ORDINANCE NO. 6459

AN ORDINANCE condemning certain land within the City of Salina,
Kansas, for the use of said City in the widening and extending of
Page Avenue from the south line of Talley Drive to the north line
of Andrew Avenue; Beverly Drive from the west line of Broadway
Boulevard to a point One Hundred Fifty Six (156) feet west; Haskett
Avenue from the south line of Talley Drive south One Hundred Sixty
Four (164) feet; and Albert Avenue from the east line of Ohio Street
to the center line of the Smoky Hill River; fixing a benefit district
therefor; and providing for the payment of the cost thereof.
WHEREAS, the governing body of the City of Salina, Kansas, on
the 3 day of May, 1960, found it necessary to appropriate certain
private property located in the City of Salina, Kansas, for the use
of said city in the widening and extending of Park Avenue from the
south line of Talley Drive to the north line of Andrew Avenue;
Beverly Drive from the west line of Broadway Boulevard to a point
One Hundred Fifty Six (156) feet west; Haskett Avenue from the south
line of Talley Drive south One Hundred Sixty Four (164) feet; and
Albert Avenue from the east line of Ohio Street to the center line
of the Smoky Hill River, and directed the City Rngineerof the City
of Salina, Kansas, to make a survey and description of the lands so
acquired; and
WHEREAS, on the 10 day of May, 1960, a survey and description
of the lands so acquired was filed with the City Clerk;
SO, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS
OF THE CITY OF SALINA, KANSAS:
Section 1. Tract A. The following described land was hereby
condemned and appropriated for the use of the City of Salina, Kansas,
for the widening and extending of Page Avenue from the south line of
Talley Drive to the north line of Andrew Avenue, described as follows:
1. Beginning at the northeast corner of Lot One (1),
Block Two (2), Ingermans on Heights, 2nd Addition,

2. thence east 64.5 feet to the east line of Page
Avenue extended,
3. thence south to the northwest corner of Lot One (1),
Block Six (6), Ingermans on 2nd Addition,
4. thence west 64.5 feet to the east line of Lot Twenty
(20) of said Block Two (2),
5. thence north along the east line of said Lot Twenty
(20) and Lot One (1) of said Block Two (2), to the place of
beginning.
Tract B. Beverly Drive from the west line of Broadway
Boulevard to a point One Hundred Fifty Six (156) feet west, described
as follows:
1. Beginning at a point 1241.7 feet north of a point
where the west line of Broadway Boulevard intersects the south
line of said Section,
2. thence west and parallel with the south line of said
Section 156.0 feet,
3. thence north 30.0 feet,
4. thence east and parallel to the south line of said
Section 156.0 feet,
5. thence south 30.0 feet to the point of beginning.
Tract C. Haskett Avenue from the south line of Talley
Drive south One Hundred Sixty Four (164) feet, described as follows:
1. Beginning 30 feet south of the center line of Talley
Drive and on the center of Haskett Avenue,
2. thence south 164 feet,
3. thence west 30 feet,
4. thence north along a line which is the extension of
the west line of Haskett Avenue 164 feet,
5. thence east 30 feet to the place of beginning.
Tract D. Albert Avenue from the east line of Ohio Street
to the center line of the Smoky Hill River, described as follows:
1. Beginning at a point 50 feet east of the center
line of Ohio Street and on the center line of Albert Avenue
extended from the west,

Section 2. It is found that the following described real
property within the City limits of the City of Salina, kansas,
will be specifically benefitted by the reason of the acquisition
of said land, and the same shall be known as the benefit districts,
to -wit:
BENEFIT DISTRICTS
A. West Side
(1Beginning at a point on the south line of
Talley Drive and 29.75 feet west of the northeast corner of
Lot 6, Block Two, Ingermanson 2nd Addition,
(2) thence east along the south line of Talley
Drive to the northeast corner of Lot 1 of said Block,
(3) thence south 164 feet,
(4) thence west to a point 37.85 feet west of the
east line of Lot 16 of said Block 21
(5) thence north to the south line of Lot 5 of said
Block 2,
(6) thence west 29.75 feet,
(7) thence north 110 feet to the point of beginning.
East tSSide-
(1) Beginning at a point on the south line of Talley
Drive and the east line of Page Avenue extended,
(2) thence east 120 feet,
(3) thence south 164 feet,
(4) thence west 120 feet
(5) thence north 164 feet to point of beginning.
B. (1) Beginning at a point on the west line of U.S.
Highway 81 By Pass and the north line of Beverly Drive extended,
(2) thence north along the west line of U.S. Highway
81 By Pass 300 feet,
(3) thence west 156 feet,
(4) thence south 300 feet,
(5) thence east 156 feet to the point of beginning
C. (1) Beginning at a point on the south line of Talley
Drive and the west line of Haskett Avenue extended,
(2) thence south 164 feet,
(3) thence west 122.68 feet,
(4) thence north 164 feet,
(5) thence east along the south line of Talley Drive
122.68 feet to the point of beginning.

D. (1) Beginning at a point on the east line of Ohio
Street and the north line of Albert Avenue extended,
(2) thence north along the east line of Ohio Street
300 feet,
(3) thence east to the thread of the channel of the
Smoky Hill River,
(4) thence in a southwesterly direction along the
thread of the channel of the Smoky Hill River to the north
line of Albert Avenue,
(5) thence west along the north line of Albert
Avenue extended 640 feet to the point of beginning.
Section 3. That Rudolph Barta, City Attorney, is hereby
ordered to forthwith prepare and present in the name of the Board
of Commissioners of the City of Salina, Kansas, a written application
to the Judge of the District Court of Saline County, Kansas, praying
for an order of appointment of commissioners to make appraisement
and assessment of damages arising from the appropriation of said
real estate described in Section 1 hereof and do and perform all

Section 4. That for the payment of the cost thereof, the Board
of Commissioners shall issue Improvement Bonds of the City of Salina,
Kansas, in an amount not to exceed the total cost of acquiring said
land herein condemned, except as herein provided, to be payable in
ten (10) approximately equal annual installments to bear interest at
not to exceed five per cent per annum from the date of such bonds and
for the purpose of paying such bonds and interest As they severally
mature, the Board of Commissioners shall:
Number 1. Apportion and assess the lots and pieces of
groud within the benefit districts, special assessments cover-
ing such portions of the cost of such land so acquired as shall
be chargeable to said benefit district, such assessment and
apportionment ordinance shall contain the total amount of tax
apportioned to such tract, piece or parcel of land within such
taxing districts and shall state the number of annual installments
in which such rax is to be collected; and thereafter the City Clerk
shall annually, at the same time that other taxes are certified,
certify to the County Clerk of Saline County, Kansas, a full list
of all property liable for such work and improvements, together
with the respective numbered amounts due on each of said tracts,
pieces or parcels of land, which amounts shall include the annual
installments and interest on all unpaid balances for one year at
the rate of not to exceed five per cent per annum, on such amounts
so certified, which shall be collected as other taxes are collected.
Number 2. Annually levy a tax upon all real and personal
property in the City of Salina, Kansas, in an amount sufficient
to pay the annual installment of principal and interest on that
portion of the cost of such land so acquired as shall be
chargeable to the city at large; and providing the issue
of such bonds, temporary notes shalt be issued according
to law, to pay the cost of acquiring such land.
Section 5. This ordinance shall take effect and be in force
from and after its publication once in the official city paper.
