ORDINANCE Num= 6252

AN ORDNANCE ratifying and confirming a contract with 0. D. Wilmoth doing business as Wilmoth
Construction Company for the construction of certain storm sewers and drainage in the City of
Salina, Kansas, to be designated as Schippel Addition Storm Sewer and Circle Addition Storm
Sewer, and providing for the issuance of Temporary Notes to pay the cost thereof, pending
the issuance and sale of bonds.
BE IT ORDAIM by the Board of Commissioners of the City of Salina, Kansas:
Section 1. That the acceptance of the City of Salina, Kansas of the proposal of the
Wilmoth Construction Company, hereinafter referred to as the "Contractor" as submitted to
the Board of Commissioners on July 1, 1958, which is hereby found to be the lowest and best
bid for such work, and the contract awarded by the Board of Commissioners of said City to
said contractor and signed on behalf of the City of Saline by its Mayor on July 8, 1958, for
the construction of eertgin public improvements in the City of Salina, Kansas, to -wit:
Beginning with a 42" storm sewer and outfall at the
intersection of the Smoky Hill River and at a point
101 South of the center line of Albert Avenue
extended east, thence west along a line 101 south of
the center line of Albert Avenue to a point which is
101 South of the center line of Albert Avenue and
101 vestd the center line of thio Street where a
manhole will be built, thence north 201 with a 42"
Storm Sewer to a point which is 101 west of the
center line of Ohio Street and 101 north of the center
line of Albert Avenue where a manhole will be built, thence
west with a 24" storm sewer on a line 101 north of the
center line of.Albert Avenue to a point 10' east of the
center line of Lewis Street where a manhole will be built;
thence west with an 18" storm sewer on a line 101 north
of the center line of Albert Avenue to a point 101 east
of the center line of Marc Street where a manhole will be
built, thence north 415' along a line 101 east of the center
line of Marc Street with an 18" storm sewer where a manhole
will be built. Beginning at the manhole which is 101
north of the center line of Albert Avenue and 101 west of
the center line of Ohio Street, thence north with a 24"
Storm sewer to a point which is 10' west of the center
line of Ohio Stree6-and 101 south of the center line of
Schippel Drive, where a manhole will be built, thence north
with an 18" Storm Sewer to a point which is 101 west of
the center line of Ohio Street and 101 south of the center
line of Cloud Street where a manhole will be built. Beginning
at the manhole which is 101 west of the center line of Ohio
Street and 101 south of the center line of Schippel Drive,
thence west with an 18" storm sewer to a point 101 east of
the center line of Fawn Street, where a manhole will be built
thence west with an 18" storm sewer to a point which is 10'
east of the center line of Lewis Ekreet and 101 south of the
center line of Schippel Drive where a manhole will be built,
thence north west 415' to a point which is 101 west of the
center line of Lewis Street and 405' northwest of the center
line of Schippel Drive where a manhole will be built. Beginning
at an existing manhole which is 10' north of the center line
of Max Avenue and 4351 west of the center line of Roach Street,
thence east with a 15" storm sewer to a point 161 east of the center
line of Roach Street where a manhole will be built which will be
terminus of Schippel Storm Sewer.

Beginning at an existing manhole which is i5t west of
the center line of Osage Avenue and 148' north of the
center line of Cloud Circle, thence south in utility
easement with a 21" storm sewer to a point 10' north
of the center line of Acorn Circle, where a manhole
will be built, thence south with an 18" storm sewer
in the utility easement to a point 10' north of Oak
Circle, where a manhole will be built, thence east
with an 18" storm sewer to a point 10' north of the
center line of Oak Circle and 10' west of the center
line of Dover Circle where a manhole will be built,
thence northeast with an 18" storm sewer to a point
10' north of the center line of Acorn Circle and
10' west of the center line of Dover Circle where a
manhole will be built. Beginning at the manhole which
is at a point 10' north of the center line of Acorn
Circle and in line of utility easement running north
and south, thence west with a 15' storm sewer to a point
10' north of the center line of Acorn Circle and 141
east of the west line of Cloud Circle where a manhole
will be built which will be terminos of Circle Addition
Storm Sewer.
at and for the unit price for said work contained in said proposal, which proposal and
contract are hereby referred to and made a part of this ordinance, be and the same is hereby
ratified and confirmed, said proposal being within the estimated cost of said improvements
as shown by the sworn estimates of the City Engineer on file in the office of the City Clerk
which estimate is hereby referred to and made a part of this ordinance.
Section 2. Said improvements shall be built and constructed in accordance with the
plans and specifications therefore prepared by the City Engineer on file in the office of
the City Clerk and in accordance with the proposals of said contractor and under the term; of
said contract, all of which are hereby referred to and made a part of this ordinance.
Section 3. That temporary notes signed by the Mayor and attest by the City Clerk be
issued from time to time as the work progresses in the manner and form as required by law,
the total amount thereof not to exceed the amount of $42,525.00 for such work, such notes to'
bear interest at not to exceed 5 per cent per annum and to mature not later than December 1,
1959, and to be issued in such amounts and at such times as may the money for the payment of
the cost of such work be required, such notes to be issued to said contractor and to be
redeemed and cancelled at the time that Internal Improvement bands are issued in lieu thereof.
Section 4. That this ordinance shall take effect and be in full fordo from and after
its publication once in the official city paper.
