AN ORDINANCE ratifying and confirming a contract with 0. D. Wilmoth doing business as Wilmoth
Construction Company for the construction of Worsley Addition and Euclid Avenue Storm Sewers
in the City of Salina, Kansas heretofore designated as Worsley Addition and Euclid Avenue
Storm Sewers, and providing for the issuance of temporary notes to pay the cost thereof,
pending the issuance and sale of bonds.
BE IT ORDAINED by the Board of Comissioners of the City of Salina, Kansas:
Section 1. That the acceptance of the City of Salina, Kansas, of the proposal of the
Wilmoth Construction Company, hereinafter referred to as the "Contractor" as submitted to
the Board of Commissioners on April 14, 1959, which is hereby found to be the lowest and
best bid for such work, and the contract awarded by the Board of Commissioners of said City
to said contractor and signed on behalf of the City by its Mayor on April 21, 1959, for the
construction of certain public improvements in the City of Salina, Kansas, to -wit:
Beginning at an existing storm sewer manhole at the intersection
of Talley Drive and Haskett Avenue, thence north with a 36 inch
storm sewer to a point 10 feet south of the center line of Garden
Avenue where a manhole will be built, thence east with a 36 inch
storm sewer on a line 10 feet south of the center line of Garden
Avenue to a point 10 feet east of the center line of Hageman
Avenue where a manhole will be built, thence north with a 30 inch
storm sewer on a line 10 feet east of the center line of Hageman
Avenue to a point 10 feet east of the center line of Hageman
Avenue and in the center of Willis Avenue, where a manhole will
be built$ !hence beginning at the manhole in the intersection
of Garden Avenue and Hageman Avenue, thence south with a 21 inch
storm sewer on a line 10 feet east of the center line of Hageman
to a point 10 feet south of the center line of Purdue Avenue,
thence continue south with an 18 inch storm sewer to a point to
feet south of the center line of Yale Avenue where a manhole will
be built, thence east with a 15 inch storm sewer on a line 10 feet
south of the center line of Yale Avenue to a point 10 feet west of
the center line of Tulane Avenue where a manhole will be built.
Beginning at a manhole in the intersection of Garden Avenue and
Hageman Avenue thence east with an 18 inch storm sewer along a line
10 feet south of the center line of Garden Avenue to a point 10
feet west of the center line of Maple Avenue where a manhole will
be built, thence south with an 18 inch storm sewer along a line
10 feet west of the center line of Maple Avenue 335 feet where a
manhole will be built.
Beginning at a manhole at the intersection of Hageman Avenue and
Tuland Avenue, thence east with an 18 inch storm sewer along a
line 10 feet south of the center line of Tuland Avenue386 feet
where a manhole will be built.
Beginning at a manhole at the intersection of Hageman Avenue and
Purdue Avenue, thence east with an 18 inch storm sewer along a
line 10 feet south of the center line of Purdue 270 feet where a
manhole will be built which will be the terminus of the Worsley
Addition Storm Sewer.
A 36 inch pipe sewer beginning at an existing manhole in the
intersection of Ninth Street and Euclid Avenue; thence west
along a line 20 feet from the north line of said Avenue 840
feet more or less to the bank of Dry Creek where an outlet
structure will be constructed which will be the terminus of Euclid
Avenue Storm Sewer.

at and for the unit price for said work contained in said proposal, which proposal and
contract are hereby referred to and made a part of this ordinance, be and the same is
hereby ratified and confirmed, said proposal being within the estimated cost of said
improvements as shown by the sworn estimates of the City Engineer on file in the office of
the City Clerk which estimate is hereby referred to and made a part of this ordinance.
Section 2. Said improvements shall be built and constructed in accordance with the
plans and specifications therefore prepared by the City Engineer on file in the office of
the City Clerk and in accordance with the proposals of said contractor and under the terms
of said contract, all of which are hereby referred to and made a part of this ordinance.
Section 3. That temporary notes signed by the Mayor and attest by the City Clerk be
issued from time to time as the work progresses in the manner and form as required by law,
the total amount thereof not to exceed the amount of $48,olo.60 for such work, such notes
to bear interest at not to exceed 5 per cent per annum and to mature not later than December
1, 1960, and to be issued in such amounts and at such times as may the money for the
Payment of the cost of such work be required, such notes to be issued to said contractor and
to be redeemed and cancelled at the time that Internal Improvement Bonds are issued in lieu
thereof.
Section 4. That this ordinance shall take effect and be in full force from and after
its publication once in the official city paper.
