for the City Engineer
shall make and file with the City Clerk on or before the 22nd day of April, 1958, complete
plans and specifications for the curbing, guttering, paving and grading with excavation
necessary therefore, of the streets described in Sections 1 to 15, of this ordinance, with
the following type of improvements;
Concrete combined curb and gutter on each side thereof
30 inches wide from back of curb to paving line, curb
12 inches deep at back, gutter 6 inches deep, and the
necessary grading of each to the established paving
grade between the curb and gutter lines on each side
thereof and within the limits of said street, as herein
before described; and the necessary grading of each to
the established paving grade, and the paving thereof,
with two-inch hot mixed asphalt concrete over a six
inch crushed rock stabalized base, and the paving
thereof with 6 inch reinforced concrete, providing
that in the event of the non-availability of reinforced
material that then said pavement shall be constructed with
concrete to a depth of 7 inches between the curb and
gutter line on each side thereof and within the limits
of said streets hereinbefore described. The streets
between the guttering lines and within the limits hereinbefore defined
shall be graded to the established paving grades and paved with
reinforced concrete six (6) inches deep, provided that in the
event of the non-availability of reinforced material that then
said pavement shall be constructed with concrete to a depth of
7 inches.

and said Engineer shall on or before the same date, submit to the Board of Commissioners
under oath, detailed estimates of the cost of such work and improvements.
Section 17. That after such plans and specifications have been made and prepared by
the City Engineer and filed with the City Clerk as aforesaid, the Board of Commissioners
may advertise by advertisement published in the official city paper of the City of Salina,
Kansas for three consecutive days for the receipt of sealed proposals for the improving
of said streets with the kind of material named and specified in the preceing section hereof,
and for the excavation and grading necessary for the completion of such work and after the
receipt of such proposals, the said Board of Commissioners may and are hereby authorized
and directed to let dontracts for the improving of said streets with the materials selected
by them to the lowest responsible bidder or bidders therefdr, as determined by the Board
of Commissioners, and for such excavation and grading, said Board reserves the right to
reject any and all bids.
Section 18. That for the improving of the above mentioned streets, such assessments
shall be made for the full cost thereof according to law, on all lots and pieces of land to
the center of the block on either side of the street to be improved according to the
appraisers valuation thereof, without regard to the buildings or improvements thereon for
the distance to be improved.
Section 19. That after the passage and publication of this ordinance, the Board of
Commissioners shall appoint three disinterested appraisers, householders, who after having
taken an oath to make a true and impartial a
p ppraisement of all lots and pieces of land
liable to assessment and taxation as aforesaid, as may be designated by the Board of
Commissioners of said City, without regard to the buildings or improvements thereof and
after making such agpraisement shall return to the Board of Commissioners of the City of
Salina, and said Board of Commissioners shall designate a time and place for the hearing
of any complaints that may be made as to the value of any lots and pieces of land appraised

as aforesaid, of which due notice shall be given in the official city paper, at which
hearing the Board of Commissioners may alter any valuation of any lot or piece of land, if,
in their opinion the same has been appraised too high or too low.
Section 20. That for the purpose of paying the cost of the work and improvements in

this ordinance provided for, the Board of Commissioners are hereby authorized and directed
to issue internal Improvement Bonds of the City of Salina in an amount not to exceed the
contract price or cost of such improvements and to run for a period of ten years and be
payable in ten equal installments, together with interest not to exceed five per cent (5%)
per annum, which bonds shall be made payable at the Fiscal .Agency of the State of Kansas
and for the purpose of paying the principal and interest on said bonds as they severally
become due and payable, the Board of Commissioners shall apportion and assess against the
lots and pieces of land within the taxing district of such improvements special assessments
covering the cost of such improvements and the apportionment herein contained shall hold good

for all of the installments that are to be collected from the specific property chargeable
with said improvements, such assessments and apportionment ordinance shall contain the total
amounts of tax apportioned to each tract, piece or parcel of land within the taxing district
and shall state the number of annual installments in which such tax is to be collected; and
thereafter the City Clerk shall annually at the same time other taxes are certified, certify
to the County Clerk of Saline County, Kansas, a full 31it of all property liable for such
work and improvements, together with the respective amounts due on each of said tracts,
pieces or parcels of land, which amounts shall include the annual installments and interest
on all unpaid balances for one year at the rate of not to exceed five per cent per annum
on such amounts so certified which shall be collected as other taxes are collected, PROVIDED
that for the purpose of defraying the cost of improving the intersections and areas formed
by the crossing of streets and alleys, and for the grading of said streets where the same
is provided for in this ordinance as well as where the improvement is through or adjacent
to property of the City for which the City is liable, the assessment will be made against
all taxable property of the City and paid by the City at large.
Section 21. This ordinance shall take effect and be in force from and after its
publication once in the official city paper.
