AN ORDINANCE relating to and apportioning and levying special assessments on certain lots
and pieces of ground in the City of Salina,[ansas, to pay the cost of curbing, guttering,
- paving and grading Albert Avenue with concrete (Thirty-three (33) feet wide from back of
curb to bac k of curb) from the east line of Roach Street to the west line of Ohio Street;
curbing, guttering, paving and grading of Beverly Drive with concrete (Thirty-three (33)
feet wide from back of curb to back of curb) from the west line of Duvall Avenue to the
center line of Broadway Boulevard; curbing, guttering, paving and grading of Elm Street
with concrete (Thirty-three (33) feet wide from back of curb to back of curb) from the
west line of College Street to the west line of Chicago Street; curbing, guttering, and
grading of Elmore Drive fromtthe north line of Crawford Avenue to the south line of Prescott
Road; curbing, guttering, paving and grading fourth Street with concrete (Thirty-three (33)
feet wide from back of curb to back of curb) from the south line of Leslie Avenue to the
north line of Wayne Avenue; paving and grading of Jewell Avenue with concrete (Thirty-three

line of Ruskin Road; paving and grading of M[arrietta Avenue with concrete (Twenty-eight
(28) feet wide from toe of gutter to toe of gutter) from the west line of Chicago Street
to the center line of Broadway Boulevard; curbing, guttering, paving and grading of North
Street with concrete (Thirty-seven (37) feet wide from back of curb to back of curb) from
the east line of Missouri Pacific Railroad Tracks to the west line of Ohio Street; curbing,
guttering, paving and grading of Ohio Street with concrete (forty (40) feet wide from back
of curb to back of curb) from the south line of Stack Avenue to the south line of Greeley
Avenue; paving and grading Lower Oakdale Drive with concrete (Thirty-six (36) feet wide
from edge to edge) from the south line of Mulberry Street to Upper Oakdale Drive; curbing,
guttering, paving and grading Roach Street with concrete (Thirty-three (33) feet wide from
back of curb to back of curb) from the south line of Albert Avenue to the north line of
Wayne Avenue; paving and grading of Stack Avenue with concrete (Twenty-eight (28) feet
wide from toe of gutter to toe of rom the east line of Ohio Street to the west
line of Connecticut Avenue; curbing, guttering, paving and grading of Second Street with
concrete (Thirty-three (33) feet wide from back of curb to back of curb) from the north
line of North Street to the south line of Railroad Street; curbing, guttering, paving and g
of North Third Street with concrete (Thirty-three (33) feet wide from back of curb to back
of curb) from the north line of Iron Avenue to bank of Smoky Sill River; curbing, guttering
paving and grading Wayne Avenue with concrete (Thirty-three (33) feet wide from back of cur
to back of curb) from the west line of highland Avenue to the east right-of-way line of the
Union Pacific Railroad; paving and grading of Beloit Avenue with concrete (Twenty-eight (28
feet wide from toe of gutter to toe of gutter) from the west line of Lewis Avenue to the
west line of Ohio Street; curbing, guttering, paving and grading of Hamilton Street with
concrete (Thirty-three (33) feet wide from back of curb to back of curb) from the west line
of Eleventh Street to the east line of Twelfth Street; and relating to and providing for th
collection and payment of such assessments.
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
Section 1. For the purpose of paying for that part of the oost of improvements in
certain portions of certain streets as hereinafter not forth in the following sections of
this ordinance, which is chargeable to the private property in the s►asessment districts for
each of such improvements, respectively, as set forth in the following sections of this ordii
with respect to each of such improvements, there is hereby levied and assessed on the propert
liable therefore, being all the lots and pieces of land lying on eigher side of said streetei
improved, respectively, to the middle of the block for the distance improved with respect to
the improvements mentioned in Sections 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, 15, 16,
17, 18, and 19 of this ordinance, according to the appraised value of such lots and pieces
of ground with respect to each such improvements, without regard to the buildings or
thereon, special assessments covering the cost of such work and improvements, said sp,

assessments being based on the special valuation and appraisement of said lots and pieces
of ground therefore made by three disinterested appraisers appointed by the Board of
Commissioners of the City of Salina, Kansas, with respect to each such improvement which
said appraisements are hereby referred to and made a part of this ordinance, and the
sevenal amounts so levied, apportioned and assessed against the lots and pieces of ground
for each such improvement, respectively, for the purpose aforesaid, are hereby found and
determined to be the amounts set forth in the following sections of this ordinance with
respect to each of said i"rovements.
Section 2. For that part of the cost of curbing, guttering, paving and grading Albert
Avenge with concrete (Thirty-three (33) feet wide from back,of curb to back of curb) from

the private property within the district chargeable therefore, and which cost is hereby
determined to be $16,655.93, there is hereby levied, apportioned and assessed against the

Section 20. Said amounts so levied, apportioned and assessed as aforesaid will be due
and collectible in ten equal installments, the first becoming due with the taxes levied for 1,
the year 1960, and one of said installments falling dee each and every year thereafter until
all are paid and all to be collected with interest as in this ordinance provided, HOWEVER,
that the owner of any piece of property liable for any such assessment may redeem his property

from such liability by paying to the City Treasury the entire amount chargeable against the
I
same, as in this ordinance provided, at any time within thirty days after the publication ofl
this ordinance and before the issuance of bonds of said City in payment of the balance of tho
I
cost of said improvements, the property so paid on shall not hereafter be liable for any
further assessments for the cost of such improvements nor for any part of said bonds.
Section 21. There is hereby levied further and assessed against such lots and pieces
ground described in this ordinance, interest at such rate per annum as shall be borne by
the bonds hereafter to be issued for the payment of the remaining unpaid cost of such
improvements, to be hereafter determined and fixed by ordinance, from the date of the bonds
which may be issued at the end of thirty days as specified in the preceding sections hereof,
as by law provided, to the time of the collection of the installments as provided by law,
which said interest shall be collected annually at the same time and in the same manner as
said installments are collected and after the taking effect of this ordinance and the fixing
of said interest rate when such bonds are authorised and issued, it shall be the duty of
the City Clerk of said City to annually at the same time other taxes are certified and until
all said assessments so apportioned and levied have been certified to the County Clerk of
Saline County, Kansas, a full list of all property liable to assessment and taxation for suc
work and improvement, except such property on which the special assessments aforesaid have
been paid in full as hereinbefore provided, together with the respective amounts due on each
of said lots and pieces of ground which amounts shall include the annual installments of sue'
special assessments with the interest for one year at the rate to be fixed as provided for i
this ordinance, on all unpaid balances of said assessments, and such amounts so certified as
herein provided shall be placed upon the tax roll by the County Clerk of Saline County,
Kansas, and collected as other taxes are collected.
Section 22. This ordinance shall take effect and be in full force from and after its
adoption and publication once in the official city paper.
