91-4298 Acquire Property(Published in The Salina Journal April a6, 1991) RESOLUTION NUMBER 91-4298 A RESOLUTION DETERMINING IT NECESSARY TO ACQUIRE FEE SIMPLE TITLE TO CERTAIN REAL ESTATE FOR THE USE OF THE CITY OF SALINA, KANSAS, FOR THE PURPOSES OF A CITY VEHICLE FUELING FACILITY AND UTILITY DISTRIBUTION WAREHOUSE. WHEREAS, certain of the City's current underground fuel storage tanks must be removed by December 31, 1991, pursuant to federal law and regulation; and WHEREAS, property is needed for a centrally located City vehicle fueling facility and for a water utility distribution warehouse located in good proximity to the water plant and administrative offices; and WHEREAS, the property generally described as: Certain lots included in Original Town, Salina, Kansas, bounded on the south by Elm Street, on the west by Union Pacific tracks, and on the east by Third Street, measuring approximately 250 feet by 250 feet (referred to herein as the "Property") is of a good size and location for such a centrally located vehicle refueling facility and water utility distribution warehouse, SO NOW, THEREFORE Kansas: BE IT RESOLVED by the Governing Body of the City of Salina, Section 1. It is hereby declared necessary that the City of Salina, Kansas acquire fee simple title to the Property, by purchase or by proper authorization and proceedings in eminent domain, for use as a centrally located city vehicle refueling facility and a water utility distribution warehouse located in good proximity to the City's water plant and administrative offices. Section 2. The City Engineer is directed to make a survey and description of the Property and to prepare a certificate showing the result of the survey over his signature and then file such certificate, survey, and description with the Office of the City Clerk. Section 3. This Resolution shall take effect and be in force from and after its adoption and publication once in the official city newspaper.
