AN ORDINANCE defining, classifying and regulating wa4s and fences, requiring a permit from
the building inspector and providing penalties for the violation of its provisions. Amending
Chapter 6 of Revised Ordinances of the City of Salina, Kansas, 1948.

BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas;
Section 1. Article 9.
6-901. DEFINiTion
No person shall erect or maintain any fence, hedge or structure for the definite

purpose of annoying any other person, or for the purpose of injuring another by obstructing
the view, shutting out the sunshine, hindering ventilation or causing inconvenience in any
other manner. No electrically charged fence shall be erected or maintained.
Any fence, hedge or structure erected or maintained in violation of the provisions of

j this section is hereby declared to be a nuisance and shall be removed by the owner thereof
within five days after receipt of notice from the building y P g ins pector to remove same. No
j
privately owned fence, hedge or structures shall be erected or maintained on any public property.
j 6-902. TYPES OF FENCES AND LOCATION

(A) CLASSIFICATION OF FENCES:
(1) Masonry Walls
2) Ornamental Iron
j 3) Woven Wire
4) Wood Picket (more than fifty per cent open)
5 Solid fences (wood or metal less than fifty per cent open)
(6) Hedges
(B) In any location, fences enclosing plots used for dwelling purposes shall

conform to the following requirements:

6-903. Front yard fences erected in front of the front building line (see Zoning Ordinance)
shall be of any class, and shall not exceed a height of four feet excepting Classes 1 and 5

which shaU bet exceed a height of three feet. Fences on corner lots in which the rear yard
abuts the front yard of the adjoining lot shall conform to the requirements for front yard
i
fences for such part of the fence as abuts the adjoining front yard.
6-904. Side yard fences erected back of the front building line and within the required,
side yard of the plot (see Zoning Ordinance) may be of any class not over four feet in height
to the rear of the neighboring dwelling, or to the rear of the dwelling located on the same

site as the fence, whichever is the greater distance from the front property line. Back of
I ,
the point such side yard fences may be built to a height of six feet.
6-905• Rear yard fences erected along the rear property line may be of any class and
height without permit, except as provided by front yard Section 6-903.
6-906. No barbed wire or other sharp pointed fence and no electrically charged fence,'

shall be erected or maintained, unless specifically permitted by other ordinances.
6-907. In case of a fence erected on top of a retaining wall, the height shall be
measured fron the grade of the low side; provided that in any case a fence of Class 2, 3, 4,

or 6 may be erected on top of a retaining wall to a height not to exceed four feet above the

grade of the high side.
6-908. Retaining walls shall be adequately designed and drained so as to resist all
lateral pressure to which they may be subject. Retainiagg walls shall not be erected in
j any front yard when, in the opinion of the building inspector such retaining wall would be
unsightly or detrimental to adjoining property. Nor shall such walls be built higher than
the grade of the ground on the high side of the wall when such would exceed the Aight allowed
for a Class 1 fence, which height is measured from the low side of the wall.

6-9o9. When in the
judgment of the Building Inspector the public health, safety and
welfare will be substantially served and the neighboring property will not be materially
damaged, or in case of an agreement between neighboring property owners, a certified copy

of which shall be filed with the building inspector, he may, at his discretion vary the
requirements herein.
6-910. Commercial or industrial fences may be of any class and the height thereof shall!
not exceed ten feet; provided, that when such fences are built in required building setback spaces
(see Zoning Ordinance) they shall be governed by the requirements as set forth in the Section'
for fences enclosing residential plots. Barbed wire or similar materials may be used at a

height of not less than seven feet above grade, unless specifically permitted by other
ordinances. Fences shall be kept in repair, and any dilapidated, dangerous or unsightly fence
shall be removed or repaired when so ordered by the Building Inspector.
6-911. No person shall install any fence or wall without first having procured a written
permit therefor from the Building Inspector. The Building Inspector shall charge a fee of
One Dollar ($1.00) for the issuance of such permit.
Section 2. Any person who shall violate any of the provisions of this ordinance shall be'
guilty of a misdemeanor and shall be fined in an amount not to exceed Fifty Dollard ($50.00)
or be
imprisoned for a period not to exceed ten (10) days, or be both so fined and imprisoned,
Section 3. In the event that any part or parts of this ordinance be determined
unconstitutional or invalid, such determination shall not effect any other portion of this
ordinance.
Section 4. This ordinance shall be in force and take effect upon its adoption and
publication in the official city paper.
