6376 Utility Improv-Bel Air AddCOX DLiDATED-SATANA 1 1 1 ORDINANCE NUMBER (Published in The Salina Journal '/�' 1959) AN ORDINANCE creating and defining a certain lateral sanitary sewer district in the City of Salina, Kansas, designated as Lateral Sanitary Sewer District Number 397, and providing for the construction of a lateral sanitary sewer in said Lateral Sanitary Sewer District Number 397, so created and providing for the payment of the cost thereof and for the levying of special assessments against the property in said district for the payment of the cost of such construction and for the issuing of bonds to pay the cost thereof. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. Lateral Sanitary Sewer District Number 397. That there be and there is hereby created Lateral Sanitary Sewer District in the City of Salina, Kansas, which shall be and it is hereby designated as Lateral Sanitary Sewer District Number 397, and which district shall include all the following described property in the City of Salina, Kansas, to -wit: Benefit District: All of Bel -Air Addition to the City of Salina, Saline County, Kansas. Section 2. It is necessary and it is hereby ordered that an eight inch V. C. P. Lateral Sanitary Sewer with all necessary connections, manholes, flushing tanks and other appurtenances be constructed and built in and to serve said Lateral Sanitary Sewer District Number 397 as created by Section 1 of this ordinance along the following course, to -wit: An 8 inch clay pipe sewer beginning at an existing sewer in Circle Addition at the extention west of the line which is a common boundary between Lots 8 and 9 in Bel -Air Addition. (1) thence east along said line which is common between said lots 8 and 9 to a point which is the radius point of the northwest corner of Bel Air Drive where sewer will branch in three directions A, B, and C. (2) Branch A begins at manhole at said northwest corner of Bel Air Drive thence south in Bel Air Drive to a point west and on line with easement between Lots 22, 21 and 23, where a manhole will be built and line will continue east in said easement 110 feet to terminus. (3) Branch B begins at manhole at said northwest corner of Bel Air Drive and thence north along east line of Lot 10 of said Addition to a point 2 feet north of the south line of Lot 1 of said Addition. (4) Branch C begins at manhole of said northwest corner of Bel Air Drive and thence easterly and southerly in Bel Air Drive to a point east and opposite center line of easement between Lots 19, 20 and 26; thence west in said easement 110 feet to terminus. Section 3. That the City Engineer shall on or before the 22nd day of September, 1959; prepare and file in the office of the City Clerk, plans and specifications for the construct of the Lateral Sanitary Sewer provided for in the preceding sections of this ordinance whicl shall be of the proper character to serve the property lying within the district for which such sewer is to be constructed and shall on or before the same date prepare and submit to the Board of Commissioners a detailed estimate under oath of the cost thereof. That there- after the City Clerk shall advertise for three consecutive days in the official city paper kion CONSOLIDATED-SALINA 1 1 L� for sealed proposals for the building and construction of such a sewer according to such pland and specifications, which proposals shall be filed with the City Clerk on or before the time fixed in such notice, at which time the Board of Commissioners may let a contract for the building and construction of such sewer to the lowest and best responsible bidder or bidders therefore, if, there be any whose bids do not exceed the estimated cost thereof, but said Board shall reserve the right to reject any or all such proposals, and if no bids. shall be received within such estimate, the Board of Commissioners shall have the power to do such work and make such improvement within the estimated cost thereof as provided by law Section 4. That for the cost of building and constructing such sewer, special assessments I shall be made for the full cost thereof on all lots and pieces of land within and for which such sewer shall be built, according to the appraised value thereof, without regard to the buildings or improvements thereon. Section 5. After the passage and publication of this ordinance, the Board of Commiss shall appoint three disinterested appraisers, who after having taken oath to make a true and impartial appraisement of all lots and pieces of land liable to taxation for the cost of such improvements shall within five days after having been notified of their appointment proceedli to appraise all of the lots and pieces of land within the district liable to assessment and taxation as aforesaid, without regard to the buildings or improvements thereon, and after making such appraisement shall return to the Board of Commissioners of said City and said Board shall designate a time for a special meeting of said Board for the purpose of hearing any complaints that may be made as to the value of any lot or piece of land appraised as aforesaid of which special session due notice shall be given in the official city paper, at I which special session said Board may alter any valuation of any lot or piece of land, if, in their opinion the same has been appraised too high or too low. Section 6. The special assessments herein provided for may be paid by the person liab therefore in ten approximately equal instalments but the owner of any property liable to such assessment may within thirty days from the date of determining the amount assessed against the property, pay the same in full and his property so paid on shall not be liable for any assessments for the cost of such improvements, and bonds as hereinafter provided fo shall be issued in an amount of the cost of such improvements remaining unpaid at the end of thirty days from the time such assessment is fixed. Section 7. For the purpose of paying for the work and improvements in this ordinance provided for, the Board of Commissioners may and are hereby authorized and directed to issue improvement bonds of the City of Salina, Kansas, on an amount not to exceed the total cost of such improvement, and to run fof a period of ten years and be payable in ten approximatel equal annual installments, togehher with interest not to exceed five per cent per annum, which bonds shall be issued and payable according to law; and for the purpose of paying the principal and interest on said bonds as they severally become due andpaybble the Board of Commissioners shall apportion and aasess against the lands and pieces of land within the rs CONSOLIDATED-SALINA 1 taxing district of such improvements, spacial assessments covering the cost of such improvement and apportionment therein contained shall hold good for all of the installments that are to!, i be collected from the specific property chargeable therefore, with such improvements; such assessments and apportionipent ordinance shall contain the total amount of tax apportioned to such tract, piece or parcel of land within the taxing district and shall state the numbed+ of annual installments in which such tax is to be collected; and thereafter the City Clerk i shall annually, at the same time that other taxes are certified, certify to the County Clerk' of Saline County, Kansas, a full list of all property liable for such work and improvement,i together with the respective numbered amounts due on each of said tracts, pieces or parcels] of land, which amounts shall include the annual installments and interest on all unpaid balances for one year at the rate of not to exceed five per cent per annum on such amounts so certified, which amounts shall be collected as other taxes are collected. Section 8. This ordinance shall take effect and be in full force from and after its adoption and publication once in the official city paper.
