6195 Issue Bonds S-177CONSOLIDATED-,SALCNA ORDINANCE NUMBER 619 (Published in The Salina JournalNU 4� il e r' � , 1957) AN ORDINANCE providing for and authorizing the issuance of Improvement Bonds of the City of Salina, Kansas, in the sum of $148,792.25, to pay the cost of constructing main sanitary sewers and certain lateral sanitary sewers and storm sewers, and pumping station in the City of Salina, Kansas, which bonds shall be designated as Series 5-177. WHEREAS, pursuant to proceedings duly had according to law, certain main and certain lateral sanitary sewers and storm sewers, and pumping station have been constructed in the City of Salina, Kansas, in main sewer districts and certain lateral sanitary sewer districts, as follows: Lateral Sanitary Sewer District Number 347 as provided for and authorized by Ordinance Number 6060. i Lateral Sanitary Sewer District Number 351 as provided for and authorized by Ordinance Number 6100 Lateral Sanitary Sewer District Number 352 as provided for and authorized by Ordinance Number 6099• Lateral Sanitary Sewer District Number 353 as provided for and authorized by Ordinance Number 6102. Pumping station for pumping sewage of Lateral Sanitary Sewer Number 353 and i extensions as provided for and authorized by Ordinance Number 6103. Main Sanitary Sewer District Number "AD" as provided for and authorized by Ordinance Number 6115. Lateral Sanitary Sewer District Number 354 as provided for and authorized by Ordinance Number 6115. Lateral Sanitary Sewer District Number 355 as provided for and authorized by Ordinance Number 6115. i Lateral Sanitary Sewer District Number 356 as provided for and authorized by Ordinance Number 6115. Gebhart Manor Storm Seger as provided for and authorized by Ordinance Number 6122. Ingermanson Storm Sewer as provided for and authorized by Ordinance Number 6112. WHEREAS, the total cost of said sewers constructed in and as the sewer districts above mentioned amounted to a total of $151,956.06. WHEREAS, it is hereby found and determined that the sum of $23,848.31 is against property belonging to said city and is to be paid by general taxes to be levied upon all taxable j C property within said city, and the sum of $40,533.64 is to be paid by special assessments levied upon lots and pieces of ground liable for the payment of said sewers in the sewer districts mentioned, which amount as been heretofore duly assessed and apportioned to the f several lots and pieces of ground liable therefor according to law and as provided for in the Ordinances of the City of Salina relating thereto, of which amount the sum of $3,163.81 has been paid by the owners of the property liable therefor, leaving a balance of $37,369.83 for which bonds are to be issued; and WHEREAS, the total cost of the said Storm Sewers has been ascertained in the amount of $87,574.11 to be paid by general taxes to be levied upon all taxable property within said city; and for which bonds are to be issued; and WHEREAS, bonds in the aggregate sum of $148,792.25 are to be issued to pay the actual not cost thereof; SO, NOW THEREFORE BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas; Section 1. That the foregoing preambles are being hereby adopted and made a part of this i ordinance and that for the purpose of providing funds to pay the cost of the improvements, hereinbefore described, there shall be issued and there hereby are issued, Internal Improvement i i r CONSOLIDATED -5 kLINA 1 1 Bonds of the City of Salina, Kansas, in the total principal sum of $148,792014Jwhich issue shall consist of 148 bonds numbered 1 to 148 inclusive, all dated November 1 1957, which shall bear interest at the rate of i`— --,.t,��� e_ -A �Z � �3),; .C��. -y2t � ,� L: - per cent per annum, payable May 1 and November 1, _each year to be evidenced by interest coupons as herein provided for, and said bonds shall become due serially in denomination as follows: Bonds Numbered 1 to 8 for $1,000.00 each except Number 1 is for $1,792.25 due May 1, 1959• Section 2. Said bonds shall be signed by the Mayor and shall be attested by the signature of the City Clerk and the corporate seal of the City shall be affixed thereto, and shall have attached thereto interest coupons representing the interest thereon, which coupons shall be in the form provided by law and shall bear the printed or lithographed facsimile signatures of the Mayor and the City Clerk of said City and4bonds and interest coupons shall be registered in the offices of the City Clerk and the State Auditor as required by law. Section 3. Said bonds shall be designated as Series 5-177, and shall be in the form and shall contain recitals substantially as follows, to -wit: Bonds Numbered 9 to 15 for $1,000.00 each -due on November 1, 1959• Bonds Numbered 16 to 23 for $1,000.00 each due on May 1, 1960. Bonds Numbered 24 to 30 for $1,000.00 each due on November 1, 1960 Bonds Numbered 31 to 38 for $1,000.00 each due on May 11 1961. Bonds Numbered 39 to 45 for $1,000.00 each due on November 1, 1961. Bonds Numbered 46 to 53 for $1,000.00 each due on May 1, 1962. Bonds Numbered 54 to 60 for $1,000.00 each due on November 1, 1962. Bonds Numbered 61 to 68 for $1,000.00 each due on May 1, 1963. Said bonds shall be designated as Series 5-177, and shall be in the form and shall contain recitals substantially as follows, to -wit: CONSOLIDATED-SA,LINA �J 1 No. UNITED STATES OF AMERICA STATE OF KANSAS COUNTY OF SALINE CITY OF SALINA INTERNAL IMPROVEMENT BOND Series 5-177 $ KNOW ALL MEN BY THESE PRESENTS, that the City of Salina, in the County of Saline, State of Kansas, acknowledges itself to be indebted and for value received hereby promises to pay the bearer the sum of DOLLARS in lawful money of the United States of America, on the first day of , 19 with interest thereon from the date hereof at the rate of per cent per annum, payable semiannually on the first days of May and November in each year,,- on ear,on presentation and surrender of the interest coupons hereto affixed as said coupons severally become due, both principal and interest of this bond being payable at the office of the State'. This bond is one of a series of 148 bonds of like date and tenor, excepting denomination)'and maturity, aggregating the principal sum of $148,792.25, issued by the City of Salina, Kansas, for the purpose of paying the cost of constructing main sanitary sewers, and certain lateral sanitary sewers, and storm sewers, and pumping station, in said city by the authority of arid -An full compliance with the provisions, restrictions and limitations of the constitution and law6 of the State of Kansas, including Sections 10-101 to 10-127, Sections 12-617 to 12-620, Sections 12-626 to 12-629, and Sections 13-1013 to 13-1018, all in the General Statutes of Kansas, 1949, and amendments thereto, and all other provisions of the laws of said state applicable thereto and this bond and all other bonds of this series, and all interest thereon; are to be paid by the City of Salina, Kansas. And it is hereby declared and certified that all acts, conditions and things required to be done and to exist precedent to and in the issuance of this bond have been properly done and performed and do exist in due and regular form and manner as required by the constitution and laws of the State of Kansas, and that the total indebtedness of said city, including thisi series of bonds does not exceed any constitutional or statutory limitations. Section 5. The full faith, credit and resources of the City of Salina, Kansas, shall be and the same are hereby irrevocable pledged for the proppt payment of said bonds and all interest thereon. The Board of Commissioners of the City of Salina, Kansas, shall annually make provisions for the payment of the principal and interest on said bonds, the same become due by levying taxes and assessments upon the property liable therefore as provided by law.
