6320 Utility ImprovementsAN ORDINANCE creating and defining certain main and lateral sanitary sever districts in the
City of Salina, Kansas, designated as Main Sanitary Sever "AI" and Dain Sanitary Sewer "Ad"
and Lateral Sanitary Sever Districts 390, 391, and 392, and providing for the construction
of a Main Sanitary Sever District "AI" and Main Sanitary Sever District "AJ" and Lateral
Sanitary Sever Districts Numbeni 390, 391, and 392, so created, and providing for the
payment of the cost thereof and for the levying of special assessments against the property
in said districts for the payment of the cost of such construction and for the issuing of
bonds to pay the cost thereof.
BE IT ORDAIM by the Board of Commissioners of the City of Salina, Kansas:
Section 1. Main Sanitary Sewer District Number "AI". That there be and there is
hereby created a main sanitary sewer district in the City of Salina, Kansas, which shall

be and, it is hereby designated as Main Sanitary Sewer "AI" and which district shall include

all the fo4oving described property in the City of Salina, Kansas, to -wit:
Benefit District:
(1) Beginning at the intersection of the center lines of Roach
Street and Wayne Avenue
(2) thence east along the center line of Wayne to the center line
of Ohio Street;
(3) Thence North along the center line of Ohio Street 200 feet;
(4) thence west along a line 170 feet north of the north line of
Wayne Avenue to a point 200 feet east of the center line of
Roach Street
(5) thence north along a line 200 feet east of the center line of
Roach Street to a point 200 feet south of the center line of
Cloud Avenue
(6) thence east along a line 200 feet south of the center line of
Cloud Street to a point 250 feet east of the center line of
Ohio Street
(7) thence south along a line 250 feet east of the center line of
Ohio Street to a point 188 feet south of the south line of
Oxford Drive
(8) thence west to the west line of Lot 10, Block 9, of Belmont Addition
(9) thence northwesterly along the center line of easement of said
Block to the south line of Lot 19, Block 9
(10) thence southwesterly along south line of Lot 19, Block 9, and
south line of Lot 7, Block 10, to the center line of easement;
(11) thence southeasterly along said easement to the southeast corner
of Lot 23, Block 10,
(12) thence southwesterly along the south line of Lot 23 to the

(14) thence southwesterly crossing Pearl Street and following the
south line of Lot 41 Block ll, to the easement line through

(16) thence southwest along the south line of said Lot 13, Block 11
to the center line of Roach Street;

Section 2. It is necessary and it is hereby ordered that an eight inch cast iron pipe
Main Sanitary Sewer with all necessary connections, manholes, flushing tanks and other
appurtenances be constructed and built in and to serve said Main Sanitary Sewer District
Humber "AI", as created by Section 1 of this ordinance along the following course, to -wit:
An eight inch cast iron pipe sewer beginning at an existing manhole
at the intersection of Cloud and Ohio; thence south along the center
line of Ohio Street 1370 feet to a pumping station to be constructed
j at a location 10 feet south of the south line of Albert Avenue and
on the center line of Ohio Street; thence south with a 10 inch clay
pipe sewer 1275 feet to a manhole to be constructed in the intersection
of Ohio, Wayne and Belmont Boulevard; thence in a southwesterly direction
following a line 8 feet north of the south line of Belmont Boulevard to
a point 5 feet east of the west line of Roach Street where a manhole
will be constructed which will be the terminus of Main Sewer "AI".
Section 3. Main Sanitary Sewer District Number "AJ". That there be and there is hereby
j created a main sanitary sewer district in the City of Salina, Kansas, which shall be and it
is hereby designated as Main Sanitary Sewer "AJ" and which district shall include all the

following described property in the City of Salina, Kansas, to -wit:
Benefit District:
Blocks 4., 5, 61 and 7 of Holiday Addition, City of Salina, Kansas.
Section 4. It is necessary and it is hereby ordered that an eight inch clay pipe rain
Sanitary Sewer with all necessary connections, manholes, flushing tanks and other appurtenances
be constructed and built in and to serve said rain Sanitary Sewer District Number "AJ", as

created by Section 3 of this ordinance along the following course, to -wit:
(1) An eight inch clay pipe sever beginning at a manhole to be
constructed over 8 inch line in University Place and first
alley east of Broadway Boulevard.
(2) thence south in said alley crossing Walnut Street and going
in easement between Lots 29 and 30 of Block 4 of Holiday Addition;
(3) thence east to the northeast corner of Lot 28, of Block 4,
Holiday Addition;
(4) thence south along easement of Block 4, Holiday Addition to
a point 10 feet north of South Street where a manhole will be built.

(5) Beginning at a manhole in the south parking of Walnut Street
and on first alley flus east of Broadway Boulevard.
(6) thence east along the said south parking to a point just north
j of the east line of Lot 4, Block 7 of Holiday Addition;
(7) thence south along said easement through Blocks 7, 6, and 5
to a point 10 feet north of the north line of South Street where
a manhole will be built which will be terminus of Main Sewer "AJ".
Section 5. Lateral Sanitary Sewer District Number 390. That there be and there is
hereby created Lateral Sanitary Sewer District in the City of Salina, Kansas, which shall
be and it is hereby designated as Lateral Sanitary Sewer District Dumber 390 and which
district shall include all the following described property in the City of Salina, Kansas,
to -wit:
Benefit District:
All of Block 49, Military Addition, City of Salina, Saline
County, Kansas.
Section 6. It is necessary and it is hereby ordered that an eight inch V. Co P. Lateral
Sanitary Sewer with all necessary connections, manholes, flushing tanks and other appurtenances
be constructed and built in and to serve said Lateral Sanitary Sewer District Number 390
as created by Section 5 of this ordinance along the following course, to -wit:
An eight inch clay pipe sewer beginning at an existing manhole in
Hamilton Avenue and on center line extended of alley first east of
Twelfth Street; thence north in said alley 445.0 feet where a manhole
will be constructed which will be terminus of Lateral 390.
j Section 7. Lateral Sanitary Sewer District Number 391. That there be and there is
hereby created Lateral Sanitary Sewer District in the City of Salina, Kansas, which shall be'
and it is hereby designated as Lateral Sanitary Sewer District Number 391 and which district
shall include all the following described property in the City of Salina, Kansas, to -wit:
Benefit District:
Lots 4, 5, 6, 7, 8 of Block 5
Lots 4, 5, 6, 7, 8 of Block 6
All in Walnut Grove Addition
Section 8_. It is necessary and it is hereby ordered that an eight inch V. C. P. Lateral'
Sanitary Sewer with all necessary connections, manholes, flushing tanks and other appurtenances

be constructed and built in and to serve said Lateral Sanitary Sewer District Number 391 as
created by Section 7 of this ordinance along the following course, to -wit:
(1) An eight inch clay pipe sewer beginning at an existing
line 20 feet north of the south line of Spruce Street
and on line with the back line of Lot 7, Block 5.
(2) thence east along a line 20 feet north of the south line
of Spruce Street to the center line of Clark Street;
(3) thence south along the center line of Clark Street to a
point 10 feet south of the north line of Lot 8, Block 6,
Walnut Grove Addition.
Section 9. Lateral Sanitary Sewer District'Number 392. That there be and there is

hereby created Lateral Sanitary Sewer District in the City of Salina, Kansas, which shall be
and it is hereby designated as Lateral Sanitary Sewer District Number 392, and which district
shall include all the following described property in the City of Salina, Kansas, to -wit:
Benefit District:
All of Moose Addition, City of Salina, Saline County, Kansas.
Section 10. It is necessary and it is hereby ordered that an eight inch V. C. P.
Lateral Sanitary Sewer with all necessary connections, manholes, flushing tanks and other
appurtenances be constructed and built in and to serve said Lateral Sanitary Sewer District
Number 392 as created by Section 9 of this ordinance along the following course, to -wit -
(1) An eight inch clay pipe sewer beginning at an existing
manhole in Crawford Avenue on the extention of the west
side of Eisenhower Addition;
! (2) thence north 635 feet to the center line of easement on
the south line of Lot 9, Block 1 of Moose Addition;
(3) thence west to a point 20 feet west of the east line of
Rocket Avenue;

(4) thence north to center line of Beverly Drive;
(5) beginning at a point of existing manhole 20 feet east of
Rocket Avenue and 5 feet north of the south line of Lot 9,
Block 11 Moose Addition;
(6) thence west 290 feet to a point 20 feet west of the east
line of Jamson Avenue;
(7) thence north to the center line of Beverly Avenue where
a manhole will be constructed, which will be terminus of
Lateral Sanitary Sewer 392•
Section 11. That the City Engineer shall on or before May 5th. 1959 , pr'epam
and file in the office of the City Clerk, plans and specifications for the construction of
the Sanitary Sewers provided for in the preceding sections of this ordinance which shall be
of the proper character to serve the property lying within the distridt which such sewer is
to be constructed and shall on or before the same date prepare and submit to the Board of

Commissioners a detailed estimate under oath of the cost thereof. That thereafter the City
Clerk shall advertise for three consecutive days in the official city paper for sealed
proposals for the building and construction of such sewer according to such plans and
specifications, which proposals shall be filed with the City Clerk on or before the time
fixed in such notice, at which time the Board of Commissioners may let a contract for the
building and construction of such sewers to the loftst and best responsible bidder of bidders
therefore, if there be and whose bids do not exceed the estimated cost thereof, but said Board
shall reserve the right to reject any or all such prpposals, and if no bids shall be received
within such estimate, the Board of Commissioners shall have the power to do such work and
make such improvements within the estimated cost thereof as provided by law.
Section 12. That for the cost of building and constructing such sewer, special
assessments shall be made for the full cost thereof on all lots and pieces of land within a%d
for which such sewer shall be built, accordint to the appraised value thereof, without regard
to the buildings or improvements thereon.
Section 13. After the passage and publication of this ordinance, the Board of Commissioners
shall appoint three disinterested appraisers, who after having taken an oath to make a true and
impartial appraisement of all lots and pieces of land liable to taxation for the cost of such
improvements, shall within five days after having been notified of their appointments proceed
to appraise all of the lots and pieces of land within the district liable to assessment and
taxation as aforesaid, without regard to the buildings or improvements thereon, and after
making such appraisements, shall return to the Board of Commissioners of the City and said
Board shall designate a time for a special meeting of said Board for the purpose of hearing
any complaints that may be made as to the value of any lot or piece of land appraised as
aforesaid, of which special session due notice shall be given in the official city paper, at
which special session said Board may alter any valuation of any lot or piece of land, if, in
their opinion, the same has been appraised too high or too low.

Section 14. The special assessment herein provided for may be paid by the person liable
therefore in ten approximately equal annual installments but the owner of any property liable
to such assessment may within thirty days from the date of determining the amount assessed against
the property, pay the same in full and his property shall not be liable for any assessments
for the cost of such improvements, and bonds as hereinafter provided for shall be issued in
the amount of the cost of such improvements remaining unpaid at the end of the thirty days
from the time such assessment is fixed.
Section 15. For the purpose of paying for the work and improvements in this ordinance
prolided for, the Board of Commissioners may and are hereby authorized and directed to issue
improvement bonds of the City of Salina, Kansas, in an amount not to exceed the total cost
of such improvement, and to run for a period of ten years and be payable in ten approximately
equal annual installments, together with interest not to exceed five per cent per annum,
which bonds shall be issued and payable according to law; and for the purpose of paying the priac

principal and interest of said bonds as they severally become due and payable the Board of
Commissioners shall apportion and assess against the lots and pieces of land within the
taxingdistrict of such
improvements, special assessments covering the cost of such improvement
I
and apportionment therein contained shall hold good for all of the installments that are to
j be collected from the specific property chargeable therefore,.add with such improvements,
j such assessment and apportionment ordinance shall contain the total amount of tax apportioned
I i
to each tract, piece or parcel of land within the taxing district and shall state the number'
of annual installments in which such tax is to be pollected; and thereafter the City Clerk
shall annually., at the sa;r time that other taxes are certified, certify to the County Clerk
of Saline County, Kansas, a full list of all property liable for such work and improvement,
together with the respective amounts due on each of said tracts, pieces or parcels of land,
which amounts shall include the annual installment and interest on all unpaid balances for
one year at the rate of not to exceed five per cent per annum on such amounts so certified,

which amounts shall be collected as other taxes are collected.
Section 16. This ordinance shall take effect and be in full force from and after its
adoption and publication once in the official city paper.
