AN ORDINANCE relating to and apportioning and levying special assessments on certain lots and
pieces of ground in the City of Salina, Kansas, to pay the cost of paving and grading Dover
Drive (Twenty-eight (28) feet wide from toe of gutter to toe of gutter) with two (2) inch hots,
asphalt mix over a six (6) inch crushed rock base, from the east line of Vassar Drive to the
north line of Windsor Drive; curbing, guttering, paving and grading Edward Street (Thirty -j
three (33) feet wide from back of curb to back of curb) with two (2) inch hot asphalt mix over
a six (6) inch crushed rock base from the south line of Wayne Avenue to the north line of
Belmont Boulevard; curbing, guttering, paving and grading of Hageman Street (Thirty-three
(33) feet wide from back of curb to back of curb) with two (2) inch hot asphalt mix over a six
(6) inch crushed rock base, from the south line of Cloud Street to the east line of Broadway
Boulevard; curbing, guttering, paving and grading of Max Avenue (Thirty-three (33) feet wide

with two (2 inch hot asphalt mix over a six (6) inch crushed rock base, from the west line of
Hageman Street to the east line of Broadway Boulevard; curbing, guttering, paving and grading

inch hot asphalt mix over a six (6) inch crushed rock base, from the west line of Belmont
Boulevard to the west line of Roach Street; curbing, guttering, paving and grading of Wesle
Street (Thirty-three (33) feet wide from back of curb to back of curb) with two (2) inch hot;
asphalt mix over a six (6) inch crushed rock base, from the south line of Wayne Avenue to thej
south line of Norton Street; paving and grading of Pershing Street (Twenty-eight (28) feet
wide from toe of gutter to toe of gutter) with two (2) inch hot asphalt mix over a six (6)
inch crushed rock base, from the north line of Jewell Avenue to the south line of Ellsworth
Avenue; and relating to and providing for the collection and payment of such assessments.
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
Section 1. For the purpose of paying for that part of the cost of improvements in
certain portions of certain streets as hereinafter set forth in the following sections of thi
ordinance which is chargeable to the private property in the assessment districts for each of
such improvements, respectively, as set forth in the following sections of this ordinance
with respect to each of such improvements, there is hereby levied and assessed on the property
liable therefore, being all the lots and pieces of land lying on either side of said street sb
improved, respectively, to the middle of the block for the distance improved with respect to
the improvements mentioned in Sections 2, 3, 4, 51 6, 7, 8, 9, 10, U, 12, 13, and 14 of thisl'
ordinance, according to the appraised value of such lots and pieces of ground with respect tol
each such improvements, without regard to the buildings or improvements thereon, special
assessments covering the cost of such work and improvements, said special assessments being
based on the special valuation and appraisement of said lots and pieces of ground therefore
made by three disinterested appraisers appointed by the Board of Commissioners of the City oft

Salina, Kansas, with respect to each such improvement which said appraisements are hereby

referred to and made a part of this ordinance, and the several amounts so levied, apportioned
and assessed against the lots and pieces of round for each such improvement, mprovement, respectively,
for the purpose aforesaid, are hereby found and determined to be the amounts set forth in the
following sections of this ordinance with respect to each of said improvements.

Section 14. For that part of the cost of paving and grading Pershing Street (t*enty-
eight (28) feet wide from toe of gutter to toe of gutter) with two (2) inch hot asphalt mix
over a six (6) inch crushed rock base, from the north line of Jewell Avenue to the south 1
of Ellsworth Avenue,which is chargeable against the private property within the district
chargeable therefore, and which cost is hereby determined to be $1,688.62, there is hereby
levied, apportioned and assessed against the following described lots and pieces of land
as provided for in Section 1 of this ordinance, the following amounts;

Section 15. Said amounts so levied, apportioned and assessed as aforesaid will be due
and collectible in ten equal installments, the first becoming due with the taxes levied for
the year 1960, and one of said installments falling due each and every year thereafter until
all are paid and all to be collected with interest as in this ordinance provided, HOWEVER,
that the owner of any piece of property liable for any such assessment may redeem his
property from such liability by paying to the City Treasury the entire amount chargeable
against the same, as in hhis ordinance provided, at any time laithin thirty days after the
publication of this ordinance and before the issuance of bonds of said City in payment of
balance of the cost of said improvements, the property so paid on shall not hereafter be
liable for any further assessments for the cost of said improvements nor for any part of
said bonds.
Section 16. There is hereby levied further and assessed against such lots and pieces
of ground described in this ordinance, interest at such rate per annum as shall be borne by
the bonds hereafter to be issued for the payment of the remaining unpaid cost of such
improvements, to be hereafter determined and fixed by ordinance when such bonds are issued
on all of said installments mentioned and provided for in this ordinance, from the date of
the bonds which may be issued at the end of thirty days as specified in the preceding sectioi
hereof, as by law provided, to the time of the collection of the installments as provided
by law, which said interest shall be collected annually at the same time and in the same
manner as said installments are collected and after the taking effect of this ordinance and
the fixing of said interest rate when such bonds are authorized and issued, it shall be the
duty of the City Clerk of said City to annually at the same time other taxes are certified
and until all said assessments so apportioned and levied have been certified to the County
Clerk of Saline County, Kansas, a full list of all property liable to assessment and
taxation for such work and improvement, except such property on which the special assessment!
aforesaid have been paid in full as hereinbefore providedp together with the respective
amounts due on each of said lots and pieces of ground which amounts shall include the annual

installments of such special assessments with the interest for one year at the rate to be
fixed as provided for in this ordinance, on all unpaid balances of said assessments, and
such amounts so certified as herein provided shall be placed upon the tax roll by the
County Clerk of Saline County, Kansas, and collected as other taxes are collected.
Section 17. This ordinance shall take effect and be in full force from and after its
adoption and publication once in the official city paper. ri
