6266 Utility ImprovementsC; O,C SOLIDATED- SAL II4A �I 1 i� ORDmwz NumR 6266 (Published in The Salina Journal,1958) AN ORDINANCE creating and defining certain lateral sanitary sewer districts in the City of Salina, Kansas, designatbd as Lateral Sanitary Seger Districts 374, 375, 376, 377, and 378, and providing for the construction of Lateral Sanitary Seger Districts Numbered 374, 375, 376, 377, and 378, so created, and providing for the payment of the cost thereof and for the levying of Special assessments against the property in said districts for the payment of the cost of such construction and for the issuing of bonds to pay the cost thereof. BE IT ORDAIM by the Board of Commissioners of the City of Salina, Kansas: Section 1. Lateral Sanitary Sewer District Number 374. That there be and there is hereby created Lateral Sanitary Sewer District in the City of Salina, Kansas, which shall be and it is hereby designated as Lateral Sanitary Sewer District 374 and which district shall include all the following described property in hhe City of Salina, Kansas, to -wit: Benefit District: Los 21, ,3, 24, 25, 26, 27, 28, and 29, Block 4, Belmont Addition. A tract of land beginning at a point 30 feet south of the center line of Wayne Avenue and 30 feet west of the center line of Quincy Street; thence south to the north line of Kensington Road extended west; thence west 100 feet; thence north to a point 30 feet south of the center line of Wayne Avenue; thence east 100 feet to the point of beginning. Section 2. It is necessary and it is hereby ordered that an eight inch clay pipe Lateral Sanitary Sewer with all necessary connections, manholes, flushing tanks and other appurtenances be constructed and built in and to serve said Lateral Sanitary Sewer District Number 374 as created by Section 1 of this ordinance along the following course, to frit: an 8 inch clay pipe sewer beginning at an existing 10 inch main sewer in the intersection of Quincy Street and Wayne Avenue; thence south in Quincy Street to the intersection of Kensington Road; thence easterly in Kensington Road 190.0 feet where a manhole will be built which will be terminus of Lateral Sewer 374. Section 3. Lateral Sanitary Sewer District Number 375. That there be and there is hereby created Lateral Sanitary Sewer District in the City of Salina, Kangas, which shall be and it is hereby designated as Lateral Sanitary Sewer District Number 375, and which district shall include all the following described property in the City of Salina, Kansas, to -wit: Benefit District: Lots 1 to 9, Z -the North 30 feet of bot 10, Block 4, Belmont Addition Lots 6 to 12, incl, in Block 3, Belmont Addition Lots 23, 24, 25, 26, and 27, in Block 2, Belmont Addition. Section 4. It is necessary and it is hereby ordered that an eight inch clay pipe Lateral Sanitary Sewer 9ith all necessary connections, manholes, flushing tanks and other appurtenances be constructed and build in and to serve said Lateral Sanitary Sewer District Number 375 as created by Section 3 of this ordinance along the following course, to -wit: An 8 inch clay pipe sewer beginning at an existing 10 inch sewer th the intersehtion of Wayne Avenue and Wesley Street; thence south in Wesley Street to the south line of Lot 27, Block 2, Belmont Addition where a manhole will be built which will be terminus of Lateral 375• C'')N5ULIIDA TED-SALIN A Section 5. Shat there be and there is hereby created Lateral Sanitary Sewer District in the City of Salina, Kansas, which shall be and it is hereby designated as Lateral Sanitary Sever District Number 376, and which district shall include all the following described property in the City of Salina, Kansas, to -wit: Benefit District: Lots 1, 2, 3, , and 5, Block 3, Belmont Addition Lots 16, 17, 18, 19, 20, 21, 22, Block 2, Belmont Addition Section 6. It is necessary and it is hereby ordered that a ten inch clay pipe Lateral I ftMtwy Sewer with all necessary connections, manholes, flushing tanks and other appurtenances be constructed and built in and to serve said Lateral Sanitary Sewer district Number 376 as created by Section 5 of this ordinance along the following course, to -wits i A 10 inch clay pipe sewer beginning at the existing manhole in Wayne Avenue in the right-of-way extended between Wesley And Norton Streets; thence south to a point 10 feet north of the south line of Wayne Avenue; thence east to the intersection of Norton Street and Wayne Avenue; thence south with an 8 inch clay pipe sewer 4150 feet where a manhole will be built which will be the terminus of Lateral 376. Section 7. Lateral Sanitary Sever District Number 377. That there be and there is hereby j created Lateral Sanitary Sever District in the City of Salina, Kansas, which shall be and it is hereby designated as Lateral Sanitary Sewer District Number 377, and which district shall i include all of the following described property in the City of Salina, Kansas, to -wit: Benefit District: Lots 1 to 15, ncl, Block 2, Belmont Addition Lots 13 to 26, incl, Block 1, Belmont Addition. Section 8. It is necessary and it is hereby ordered that a ten inch clay pipe Lateral Sanitary Sewer with all necessary connections, manholes, flushing tanks and other appurtenances i be constructed and built in and to serve said Lateral Sanitary Sewer District Number 377 as I created by Section 7, of this ordinance along the following course, to -wit: A 10 inch clay pipe sewer beginning at the manhole in Lateral 376 in the intersection of Norton Street and Wayne Avenue, thence east to the intersection of Edward Street and Wayne Avenue, thence south in Edward Street with an 8 inch clay pipe 1112 feet to a manhole 10 feet north of the south property line of Belmont Boulevard which will be terminus of Lateral 377• SectionLateral Sanitary Sewer District Number 378. That there be and there is hereby created Lateral Sanitary Sewer District in the City of Salina, Kansas, which shall be and it is hereby designated as Lateral Sanitary Sewer District Number 378, and which district shall include all the following described property in the City of Salina, Kansas, to -wit: Lots 1 to 12, incl, in Block 1, Belmont AdditLon. A tract of land 140 feet wide adjacent to and parallel to the east line of Roach platted as School Grounds in Belmont Addition. Section 10. It is necessary and it is hereby ordered that a ten inch clay pipe Lateral Sanitary Sever with all necessary connections, manholes, flushing tanks and other appurtenances be constructed and built in and to serve said Lateral Sanitary Sewer District Number 378 as created by Section 9 of this ordinance along the following course, to -wit: CON St:L3DAT .D-SALT_NA A 10 inch clay pipe sewer beginning at the manhole in Lateral 377 in the intersection of Edward Street and Wayne Avenue; thence east to the intersection of Roach Street and Wayne Avenue; thence souhh, with an 8 inch clay pipe sewer to a manhole 10 feet north of the south of Belmont Boulevard which will be terminus of Lateral 378. Section 11. That the City Engineer shall on or before L Ot prepare and III file in the office of the City Clerk, plans and specifications for the construction of the sanitary sewers provided for in the preceding sections of this ordinance which shall be of the proper character to serve the property lying within the district which such sewer is to be constructed and shall on or before the same date prepare and submit to the Board of I Commissioners a detailed estimate under oath of the Cost thereof. That thereafter the City Clerk shall advertise for three consecutive days in the official city paper for sealed proposals for the building and construction of such sewer according to such plans and specifications, which proposals shall be filed with the City Clerk on or before the time fixed in such notice, at which time the Board of Commissioners may let a contract for the building and construction of such sewers to the lowest and best responsible bidder or bidders therefore, if there be any whose bids do not exceed the estimated cost therefore, but said Board shall reserve the right to reject any or all such proposals, and if no bids shall be received within such estimate, the Board of Commissioners shall have the power to do such work and make such improvements within the estimated cost thereof as provided by law. j Section 12. That for the cost of building and constructing such sewers, special assessments shall be made for the full cost thereof on all lots and pieces of land within and for which such sewer shall be built, according to the appraised value thereof, without regard to the buildings or improvements thereof. Section 13. That after the passage and publication of this ordinance, the Board of Commissioners shall appoint three disinterested appraisers, who after having taken an oath to make a true and impartial appraisement of all lots and pieces of land liable to taxation for the cost of such improvements, shall within five days after having been notified of their appointments proceed to appraise all of the lots and pieces of land within the district liable to assessment and taxation as aforesaid, without regard to the buildings or improvements thereon; and after making such appraisements, shall return to the Hoard of Commissioners of said City and said Board shall designate a time for a special meeting of said Board for the purpose of hearing any complaints that may be made as to the value of any lot or piece of land appraised as aforesaid, of which special session due notice shall be given in the official city paper, at which special session said Board may alter any valuation of any lot or piece of land, if, in their opinion, the same has been appraised too high or too low. I Section 14. The special assessment herein provided for may be paid by the person liable therefore in ten approximately equal installments but the owner of any property liable to such assessment may within thirty days from the date of determining the amount assessed against the property, pay the same in full and his property shall not be liable for any Mayor (SM) Attest t City CTe=r Section 15. For the purpose of paying for the work and improvements in this ordinance provided for, the Board of Commissioners may and are hereby authorized and directed to issue improvement bonds of the City of Salina, Kansas, in an amount not to exceed the total cost i j of such improvement, and to run for a period of ten years and be dyable in ten approximately equal annual installments, together with interest not to exceed five per cent per annum, Which bonds shall be issued and payable according to law; and for the purpose of paying the principal and interest of said bonds as they severally become due and payable the Board. of Commissioners shall apportion and assess against the lots and pieces of land within the taxing district of such improvements, special assessments covering the cost of such improvement and apportionment therein contained shall hold good for all of the installments that are to be collected from i the specific property chargeable tierefere, and wdM such improvements; such assessment and apportionment ordi.ngoe shall contain the total amount of tax apportioned to each tract, piece or parcel of land within the taxing district and shall state the number of annual installments in which such tax is to be collected; and thereafter the City Clerk shall annually.,. at the same j time that other taxes are certified, certify to the County Clerk of Saline County, Kansas, a full list of all property liable for such work and improvement, together with the respective amounts due on each of said tracts, pieces or parcels of land, which amounts shall include the j annual installment and interest on all unpaid balances for one year at the rate of not to exceed five per cent per annum on such amounts so certified, which amounts shall be collected as other taxes are collected.
