ORDINANCE � 3 6

AN ORDINANCE creating and defining a certain lateral sanitary sewer district in the City of
Salina, Kansas, designated as Lateral Sanitary Sewer District Number 3", and providing for
the construction of a lateral sanitary sewer in said Lateral Sanitary Seger District Number
395, so created and providing for the payment of the cost thereof and for the levying of
special assessments against the property in said district for the payment of the cost of
such construction and for the issuing of bonds to pay the cost thereof.
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
Section 1. Lateral Sanitary Sewer District Number 395. That there be and there is
hereby created lateral Sanitary Sewer District in the City of Salina, Kansas, which shall be
and it is hereby designated as Lateral Sanitary Sever District Number 395 and which district
shall include all the following described property in the City of Salina, Kansas, to -wit:
Benefit District:
Lot 9, Addition to Block 2, Southern View Addition
to the City of Salina, Kansas.
Section 2. It is necessary and it is hereby ordered that an eight inch V. Ce P.
lateral Sanitary Sever with all necessary connections, manholes, flushing tanks and other
appurtenances be constructed and built in and to serve said Latemxl Sanitary Sever District
Number 395 as created by Section 1 of this ordinance along the following course, to-vit:
An 8 inch Clay pipe sever
le Bunning at an existing manhole which is in the easement
first north of Max Avenue and 160 feet east of the east right-
of-vay line of Norton Street.
2e thence east 43 feet to the east line of Lot 6, Block 2,
Southern View Addition where a manhole will be constructed which
will be terminus of Lateral 395•
Section 3e That the City Engineer shall on or before the day of (C -C 109,

prepare and file in the office of the City Clerk, plans and specifications for the construction
of the lateral Sanitary Sewer provided for in the preceding sections of this ordinance which')
shall be of the proper character to serve the property lying within the district for which

such sever is to be constructed and shall on or before the same date prepare and submit to
the Board of Commissioners a detailed estimate under oath of the cost thereof. That thereaft�
the City Clerk shall advertise for three consecutive days in the official city paper for
sealed proposals for the building and construction of such a sever according to such plans
and specifications, which proposals shall be filed with the City Clerk on or before the time
fixed in such notice, at which time the Board of Commissioners may let a contract for the
building and construction of such sewer to the lowest and best responsible bidder or bidders
therefore, if, there be any whose bids do not exceed the estimated cost thereof, but said
Board shall reserve the right to reject any or all such proposals, and if no bids shall be

received within such estivate, the Board of Commissioners shall have the power to do such
work and made such improvement within the estimated cost thereof as provided by law.

Section 4. That for the cost of building and constructing such sever, special assessments
shall be made for the full cost thereof on all lots and pieces of land within and for which
such sever shall be built, according to the appraised value thereof, without regard to the
buildings or improvements thereon.
Section _5_ After the passage and publication of this ordinance, the Board of Commissioners
shall appoint three disinterested appraisers, who after having taken oath to make a true and
impartial appraisement of all lots and pieces of land liable to taxation for the cost of such
improvements shall within five days after having notified of their appointment prodeed to
appraise all of the lots and pieces of land within the district liable to assessment and
taxation as aforesaid, without regard to the buildings or improvements thereon, and after
soaking such appraisement shall return to the Board of Commissioners of said City and said
Board shall designate a time for a special meeting of said Board for the purpose of hearing

any complaints that may be made as to the value of any lot or piece of land appraised as aforesaid
of which special session due notice shall be given in the official city paper, at which special
session said Board may alter any valuation of any lot or piece of land, if, in their opinion,
the same has been appraised too high or too low.
Section 6. The special assessments herein provided for may be paid by the person liable
therefore in ten approximately equal installments but the owner of any property liable to suc
assessment may within thirty days from the date of determining the amount assessed against th
property, pay the same in full and his property so paid on shall not be liable for any
assessments for the cost of such improvements, and bonds as hereinafter provided for shall
be issued in an amount of the cost of such improvements remaining unpaid at the end of thirty
days from the time such assessment is fixed.
Section . For the purpose of paying for the work and improvements in this ordinance
provided for, the Board of Commissioners may and are hereby authorized and directed to issue
6 provement bonds of the City of Salina, Kansas, on an amount not to exceed the total cost
of such improvement, and to run for a period of ten years and be payable in ten approximately
equal annual installments, together with interest not to exceed five per cent per annum,
which bonds shall be issued and payable according to law; and for the purpose of paying the
principal and interest on said bonds as they severally become due and payable the Board of
Commissioners shall apportion and assess against the lauds and pieces of land within the
taxing district of such improvements, special assessments covering the cost of such improven
and apportionment therein contained shalt hold good for all of the installments that are to
collected from the specific property chargeable therefore, with such improvements; such
assessments and apportionment ordinance shall contain the total amount of tax apportioned to
such tract, piece or parcel of land within the taxing district and shall state the number of

annual installments in etch such tax is to be collected; and thereafter the City Clerk shaill
annually, at the same time that other taxes are certified, certify to the County Clerk of
Saline County, Kansas, a full list of all property liable for such work and improvement,
together with the respective numbered amounts due on each of said tracts, pieces or parcels
of land, which amounts shall include the annual installments and interest on all unpaid bMancees
for one year at the rate of not to exceed five per cent per annum on such amounts so certified.,
which amounts shall be collected as other taxes are collected.
Section 8. This ordinance shall take effect and be in full force from and after its
publication Once in the official city paper•
