AN ORDINANCE providing for the paving and grading of Alley with concrete (Fifteen Feet wide)
first east of Ninth Street from Cloud Street to the north line of Lot 84, on Ninth Street,
Grounds of Kansas Wesleyan University; paving and grading of Alley, first north of Kirwin
with concrete (Sixteen (16) feet wide) from Santa Fe Avenue west 117.5 feet; curbing,
guttering, paving and grading of Cloud Street with concrete (Thirty-three (33) feet wide
from back of curb to back of curb7 from the east line of Lewis Avenue to the west line of
Ohio Street; paving and grading of Eleventh Street with concrete (Twenty-eight (28) feet

back of curb to back of curb) from the north line of Iron Avenue to the south line of Gypsum
Avenue; paving and grading of Jewell Avenue with concrete (Twenty-eight (28) feet wide from
toe of gutter to toe of gutter) from the west line of Rush Street to the west line of
Coronado Street; curbing, guttering, paving and grading of Lewis Avenue with concrete (Thirll
three (33) feet wide from back of curb to back of curb) from the south line of Minneapolis
Avenue to the south line of Republic Avenue; curbing, guttering, paving and grading of Talle
Drive with concrete (Thirty-three (33) feet wide from back of curb to back of curb) from the
west line of Ingman Road to the east right-of-way line of the Missouri Pacific Railroad;
paving and grading of Tenlawns with concrete (Twenty-eight (28) feet wide from toe of gutter
to toe of gutter) from the north line of Frost Street to the south line of Brown Street;
curbing, guttering, paving and grading of Carlton Place (Thirty-three (33) feet wide from bac
of curb to back of curb) with two (2) inch hot asphalt mix over a six (6) inch crushed rock
base, from the west line of Ingman Road to the east line of Roberts Avenue; curbing, gutteri
paving and grading of Dover Drive (Thirty-three (33) feet wide from back of curb to back of
curb) with two (2) inch hot asphalt mix over a six (6) inch crushed rock base, from the north
line of Teakwood Street to the south line of Winona Street; Curbing, guttering, paving and
grading of Holiday Street (Thirty-three (33) feet wide from back of curb to back of curb)
with two (2 inch hot asphalt mix over a six (6) inch crushed rock base, from the south line
of South Street to the west line of Clark Street; curbing, guttering, paving and grading of
Teakwood Street (Thirty-three (33) feet wide frmm back of curb to back of curb) with two
inch hot asphalt mix over a six (6) inch crushed rock base, from the east line of Winona
Street to the east line of Dover Drive; curbing, guttering, paving and grading of Westwood
Road (dirty -three (33) feet wide from back of curb to back of curb) with two (2) inch hot
asphalt mix over a six (6) inch crushed rock base, from the north line of Winona Street to
the south line of Teakwood Street; and providing for the payment of the cost thereof, and
how the same shall be assessed and the manner of the payment of the cost thereof.
WHEREAS, by Resolution Numbers 2190, 2191, 2198, 2159, 2153, 2146, 2187, 2200, 2199, 2169,
2152, 2145, 2188, 2192, 2189, 2203, 21680 2202, 2201) , duly adopted on July 14, August 4,
May 5, April 28, April 21, May 26, and April 14,1959, by the Board of Commissioners of the
City of Salina, Kansas, have declared that they deem it necessary to pave and grade Alley
with concrete (Fifteen feet wide) First east of Ninth Street from Cloud Street to the north
line of Lot 84, on Ninth Street, Grounds of Kansas Wesleyan University; pave and grade
Alley, First north of Kirwin with concrete (Sixteen (16) feet wide) from Santa Fe Avenue
west 117.5 feet; curb, gutter, pave and grade Cloud Street with concrete (Thirty-three (33)
feet wide from back of curb to back of curb) from the east line of Lewis Avenue to the west
line of Ohio Street; pave and grade Eleventh Street with concrete (Twenty-eight (28) feet wi
from toe of gutter to toe of gutter) from the port line of Woodlawn Avenue to the north line

inch crushed rock base, from the east line of Winona Street to the east line of Dover Drive;
curb, gutter, pave and grade Westwood Road (Thirty-three (33) feet wide from back of curb
to back of curb) with two (2) inch hot asphalt mix over a six (6) inch crushed rock base,
from the south line of Winona Street to the south line of Teakwood Streets;
WHEREAS, each of the said Resolutions were published for six days in the Salina Journal, a
daily newspaper, published in the said City, and being the official city paper, and the
majority of the resident property owners owning a majority of the square feet of the lots or
real estate liable to taxation for the cost of said improvements and did not within twenty
days from the date of the last publication thereof file with the City Clerk a sufficient
protest in writing against the making of said improvements, no protests of any kind having
been filed, SO NVW, THEREFORE
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
Section 1. That it is necessary and it is hereby ordered that an Alley, First east of
Ninth Street, from Cloud Street to the north line of Lot 84, on Ninth Street, Grounds of
Wesleyan University be paved and graded with concrete (Fifteen (15) feet wide) along with
such excavation as may be necessary, and paved between the guttering lines thereof.
Section 2. That it is necessary and it is hereby ordered that an Alley, First North of
Kirwin , from Santa Fe Avenue west 117.5 feet be paved and graded with concrete (Sixteen (16)
feet wide) along with excavation as may be necessary, and paved between the guttering lines
thereof.
Section 3. That it is necessary and it is hereby ordered that Cloud Street, from the
east line of Lewis Avenue to the west line of Ohio Street, in said City, be curbed, guttered
and paved with concrete (Thirty-three (33) feet wide from back of curb to back of curb)
with excavation thereof, and graded to the established paving grades and paved between the
guttering lines thereof.
Section 4. That it is necessary and it is hereby ordered that Eleventh Street, from
north line of Woodlawn Avenue to the north line of Cloud Street, in said City, be paved and
graded with concrete (Twenty-eight (28) feet wide from toe of gutter to toe of gutter) with
excavation thereof, and graded to the established paving grades and paved between the Butte:
lines thereof.

Section 5. That it is necessary and it is hereby ordered that Eleventh Street, from the
south line of Claflin Avenue to the south line of Woodlawn Avenue, in said City, be paved
and graded with concrete (Tvem$y-eight (28) feet wide from toe of gutter to toe of gutter)
with excavation thereof, and graded to the established paving grades and paved between the
guttering lines thereof.
Section 6. That it is necessary and it is hereby ordered that Gypsum Avenue, from the
east line of Wisconsin to AL point 272 feet east, in said City, be curbed, guttered, paved
and graded with concrete (Thirty-three (33) feet wide from back of curb to back of curb)
with excavation thereof, and graded to the established paving grades and paved between the
guttering lines thereof.
Section 7. That it is necessary and it is hereby ordered that Hamilton Avenue, from the
west line of Santa Pie Aymue to the bast line of Ninth Street, in said City, be curbed,
guttered, paved and graded with concrete (Thirty-three (33) feet wide from back of curb to
back of curb) with excavation thereof, and graded to the established paving #rades and paved
between the guttering lines thereof.
Section 8. That it is necessary and it is hereby ordered that Hageman Avenue, from the
south line of Garden Avenue to a point 338 feet south of the south line of Vale Avenue, in
said City, be paved and graded with concrete (Thirty-three (33) feet wide from back of curb
to back of curb) with excavation thereof, and graded to the established paving grades and
paved between the guttering lines thereof.
Section 9. That it is necessary and it is hereby ordered that the West side of Hageman
Avenue from the center line of Garden Avenue to the point 338 feet south of the south line
of Yale Avenue, in said City, be curbed, and guttered and graded with excavation thereof#
Section 10. That it is necessary and it is hereby ordered that Iowa Avenue, from the
north line of Iron Avenue to the south line of Gypsum Avenue, in said City, be curbed,

to back of curb) with excavation thereof, and graded to the established paving grades and
paved between the guttering lines thereof.
Section 11. That it is necessary and it is hereby ordered that Jewell Avenue, from the
west line of Rush Street to the west line of Coronado Street, in said City, be paved and graAed
with concrete (Twenty-eight (28) feet wide from toe of gutter to toe of gutter) with
excavation thereof, and graded to the established paving grades and paved between the
guttering lines thereof.
Section 12. That it is necessary and it is hereby ordered that Lewis Avenue, from the
south line of Minneapolis Avenue to the south line of Republic Avenue, in said Ctty, be
curbed, guttered, paved and graded with concrete (Thirty-three (33) feet wide from back of
curb to back of curb) with excavation thereof, and graded to the established paving grades
and paved between the guttering lines thereof.

the west line of Ingman Road to the east right-of-way line of the Missouri Pacific Railroad,)

Section 14. That it is necessary and it is hereby ordered that Tenlawns, from
the north line of Frost Street to the south line of Brown Street, in said City, be paved
and graded with concrete (Twenty-eight (28) feet wide from toe of gutter to toe of gutter)
with excavation thereof, and graded to the established paving grades and paved between the
guttering lines thereof.
Section 15. That it is necessary and it is hereby ordered that Carlton Place, from the
west line of Ingman Road to the east line of Roberts Avenue, in said City, be curbed, gutter
paved and graded with two (2) inch hot asphalt mix over a six (6) inch crushed rock base,
(Thirty-three (33) feet wide from back of curb to back of curb) with excavation thereof, and
graded to the established paving grades and paved between the guttering lines thereof.
Section 16. That it is necessary and it is hereby ordered that Dover Drive, from the
north line of Teakwood Street to the south line of Winona Street, in said City, be curbed,
guttered, paved and graded with two (2) inch hot asphalt mix over a six (6) inch crushed
rock base, (Thirty-three (33) feet wide from back of curb to back of curb) with excavation
thereof, and graded to the established paving grades and paved between the guttering lines
thereof.
Section 17. That it is necessary and it is hereby ordered that Holiday Street, from
the south line of South Street to the west line of Clark Street, in said City, be curbed,
guttered, paved and graded with two (2) inch hot asphalt mix over a six (6) inch crushed rock
base, (Thirty-three (33) feet wide from back of curb to back of curb) with excavation thereof
and graded to the established paving grades and paved between the guttering lines thereof.
Section 18. That it is necessary and it is hereby ordered that Teakwood Street, from
the east line of Winona Street to the east line of Dover Drive, in said City, Be curbed,
guttered, paved and graded with two (2) inch hot asphalt mix over a six (6) inch crushed
rock base, (Thirty-three (33) feet wide from back of curb to back of curb) with excavation
thereof, and graded to the established paving grades and paved between the guttering lines
thereof.
Section 19. That it is necessary and it is hereby ordered that Westwood Road, from the
north line of Winona Street to the south line of Teakwood Street, in said City, be curbed,
guttered, paved and graded with two (2) inch hot asphalt mix over a six (6) inch crushed
rock base, (Thirty-three (33) feet wide from back of curb to back of curb) with excavation
thereof, and graded to the established paving grades and paved between the guttering lines
thereof.

Section 20. That for the work and improvements herein provided for the City Engineer
shall make and file with the City Clerk on or before the ALT day of Ste: , 1959,
complete plans and specifications for the curbing, guttering, paving and grading with
excavation necessary therefore, of each of the streets or portions thereof described in
Sections 1 to 19, both inclusive, of this ordinance, with the following type of improvements
Concrete combined curb and gutter on each side thereof,
30 inches wide from back of curb to paving line, curb
12 inches deep at back, guttering 6 inches deep; and the
necessary grading of each to the established paving
grade, and paving thereof with 6 inch reinforced concrete
providing that in the event of the non-availability of
reinforced material that then said pavement shall be
constructed with concrete to a depth of 7�11nches between
the curb add gutter line on each side thereof and within
the limits of said streets hereinbefore described; and
the paving thereof with two inch hot mixed asphaltic
concrete over a six inch crushed rock stabalized base
on said streets hereinbefore described.
and said Engineer shall on or before the same date, submit to the Board of Commissioners
under oath, detailed estimates of the cost of such work and improvements.
Section 21. That after such plans and specifications have been made -and prepared by
City Engineer and filed with the City Clerk as aforesaid, the Board of Commissioners may
advertise Published advertisements in the official city paper of the City of Salina, Kansas,
for three consecutive days for the receipt of sealed proposals for the improving of said
streets with the kind of material named and specified in the preceding section hereof, and
for the excavation and grading necessary for the completion of said work and after the
receipt of such proposals, the Board of Commissioners may and are hereby authorized and
directed to let contracts for the improvimg of said streets with the materials selected by
them to the lowest responsible bidder or bidders thereof, as determined by the Board of
Commissioners, and for such excavation and grading. Said Board reserves the right to reject

any or all bids.
Section 22. That for the improving of the above mentioned streets, such assessment sha
be made for the full cost thereof according to law on all lots and pieces of land to the
center of the block on either side of the streets to be improved according to the appraisers
valuation thereof, without regard to the buildings or improvements thereon for the distance
to be improved.
Section 23. Mat after the passagd and publication of this ordinance, the Board of

Commissioners shall appoint three disinterested appraisers, householders, who after having
taken an oath to make a true and impartial appraisement, of all lots and pieces of land liable
to assessment and taxation as aforesaid, as may be designated by the Board of Commissioners of
the City of Salina, without regard to the buildings or improvements thereon and after making
such appraisement shall return to the Board of Commissioners of said City and said Board
of Commissioners shall designate a time and place for the hearing of any complaints that may
be made as to the value of any lots and pieces of land appraised as aforesaid, of which due
notice shall be given in the official city paper, at which hearing the Board of Commissioners
may alter any valuation of any lot or piece of land, if, in their opinion the same has been
appraised too high or too low.

Section 24. That for the purpose of paying the cost of the work and improvements in this
ordinance provided for, the Board of Commissioners are hereby authorized and directed to
issue internal improvement bonds of the City of Salina, in an amount not to exceed the contract
price for the cost of such improvements and to run for a period of ten years and be payable !.
in ten equal installments, together with interest not to exceed five per cent per annum, which
bonds shall be made payable at the Fiscal Agency of the State of Kansas and for the purpose
of paying the principal and interest on said bonds as they severally become due and payable the
Board of Commissioners shall apportion and assess against the lots and pieces of land within'
the taxing district of such improvements special assessments covering the cost of such
improvements and the apportionment herein contained shall hold good for all of the installments
that are to be collected from the specific property chargeable with said improvements.
such assessments and apportionment ordinance shall contain the total amount of tax apportioneId
to each tract, piece or parcel of land within the taxing district and shall state the number,:
of annual installments in which such tax is to be collected; and thereafter the City Clerk
shall annually, at the same time other taxes are certified, certify to the County Clerk of
Saline County, Kansas, a full list of all property liable to such work and assessments
together with the respective amounts due on each of said tracts, pieces of land, which
amounts shall include the annual installments and interest on all unpaid balances for one
year at the rate of not to exceed five per cent per annum on such amounts so certified whicht
shall be collected as other taxes are collected; PROVIDED, that for the purpose of defraying
the cost of improving the intersections and areas formed by the crossing of streets and
alleys, and for the grading of said streets where the same is provided for in this ordinance
as well as where the improvement is through or adjacent to property of the City for which
the City is liable, the assessment will be made against all taxable property of the City of
Salina and paid by the City at large.
Section 25. That this ordinance shall take effect and be in full force from and after
its adoption and publication once in the official city paper.
