6374 Utility Improvements�:ONSbt IDATED-SA[,INA 1 i f] ORDINANCE NUMBEER,�.�.J/�/� 11 637 (Published in The Salina Journal L /" Y'v" � - , 1959) AN ORDINANCE ratifying and confirming a contract with L. W. Rexroad and Son doing business as L. W. Rexroad and Son Construction Company for the construction of Lateral Sanitary Sewers 393 and 394, and providing for the issuance of Tempprary Notes to pay the cost thereof, pending the issuance and sale of bonds. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That the acceptance of the City of Salina, Kansas, of the proposal of the L. W. Rexroad and Son Construction Company, hereinafter referred to as the "Contractor' as submitted to the Board of Commissioners on September 8, 1959, which is hereby found to be the lowest and best bid for such work, and the contract awarded by the Board of Commissioners of said City to said contractor and signed on behalf of the City by its Mayor on September 15, 1959, for the construction of certain public improvements in the City of Salina, Kansas, to -wit: An eight inch clay pipe sewer (1) beginning at a manhole to be constructed in Ohio Street, 7 feet west of the center line thereof and 100 feet north of the north line of Millwood Drive. (2) thence west in the center line of easement in Blocks 2 and 1 to a point 10 feet west of the east line of Lot 1, Block 1 of Riker Addition. Lateral 393- (1) An 8 inch clay pipe sewer beginning with a manhole to be constructed over an existing sewer which is 46.6 feet west of the center line of Broadway Boulevard and at a point 20 feet north of the center line of Beverly Drive. (2) thence west along a line which is 20 feet north of the center line of Beverly Drive 1665.45 feet more or less to the west line of Lot 8, Vanderbilt Addition, where a manhole will be built which will be terminus of Lateral 394. at and for the unit price for said work contained in said proposal, which proposal and contract are hereby referred to and made a part of this ordinance, be and the same is hereby ratified and confirmed, said proposal being within the estimated cost of said improvements as shown by the sworn estimates of the City Engineer on file in the Office of the City Clerk which estimate is hereby referred to and made a part of this ordinance. Section 2. Said improvements shall be built and constructed in accordance with the and specifications therefore prepared by the City Engineer on file in the office of the City Clerk and in accordance with the proposals of staid contractor and under the terms of said contract, all of which are hereby referred to and made a part of this ordinance. Section 3. That temporary notes signed by the Mayor and attest by the City Clerk be issued from time to time as the work progresses in the manner and form as required by law, the total amount thereof not to exceed the amount of $12,103.00 for such work, such notes to bear interest at not to exceed 5 per cent per annum and to mature not later than December 1, 1960, and to be issued in such amounts and at such times as may the money for the payment of the cost of such work be required, such notes to be issued to said contractor and to be redeemed and cancelled at the time that Internal Improvement Bonds are issued in lieu thereof, CONSOLIDATED-SALINA 1 1 �1_ Section 4.
