90-4256 Sell Park Likens-Foster(First Published in The Salina Journal December , 1990) RESOLUTION NUMBER 90-4256 A RESOLUTION DETERMINING THAT CERTAIN REAL ESTATE IS NO LONGER NEEDED BY THE CITY OF SALINA FOR PARK PURPOSES AND THAT A SALE THEREOF WOULD BE IN THE BEST INTEREST OF THE CITY. Kansas: BE IT RESOLVED by the Governing Body of the City of Salina, Section 1. That it is hereby determined that the following described real estate is no longer needed or required for park purposes of the City of Salina, Kansas: A parcel of land located within the proposed park as shown on the Plat of Likins-Foster Addition to the City of Salina, Kansas, recorded in the office of the Register of Deeds, Saline County, Kansas, on the 12th day of May, 1952, in Book N of Plats, Page 18, and dedicated by City of Salina Resolution Number 1729, said Resolution adopted on the 3rd day of July, 1956, said parcel described by metes and bounds as follows: Beginning at the southeast corner of Likins-Foster Addition to the City of Salina, Kansas where the south boundarary of said Addition intersects with the west right-of-way line of U.S. Highway 81; Thence South eighty-nine degrees fifty-two minutes zero seconds West (S89°52'00"W) along said south boundary a distance of four hundred thirty-eight and thirty-six hundredths feet (438.36') to the east right-of-way line of Osage Avenue; Thence North zero degrees eight minutes zero seconds West (NO008'00"W) along said right-of-way a distance of seventy-seven and ninety-six hundredths feet (77.86'); (3) in said Addition Thence North thirty-seven degrees nine minutes nine seconds West (N37°09'09"W) along said right-of-way a distance of one hundred ten and seventeen hundredths feet (110.17') to a tangent curve with a chord bearing North five degrees twenty-six minutes seventeen seconds West (N05026'17"W) a distance of seventy-five and twelve hundredths feet (75.12'), said curve having a central angle of sixty-three degrees twenty-five minutes forty-four seconds to the right, said curve being on said right-of-way line; Thence along the arc of said curve a distance of seventy-nine and ten hundredths feet (79.101) to the southwest corner of Lot Seventeen (17), Block Three (3), in said Addition, said point being on a non tangent line to the southeast; Thence South sixty-three degrees forty-three minutes twenty-five seconds East (S63143'25"E) along the south line of said Lot Seventeen (17) a distance of one hundred thirty-five and sixty-five hundredths feet to the southeast corner of said lot; Thence North twelve degrees thirteen minutes twenty seconds East (N12°13'20"E) along the east line of Lots Seventeen (17), Sixteen (16) and Fifteen (15), Block Three (3) in said Addition a distance of two hundred twenty-seven and thirty-four hundredths feet to the east corner of said Lot Fifteen (15), said point being on the west right-of-way line of U.S. Highway 81 and said point intersecting a non tangent curve with a chord bearing South thirty-eight degrees fifty-two minutes nineteen seconds East (S38052119"E) a distance of one hundred one and seventy-five hundredths feet, said curve having a central angle to the right of three degrees fifty-four minutes twenty-two seconds; Thence along the arc of said curve, also being along said right-of-way line, a distance of one hundred one and seventy-six hundredths feet (101.761) to a tangent line; Thence South forty degrees forty-nine minutes thirty seconds East (S40149'30"E) along said right-of-way a distance of four hundred twenty-six and twelve hundredths feet to the point of beginning. The above described parcel of land contains 98,718.87 square feet or 2.26 acres, more or less. The above described parcel of land is subject to all easements and right-of-ways of record. Section 2. That it would be in the best interest of the City of Salina, Kansas, that the above described land be sole. Section 3. That if within thirty (30) days from the date of the last publication of this resolution there has not been filed with the City Clerk a protest signed by the qualified electors of the City of Salina equal in number to 1I not less than ten percent (10%) of the electors who voted in the last preceding regular city election as shown by the poll books, then the City of Salina will proceed to sell said property. Section 4. That this Resolution shall be in full force and effect from and after its publication twice in the official city newspaper.
