AN ORDINANCE relating to and apportioning and levying special assessments on certain lots and
pieces of ground in the City of Salina, Kansas, to pay the cost of paving and grading Lewis
Avenue (Twenty-eight (28) feet wide from toe of gutter to toe of gutter) with two (2)_=_

to the north line of Cloud Street; paving and grading Ral h Avenue (Twenty-eight (28) feet
wide from toe of gutter to toe of gutter) with two (2) inch hot asphalt mix over a six (6)
inch crushed rock base, from the east line of Quincy Street to the west line of Norton Street;
curbing, guttering, paving and grading Smith Avenue (Thirty-three (33) feet wide from back of
curb to back of curb) with two (2) inch -EBT -asphalt mix over a six (6) inch crushed rock base,
from the east line of Haskett to the west line of US 81 By-pass, Broadway Boulevard; paving
and grading Second Street with two (2) inch hot asphalt mix over a six (6) inch crushed rock
base, from the north Ine of Iron Avenue 250 feet north; paving and grading Windsor Drive
with two (2) inch hot asphalt mix over a six (6) inch crushed rock base, from t e scut ine
of Republic Avenue to the west line of Dover Drive; curbing, guttering and grading of the
East side of Lewis Avenue from the north line of Beloit Avenue to the north line of
Minneapolis Avenue; curbing, guttering, and grading Highland Avenue, from the south line of
High Place to the south line of Wayne Avenue; and relating o and providing for the collection
and payment of such assessments.

BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
Section 1. For tba-purpose of paying for that part of the cost of improvements in
certain portions of certain streets as hereinafter set forth in the following sections of this
ordinance which is chargeable to the private property in the assessment districts of each of
such improvements, respectively, as set forth in the following sections of this ordinance
with respect to each of such improvements, there are hereby levied and assessed on the property
liable therefore, being all the lots and pieces of land lying on either side of said street

so improved, respectively, to the middle of the block for the distance improved with respect
to the improvements mentioned in Sections 2, 3, 4, 5, 6, 7, and 8 of this ordinance, according
to the appraised value of such lots and pieces of ground with respect to each such improvements,
without regard to the buildings or improvements thereon, special assessments covering the cost
of such work and improvements, said special assessments being based on the special valuation
and appraisement of said lots and pieces of ground .heretofore made by three disinterested
appraisers appointed by the Board of Commissioners of the City of Salina, Kansas, with respect
to each such improvement, which said appraisements are hereby referred to and made a part of
this ordinance, and the several amounts so levied, apportioned and assessed against the lots
and pieces of ground for each such improvement, respectively, for the purpose aforesaid, are
hereby found and determined to be the amounts set forth in the following sections of this
ordinance with respect to each of said improvements.

Section 9. Said amounts so levied, apportioned and assessed as aforesaid will be due
and collectible in ten equal installments, the first becoming due with the taxes levied for
the year 1959, and one of said installments falling due each and every year thereafter until
all are paid and all to be collected with interest as in this ordinance provided, HOWEVER,
that the owner of any piece of property liable for any such assessment may redeem his property
from such liability by paying to the City Treasury the entire amount chargeable against the
same, as in this ordinance provided, at any time within thirty days after the publication of
this ordinance and before the issuance of bonds of said city in payment of the balance of the
cost of said improvements, the property so paid on shall not hereafter be liable for any
further assessments for the cost of said improvements nor for any part of said bonds.
9eatfi" & There is hereby levied further and assessed against such lots and pieces of
ground described in this ordinance, interest at such rate per annum as shall be borne by the
bonds hereafter to be issued for the payment of the remaining unpaid cost of such improvements,
to be hereafter determined and fixed by ordinance when such bonds are issued on all of said
installmbnts mentioned and provided for in this ordinance, from the date of the bonds which
may be issued at the end of thirty days as specified in the preceding sections hereof, as by
law provided, to the time of the collection of the installmbnts as provided by law, which
said interest shall be collected annually at the same time and in the same manner as said

installments are collected and after the taking effect of this ordinance and the fixing of
j the said interest rate when such bonds are authorized and issued, it shall be the duty of the
City Clerk of said City to annually at the same time other taxes are certified and until all
said assessments so apportioned and levied have been certified to the County Clerk of Saline
County, Kansas, eertify a full list of all property liable to assessment and taxation for such
work and improvement, except such property on-iUhich the special assessments aforesaid have
been paid in full as hereinbefore provided, together with the respective amounts due on each
of said lots and pieces of ground which amounts shall include the annual installments of such
special assessments with the interest for one year at the rate to be fixed as provided for in
this ordinance, on all unpaid balances of such assessments, and such amounts so certified as
herein provided shall be placed upon the tax roll by the County Clerk of Saline County, Kansas,
and collected as other taxes are collected.
Section 11. This ordinance shall take effect and be in force from and after its adoption
and publication once in the official city paper.
