ORDINANCE 6356

AN ORDINANCE ratifying and confirming a contract with the Brown and Brown Construction
Company for hhe construction of certain improvements on certain streets in the City of Salina)
Kansas, and providing for the issuance of temporary notes to pay the cost thereof pending the
issuance and sale of bonds.
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
Section 1. That the acceptance by the City of Salina, Kansas, of the proposal of the
Brown and Brown Construction Company, hereinafter referred to as the "Contractor" as submittdid
to the Board of Commissioners on July 21, 1959, which is hereby found to be the lowest and
best bid for such work, and the contract awarded by the Board of Commissioners of the City
to said contractor and signed on behalf of the City by its Mayor on July 28, 1959, for the
construction of certain public improvements in the City of Salina, Kansas, to -wit:
The paving with concrete, 28 feet wide, tort of gutter to
toe of gutter, Shawnee Avenue from the south line of Crawford
Avenue to the east line of Seminole Avenue.
The paving with concrete, 28 feet wide, toe of gutter to
toe of gutter, Seminole Avenue from the west line of Shawnee
Avenue to the north line of Republic Avenue.
The paving with concrete, 20 feet wide, toe of gutter to
toe of gutter, Mohawk Avenue from the south line of Lot 161
Block 6 of Sunset Manor Addition, to the north line of Republic Avenue.
The paving with concrete, 28 feet wide, toe of gutter to
toe of gutter, Franklin Avenue from the east line of Mohawk
to the west line of Shawnee.
at and for the unit price for said work contained in said proposal, which proposal and
contract are hereby referred to and made parts of this ordinance, be and the same is hereby
ratified and confirmed, said proposal being within the estimated cost of said improvements
as shown by the sworn estimates of the City Engineer on file in the office of the City Clerk,
which estimates are hereby referred to and made a part of this ordinance.
Section 2. Said improvements shall be built and constructed in accordance with the
and specifications therefore prepared by the City Engineer on file in the office of the City
Clerk and in accordance with the proposal of said contractor and under the terms of said
contract, all of which are hereby referred to and made a part of this ordinance.
Section 3. That temporary notes signed by the Mayor and attested by the City Clerk be
issued from time to time as the work progresses in the manner and form as required by law,
the total amount thereof not to exceed the amount of $88,796.40 for such world, such notes
to bear interest not to exceed 5 per cent per annum and to mature not later than December 1,
1960, ant to be issued in such amounts and at such times as money for the payment of the cost
of such notes being issued to said contractor and to be redeemed and cancelled at the time
that permanent bonds are issued in lieu thereof.
