AN ORDINANCE AMENDING AN ORDINANCE creating and defining certain Intercepting Sever District
in the City of Salina, Kansas, designated as Intercepting Sewer Country Club District,
providing for the construction and maintaining pumping stations and intercepting sewers to
serve said district; and providing for the levying of special assessments against property
in said district for the cost of construction and maintaining pumping stations and sewers
including the cost of acquiring, by condemnation or purchase, land or any easement or right
therein, and for the issuing of negotiable bonds therefor.
WHEREAS, the governing body of the City of Salina, Kansas, has heretofore enacted Ordinance
Number 6138, passed on April 30, 1957, creating Intercepting Sewer Country Club District
which includes Blocks 1, 2, 31 4, 5, and 6 in Country Club Heights Addition and Blocks 1, 21
3, and 4 in Country Club Heights Addition Number Two in the City of Salina, Kansas, and
has constructed an intercepting sewer therein, together with all necessary connections,
manholes, pumping station and other appurtenances in accordance with the provisions of said
ordinance, and
WHEREAS, it appears that the improvements so constructed also provide for the disposition
of sewage from Country Club Heights Addition Number Three and that the property in said
Country Club Heights Addition Number Three is benefited by said improvements and the owners
of all the property in said addition have consented in writing to be included in the
benefit district created by said ordinance, and SO, NOW THEREFORE
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
Section 1. That Country Club Heights Addition Number Three is benefited by the
improvemdnts constructed in Intercepting Sewer Country Club District; and that said Country
Club Heights Addition Number Three should be included in said District and that Section 1 of
Ordinance Number 6138, passed on April 30, 1957, should be amended so that said district
will include said addition and that Section 1 of said Ordinance be and it is hereby amended
to read as follows:
The North one-half (ND of the Northwest Quarter (NW4), Section
Seventeen (17), Township Fourteen (14) South, Range Two (2)
West of the Sixth Principal Meridian, Saline County, Kansas, which
included Blocks 1, 2, 3, 4, 5, and 6 in Country Club Heights Addition
and Blocks 1, 2, 3, and 4 in Country Club Heights Addition Number Two,
City of Salina, Saline County, Kansas.
Blocks 1, 2, 31 4, 5, 6, 7, 0, and 9 in Country Club Heights Addition
Number Three, City of Salina, Saline County, Kansas.
Section 2. This ordinance shall take effect and be in force from and after its
publication in the official city paper.
