AN 0BDIRAUCE creating and defining a certain lateral sanitary sewer district in the City of
Salina, Kansas, designated. as Lateral Sanitary Sewer District Number 379, and providing for
the construction of a lateral sanitary sever in said Lateral Sanitary Sever District Number
379, so created and providing for the payment of the cost thereof and for the levying of
special assessments against the property in said district for the payment of the cost of
such construction and for tie issuing of bonds to pay the cost thereof.
BR IT OFWAIM by the Board of Commissioners of the City of Salina, Kansas:
Section 1. Lateral Sanitary Sewer District lurber 379• That there be and there is
iefeby created Lateral sanitary sewer district in the City of Salina, Kansas, which shall be
and it is hereby designated as Lateral Sanitary Sever District Number 379 and Which district
shall include all the following described property in the City of Salina, Kansas, to -wit:

Lots 1 and 2j, 5, Qebhart Manor Addition,
Lots 1p 2, 3, 4, 5, 6, 7, 8, 9, 10, u, 22, 13, 14, Block 6
Qebhart Manor Addition. lee east 352.5 feet of Block 4, Mbhart
Manor Addition to the City of Salina, Kansas.
Section 2. Th is necessary and it is hereby ordered that an eight inch V, C P,
Lateral Sanitary Rover with all necessary connections, manholes, flushing tanks and other
appurtenances be constructed and built in and to serve said Iateral Sanitary Sever District
Nwnber 379 as ersatsd by Section 1 of this ordinance along the following course, to -wit:
An 8" clay pipe sewer beginning at an existing manhole
which is lA feet east of the center line of Fourth Street
and 10 feet north of the center line of Wyne Avmue, thence
north in Fourth Street, and parallel to tie center line of
Fourth Street to a point 20 feet north of the south line
of Lot 1, Block 5, Gobhart Manor Addition to the City of
Salina, Kansas.
Section 3. faat the City Engineer shall on or before the 7th day of October , 195$,
prepare and file in the office of the City Clark, plans and specifications for the soustruction
of the Lateral Sanitary Sever provided for in the preceding sections of this ordinance which
sha3.1 be of the proper character to serve the property lying within the district for which
such sever is to be censtrreted and shall on or before the same date prepare and submit to
the Board of Cosisissioners a detailed estimate under oath of the cost thereof. %at thereafter
the City Clerk shall advertise for three consecutive days in the official city paper for
seabed j&Wosais for the building and construction of such a sewn according to such plans
and specifications, which proposals shallbe filed with the City Clerk an or before the
time fixed in such notice, at vhcih time the Board of Cd:missioners may let a contract for
the building and construction of such sewer to the lowest and beat responsible bidder or
bidders therefore, if, there be any whose bids do not exceed the estimated cost thereof, but
said Board shall reserve the right to reject any or all such proposals, and if no bids shall
be received within such estimate, the Board of Cond.asioners shall hm the pwier to do
such work and make such improvements within the estimated cost thereof as provided by law.

Section 4. That for the cost of building and constructing such sever, special
assessments shall be made for the full cost thereof on all lots and pieces of ]rand within
6M for Which such sewer sball be built, according to the appraised value thereof, without
regard to the buildings or improvements thereon.
Section 5. After the passage and publication of this ordinance, the Board of
Commissioners shall appoint three disinterested appraisers, who after having taken oath to
make a true and impartial appraisement of all lots and pieces of land liable to taxation for
the cost of such improvements shall within five days after having been notified of their
appointment proceed to appraise all of the lots and pieces of land within the district
liable to assessment and taxation as aforesaid, without regard to the buildings or
improvements thereon, and after making such appraisement shall weturn to the Board of
Commissioners of said City and said Board shall designate a time for a special retiag of
said Board for the purpose of hearing any complaints that may be made as to the value of any
let or piece et land appraised as aforesaid, of which spaadal session due notice shall be
given in On official city paper, at which special session said Board may alter any
valuation of any lot or piece of land, if, in their opinion, the same has been appraised
too high or too low.
Section 6. The Special Assessments herein provided for nay be paid by the person
liable therefore in ten approximately equal installments but the owner of any property
liable to such assessment may within thirty days from the date of determining the amount
assessed against the property, pay the same in full and his property so paid on shall not
be liable for any assessments for the cost of such improvements, and bonds as herein after
provided for shall be issued in an amount of the cost of such improvements remaining unpaid
at the end of thirty days from the time such as maWnt is fixed.
Section 7. For the purpone of paying for the work and improvements in this ordinance
provided for, the Board of Commissioners may and are hereby authorized and directed to issue
improvement bonds of the City of Salina, Kansas, on an amount not to exceed the total cost
of such improvement, and to run for a period of ten years and be payable in ten apply
equal ainual installments, together with interest not to exceed five per cent per annum,
which bonds shall be hsoued and payable according to law; and for the purpose of paying the
principal and interest on said bonds as they severally become due and payable the Board of
Commissioners shall apportion and ""as against the lands and pieces of ].and within the
taxing district of such improvements, special assessments covering the cost of such
improvement and apportionment therein contained shall hold good for all of the installments
that are to be collected from the specific property chargeable therefore, vU ..such
improvements; such assessments and apportionment ordinance sball contain the total mount of
tax apportioned to such tract, piece or parcel of land within the taxing district and sball

state the number of annual installssznts in which such tax is to be collected; and thereafter
the City Clerk shall annually, at the same time that other taxes are certified, certify
to the County Clerk of Salina County, Kansas a full list of all property liable for such work
and improvement, together with the respective numbered amounts due on each of sail toads,
pieces or parcels of land, which amounts shall include the annual installmnts and interest
on all unpaid balances for one year at the rate of not to exceed fLme per cent per annum on
such amounts so certified, which amounts shall be collected as other taxes are collected.
Section 8. This ordinance shall take effect and be in force from and after its
publication once in the official city paper.
