RESOLUTION NUMBER 91-4347
A RESOLUTION DETERMINING THE ADVISABILITY OF SIDEWALK
IMPROVEMENTS ON OHIO STREET, ESTIMATING THE COST THEREOF,
DEFINING THE BOUNDARIES OF THE IMPROVEMENT DISTRICT, METHOD OF
ASSESSMENT, AND APPORTIONING THE COST BETWEEN THE IMPROVEMENT
DISTRICT AND THE CITY -AT -LARGE.
WHEREAS, the public hearing on the advisability of the following
improvements, to -wit:
Property line and curb line sidewalk along the east side of Ohio
Street from Ellsworth Avenue to Cloud Street.
was held as provided by Resolution Number 91-4337, adopted and approved by
the Board of Commissioners of the City of Salina, Kansas, on the 15th day
of July, 1991.
WHEREAS, notice of public hearing on the advisability of the said
improvements has been published in The Salina Journal, the official city
newspaper, on the 18th and 25th day of July, 1991, as provided by said
Resolution and K.S.A. Sections 12 - 6a01 to 12-6a18.
WHEREAS, the Board of Commissioners of the City of Salina,
Kansas, met in the Commissioners' Room, in the City -County Building, on the
29th day of July, 1991, at 4:00 p.m. for the purpose of conducting a public
hearing on the advisability of said improvements, said hearings were finally
adjourned on the 29th day of July, 1991, as provided by law, SO NOW,
THEREFORE
BE IT RESOLVED by the Governing Body of the City of Salina,
Kansas:
Section 1. That the Board of Commissioners of the City of Salina,
Kansas, hereby finds and finally determines that it is advisable to make the
following improvements, to -wit:
Property line and curb line sidewalk along the east side of Ohio
Street from Ellsworth Avenue to Cloud Street.
Section 2. The extent or boundaries of the proposed improvement
district to be assessed is:
That part of the City of Salina, Saline County, Kansas, described as
follows, to -wit:
Replat of Lot 22, Block 3 and Lot 9, Block 6, Dow Addition
West 75' of Lot 1, Block 8
Lot 2, Block 8
Lot 3, Block 8
Nazarene Addition
Lot
1,
Block 1, and
vacated street lying north and east of said Lot
1,
and
Lot 4, Block
8, Replat of Lot 22, Block 3 and Lot 9, Block
6,
Dow
Addition
Lot 1, Block 1
Gile Addition
Lundberg Addition
Lot 1 and 2 except the South 325 feet, Block 1
Parkwood Village Addition
North 75 feet of Lot 1, Block 1
Kâ Caw Priming â Sabine, Kansas
Section 3. The estimated or probable cost of such improvements is
$22,198.70.
Section 4. The apportionment of cost between the improvement
district and the City -at -large is as follows:
1. Costs chargeable to private property in the amount of
$7,574.95.
2. Costs chargeable to the city -at -large in the amount of
$14,623.75.
Section 5. The assessment with accrued interest shall be levied
as a special tax upon the property included within the benefit district
concurrent with the general property taxes and shall be payable in four (4)
equal annual installments.
Section 6. The method of assessment shall be based on the square
footage of the sidewalk actually constructed.
Section 7. BE IT FURTHER RESOLVED that the public hearing on
the advisability of the improvements set out in Section 1 hereof, is hereby
finally adjourned.
Adopted by the Board of Commissioners and signed by the Mayor
this 29th day of July, 1991.
