AN ORDINANCE relating to and apportioning and levying special assessments on certain lots andl
pieces of ground in the City of Salina, Kansas, to pay the cost of construction of Main
Sanitary Sewer District "AE" and Lateral Sanitary Sewer Districts Numbered 357, 358, 359,
and 360, and relating to and providing for the collection and payment of such assessments.

BE IT ORDADED by the Board of Commissioners of the City of Salina, Kansas:
Section 1. That for the purpose of paying for the cost of building and constructing
Main Sanitary Sewer District "AE" and Lateral Sanitary Sewer Districts Numbered 357, 358,
359, and 360 and as authorized by the provisions of Ordinance Number 6134, the cost of which
has been duly ascertained as shown by the City Engineer's final estimate of cost, which has
been duly approved by the Board of Commissioners, there are hereby levied and assessed on

the property liable therefor, being all the lots and pieces of ground lying in the sewer

district mentioned above as created by Ordinance Number 6134, according to the appraised
I
i
value of such lots and pieces of ground without regard to the buildings or improvements
I
thereon, special assessments covering the cost of such improvements constructed in said
I '
sewer district, said special assessments being based on the special valuation and appraisement
jmade by three disinterested appraisers appointed by the Board of Commissioners of the City of!
Salina, Kansas, which said appraisement is hereby referred to and made a part of this ordinance
I
and the several amounts levied, and apportioned against the cost of improvements constructed
in such district being hereby found and determined to be as set forth in the following
sections of this ordinance.
Section 2. That for the purpose of the payment of the cost of construction of Main
Sanitary Sewer "AEI`, a ten inch clay pipe sewer beginning at an existing manhole at the

intersection of Wayne Avenue and Highland ghland Avenue; thence west along the center line of
easement at the south line of Lot 17, Block 1, Gebhart Manor Addition and continuing west
across Broadway Boulevard 457.0 feet where a manhole will be constructed; thence north along
a line 5 feet east of the west right-of-way line of said Broadway Boulevard 1020.0 feet where
a manhole will be built; thence north 70.0 feet with a 6 inch cast iron pressure line where a
pump station will be installed; thence continuing north 5 feet east of west line of Broadway

Boulevard with a ten inch clay pipe sewer 1500.0 feet to a point 12.0 feet east of the west
line of Hageman Avenue where a manhole will be built; thence south along a line 12 feet south
of the north line of Garden Avenue where a manhole will be built which will be terminus of
Main Sewer "AE", the amount levied, apportioned, and assessed against the lots and pieces of
ground in said district are found and determined to be as follows;

Section 7. Said amounts levied, apportioned and assessed as aforesaid shall be due and
collectible in ten equal inttallments, the first becoming due with the taxes levied for 195$,'
and one of said installments falling due each and every year thereafter until all are paid,
all to be collected with interest as in this ordinance provided for, however, that the owner
of any piece or parcel of property liable for any such assessment may redeem his property
from any such assessment liability by paying into the City Treasury the entire amount
chargeable against the same as in this ordinance designated at any time within thirty days
from the publication of this ordinance, and before the issuance of bonds of said City, in
payment of the cost of said improvements, and his property so paid shall not thereafter be
liable for any further assessment for the cost of said improvements nor for any part of said
bonds.

Section 8. There is hereby levied and assessed further against such lots and pieces
of ground as described in this ordinance, interest at such rate per annum as shall be borne
by the bonds hereafter to be issued for the payment of the remaining unpaid cost of such
improvements, such rate to be hereafter determined and fixed by ordinances when such bonds
are issued, on all of said installments mentioned and provided for in this ordinance, from
the date of the bonds which may be issued at the end of thirty days, as specified in the
preceding section hereof as by law provided, to the time of collection of the last installment
as provided by law, which said interest shall be collected annually at the same time and in
the same manner as said installments are collected, and after the taking effect of this

ordinance and the fixing of the interest rate when such bonds are authorized and issued, it
ji
shall be the duty of the City Clerk of said City to annually at the same time other taxes
i
are certified, to certify to the County Clerk of Saline County, Kansas, a full list of all
property liable to assessment and taxation for such work and improvements, except such
property on which the special assessments have been paid in full as hereinbefore provided,
together with the respective amounts due on each of such lots and pieces of ground, which amouInts
� shall include the annual installments of such special assessments together with the interest
at one year at the rate to be fixed and provided for in this ordinance, being the rate borne
by the bonds to be issued on all unpaid balances of such assessments and such amounts so
certified as herein provided shall be placed upon the tax roll by the County Clerk of Saline
County, Kansas, and collected as all other taxes are collected.
Section 9. That this ordinance shall be in effect and force from and after its
publication once in the official city paper.
