AN ORDINANCE ratifying and confirming a contract with 0. D. Wilmoth doing business as
Wilmoth Construction Company for the construction of Lateral Sanitary Sewers and Intercepting
Sewer in the City of Salina, Kansas heretofore designated as Lateral Sanitary Sewers 374,
375, 376, 3771 378, and 379, and Intercepting Sewer "AG", and providing for the issuance
of Temporary Notes to pay the cost thereof, pending the issuance and sale of bonds.
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:

j Section 1. That the acceptance of the City of Salina, Kansas, of the proposal of the

Wilmoth Construction Company, hereinafter referred to as the "Contractor" as submitted to
the Board of Commissioners on November 4, 1958, which is hereby found to be the lowest and
best bid for such work, and the contract awarded by the Board of Commissioners of said City
to said contractor and signed on behalf of the City by its Mayor on NoVember 10, 1958, for

the eonstrubtion of certain public improvements in the City of Salina, Kansas, to -wit:
An 8 inch clay pipe sewer beginning at an existing 10 inch
main sewer in the intersection of Quincy Street and Wayne
Avenue; thence south in Quincy Street to the intersection of
Kensington Road; thence easterly in Kensington Road 190.0 feet
where a manhole will be built which will be terminus of Latemal
Sewer 374,
An 8 inch clay pipe sewer beginning at an existing 10 inch
sewer in the intersection of Wayne Avenue and Wesley Street;
thence south in Wesley Street to the south line of Lot 27,
Block 2, Belmont Addition where a manhole will be built which
will be terminus of Lateral 375,
A 10 inch clay pipe sewer beginning at the existing manhole
in Wayne Avenue in the right-of-way extended between Wesley
and Norton Streets; thence south to a point 10 feet north of
the south line of Wayne Avenue; thence east to the intersection
of 100ton Street and Wayne Avenue; thence south with an 8 inch
clay pipe sewer 4150 feet where a manhole will be built which
will be the terminus of Lateral 376.
A 10 inch clay pipe sewer beginning at the manhole in Lateral
376 in the intersection of Norton Street and Wayne Avenue,
thence east to the intersection of Edward Street and Wayne
Avenue, thence south in Edward Street with an 8 inch clay pipe
1112 feet to a manhole 10 feet north of the south property
line of Belmont Boulevard hatch till be terminus of Lateral 377,
A 10 inch clay pipe sewer beginning at the manhole in Lateral
377 in the intersection of Edward Street and Wayne Avenue; thence east to
the intersection of Roach Street and Wayne Avenue; thence south with
an 8 inch clay pipe sewer to a manhole 10 feet north of the south
Of Belmont Boulevard which will be terminus of Lateral 378.
An 8 inch clay pipe sewer beginning at an existing manhole
which is 10 feet east of the center line of Fourth Street
and 10 feet north of the center line of Wayne AryWe, thence
north in Fourth Street, and parallel to the center line of
Fourth Street to a point 20 feet north of the south line
of Lot 1, Block 5, Gebhart Manor Addition to the City of
Salina, Kansas,3? q
A 10 inch clay pipe sewer beginning at an existing manhole
at the intersection of Norton and Cloud Streets, thence east
in Cloud Street to the intersection of Cloud and Ohio Streets;
thence north in Ohio Street to an existing manhole east of
center line of utility easement in Block 2, Wymore Addition,
which manhole connection will be terminus of Intercepting Sewer "AG",

at and for the unitrice for said work contained fined in said proposal, which proposal and
contract are hereby referred to and made a part of this ordinance, be and the same is
hereby ratified and confirmed, said proposal being within the estimated cost of said
improvements as shown by the sworn estimates of the City Engineer on file in the office of
the City Clerk which estimate is hereby referred to and made a part of this ordinance.
Section 2. Said improvements shall be built and constructed in accordance with the
plans and specifications therefore prepared by the City Engineer on file in the office of
the City Clerk and in accordance with the proposals of said contractor and under the terms
j of said contract, all of which are hereby referred to and made a part of this ordinance.
Section 3. That temporary notes signed by the Mayor and attest by the City Clerk be
issued from time to time as the work progresses in the manner and form as required dry Lw,
the total amount thereof not to exceed the amount of $43,878.55 for such work, such notes
to bear interest at not to exceed 5 per cent per annum and to mature not later than December
1, 1959, and to be issued in such amounts and at such times as may the money for the
payment of the cost of such work be required, such notes to be issued to said contractor and
to be redeemed and cancelled at the time that Internal Improvement Bonds are issued in lieu
thereof.
Section 4. That this ordinance shall take effect and be in full force from and after
its publication once in the official city paper.
