AN ORDINANCE ratifying and confirminga contract with the
Brown and Brown Construction
Company for the construction of certain curbing, guttering, paving and grading improvements
on certain streets in the City of Salina, Kansas, and providing for the issuance of Temporary
notes to pay the cost thereof pending tiw issuance and sale of bonds.
BE IT ORDAINED by the Board of Commissioners of the City of Salina,Kansas:
Section 1. That the acceptance by the City of Salina, Kansas, of the proposal of the
Brown and Brown Construction Company, hereinafter referred to as the "Contractor" as submitted
to the Board of Cosmmissioners on May 19, 1959, which is hereby found to be the lowest and

best bid for such work, and the contract awarded by theBoard of Commissioners Of the City
of Salina to said Contractor and signed on behalf of the City by its Mayor on May 26, 1959,
for the construction of certain public improvements in the City of Salina, Kansas, to -wit:
Curbing, guttering, paving and grading of Clark Street
(Thirty-three (33) feet wide from back of curb to back
Of curb) with two (2) inch hot asphalt mix over a six
(6) inch crushed rock base, from the north line of
Armory Road to a point 136.5 feet north of the north
line of South Street, as provided for by Resolution
Number 2120 and Ordinance Number 6326.
Paving and grading of Franklin Street (Twenty-eight (28)

feet wide from toe of gutter to toe of gutter) with two
(2) inch hot asphalt mix over a six (6) inch crushed
rock base, from the east side of Custer Street to the
west line of Sheridan Street, as provided for by Resolution
Number 2111 and Ordinance Number 6326.
Paving and grading of Fifth Street with two (2) inch hot
asphalt mix over a six7T6f incZcrrushed rock base, from
the north line of Harsh Avenue to the south line of Euclid
Avenue, as provided for by Resolution Number 2125 and
Ordinance Number 6326.
Curbing, guttering, paving and grading of Max Avenue with two
(2) inch hot asphalt mix over a six (6) inch crushed rock
base, from the east line of Quincy Street to the west line
of Norton Avenue, as provided for by Resolution Number
2129
and Ordinance Numier 6326.
Curbing, guttering, paving and grading of Quincy Street (Thirty-
three
33) feet wide from back of curb to back of curb with
two (2) inch hot asphalt mix over a six (6) inch crushed rock
base, from the south line of Leslie Avenue to the north line
of Wayne, as provided for by Resolution Number 2127 and
Ordinance Number 6326.
at and for the unit price for said work contained in said proposal, which proposal and
contract are hereby referred to and made parts of this ordinance, be and the same are hereby
ratified and confirmed, said proposal being within the estimated cost of said improvements
as shown by the sworn estimates of the City Engineer on file in the office of the City Clerk,i,
which estimates are hereby referred to and made a part of this ordinance.

Section 2. Said improvements shall be built and constructed in accordance with the plans
and specifications therefore prepared by the City Engineer on file in the office of the City
Clerk and in accordance with the proposal of said contractor and under the terms of said
contract, all of which are hereby referred to and made a part of this ordinance.
Section 3. That temporary notes signed by the Mayor and attested by the City Clerk be
issued from time to time as the work progresses in the manner and form as required by law,
the total amount thereof not to exceed the amount of $102,536.50, for such work, such notes
to bear interest not to exceed5 per cent per annum and to nature not later than Decenber l,,

1960, and to be issued in such amounts and at such times as money for the payment of the cost
of such notes being issued to said contractor and to be redeemed and canc#lled at the time
that permanent bonds are issued in lieu thereof.
Section 4. This ordinance shall take effect and be in force from and after its adoption

and publication once in the ofticial city Paper.
