6312 Utility ImprovementsCaNSOLIDATED-SAUNA ORDINANCE NUMBER 6312 (Published in The Salina Journal 1959) I AN ORDINANCE providing for the construction of certain storm severs and drainage in the City' of Salina, Kansas, to be designated as Worsley Addition Storm Sever and Euclid Avenue Storm Sewer, and providing for the letting of contract for such sonstruetion and for the payment of the cost thereof. WHUMAS, at all times heretofore, the entire City of Salina, Kansas, has constituted a storm sever and drainage district and bonds issued to pay the cost thereof and payable by a general tax as provided by law; and i BE IT OFMINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That the preamble of this ordinance is hereby incorporated herein. That i I the entire City of Salina is hereby determined to be the benefit district for the purpose of the installation of a system of storm sewers and drainage in the said City. That the entire limits of said City has always constituted one district for said purpose. Section 2. That it is necessary and it is hereby ordered that a storm sever, which is hereby designated as Worsley Addition Storm Sever, together with all necessary inlets, inlet connections, manholes, connecting lines, sluice gates and other appurtenances, be constructed in the City of Salina, along the following course, to -wit: Beginning at an existing storm sever manhole at the intersection of Talley Drive and Haskett Avenue, thence north with a 36 inch storm sewer to a point 10 feet south of the center line of Garden Avenue where a manhole will be built, thence east with a 36 inch storm sewer on a line 10 feet south of the center line of Garden Avenue to a point 10 feet east of the center line of Hageman Avenue where a manhole will be built, thence north with a 30 inch storm sewer on a line 10 feet east of the center line of Hageman Avenue to a point 10 feet east of the center line of Hageman Avenue and in the center of Willis Avenue, where a manhole will be builtr# Thence beginning at the manhole in the intersection of Garden Avenue and Hageman Avenue, thence south with a 21 inch j storm sewer on a line 10 feet east of the center line of Hageman to a point 10 feet south of the center line of Purdue Avenue, thence continue south with an 18 inch storm sever to apoint 10 feet south of the center line of Yale Avenue where a manhole will be built, thence east with a 15 inch storm sewer on a line 10 feet south of the center line of Yale Avenue to a point 10 feet west of the center line of Tulane Avenue where a manhole will be built. Beginning at a manhole in the intersection of Garden Avenue and Hageman Avenue thence east with an 18 inch storm sewer along a line 10 feet south of the center line of Garden Avenue to a point 10 feet west of the center line of Maple Avenue where a.man3aele will be built, thence south with an 18 inch storm sewer along a line 10 feet west of the center line of Maple Avenue 335 feet where a manhole will be built. Beginning at a manhole at the intersection of Hageman Avenue and Tulane Avenue, thence east with an 18 inch storm sever along a line 10 feet south of the center line of Tulane Avenue 386 feet where A manhole will be built. Beginning at a manhole at the intersection of Hageman Ave&0!2 Purdue Avenue, thence east with an 18 inch strom sever alline 10 feet south of the center line of Purdue 270 feetnhwill be built which will be the terminus of the Worsley A Storm Sever. Section 3. That it is necessary and it is hereby ordered that a storm sewer, which is hereby designated as Euclid Avenue Storm Sewer, together with all necessary inl6ts, inlet connections, manholes, connecting lines, sluice gates and other appurtenances be constructed in the City of Salina along the following course, to -wit: CON SOLID:' TED-SALINA 1 U 1 _. A 36 inch pipe sewer beginning at an existing manhole in the intersection of Ninth Street and ImAd Avenue; thence west along a line 20 feet from the north line of said Avenue 840 feet more or less to the bank of Dry Creek where an outlet structure will be constructed which will be the terminus of Euclid Avenue Storm Sewer. Section 4. That on or before the day of ', 1959, the City Engineer shall prepare and file in the office of the City Clerk, detailed plans and specifications for the construction of the storm sewers provided for in Section 2 and Section 3 of this ordinance with vitrified and/or corrugated metal pipe, bituminous coated, and/or concrete sewer pipe or any combination of such types of sewer pipe and on or before the same date shall prepare and file in hhe office of the City Clerk, under oath, a detailed estimate of the cost thereof. After such plans and specifications and estimate of cost shall have been filed, the City Clerk shall advertise by advertisements published in the official city paper for at least three consecutive days for sealed proposals for the building and construction of such storm sewer and at the time and place mentioned, the Board of Commissioners may let a contract with the lowest and best responsible bidder for the building and construction of such storm and drainage sewers, but the right to reject any and all bids shall be and it is hereby reserved, and provided forther that if no responsible J*rson shall propose to enter a contract at a price not exceeding the estimated cost, then the Board of Commissioners may proceed to construct said improvements within the estimated cost thereof and shall purchase the necessary tools, apparatus, and materials and employ the necessary labor for the purpose of constructing the sewer. Section 5. That for the payment of the cost of said work, the Board of Commissioners shall issue General Obligation and Improvement Bonds of the City of Salina, Kansas, in an amount not to exceed the total cost of such work and improvements, to be payable in ten approximately equal annual installments and to bear interest at not to exceed five per cent per annum and from the date of such bonds, and for the purpose of paying such bonds and interest as they severally become due, the Board of Commissioners shall annually levy a tax upon all real and personal property in the City of Salina in an amount sufficient to pay the annual installments of such principal and interest, and that pending the issuance of such bonds, temporary notes shall be issued according to law, to pay the cost of such work. Section 6. This ordinance shall take effect and be in full force from and after its adoption and publication once in the official city paper.
