AN ORDINANCE creating and defining certain lateral sanitary sewer districts in the City of
Salina, Kansas, designated as Lateral Sanitary Sewer Districts Numbered 423, 424, and 425,
and providing for the construction of a lateral sanitary sewer in said Lateral Sanitary
Sewer Districts Numbered 423, 424, and 425, so created and providing for the payment of the
cost thereof and for the levying of special assessments against the property in said
district for the payment of the cost of such construction and for the issuing of bonds to pay the
cost thereof.
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
Section 1. Lateral Sanitary Sewer District Number 423. That there be and there is
hereby created Lateral Sanitary Sewer District in the City of Salina, Kansas, which shall
and it is hereby designated as Lateral Sanitary Sewer District Number 423, and which distric
shall include all the following described property in the City of Salina, Kansas, to -wit:
Benefit District:
All lots in Blocks 2 and 11, Riker Manor Addition to the
City of Salina, Kansas.
Section 2. It is necessary and it is hereby ordered that an eight inch V. C. P. Latera
Sanitary Sewer with ail necessary connections, manholes, flushing tanks and other
appurtenances be constructed and built in and to serve said Lateral Sanitary Sewer District
Number 423 as created by Section 1 of this ordinance along the following course, to -wit:
An eight inch Clay pipe sewer beginning at an existing nanhdle
which is 10 feet south of the canter line of Greeley Avenue
and in line with utility easement first west of Beachwood Road,
thence east along a line 10 feet south of the center line of
Greeley Avenue to the easement first sash of Beachwood Road,
thence south along the center line of said utility easement
to a point 80 feet north of the north line of Brookwood Lane
where a manhole will be built which will be terminus of
Lateral 423.
Section 3. Lateral Sanitary Sewer District Number 424. That there be and there is
hereby created Lateral Sanitary Sewer District in the City of Salina, Kansas, which shall be
and it is hereby designated as Lateral Sanitary Sewer District Number 424, and which distric
shall include all the following described property in the City of Salina, Kansas, toMwit
Benefit District:
Lots 1 through 9, and Lots 13 through 19, Block 9,
Belmont Addition.
Section 4. It is necessary and it is hereby ordered that an eight inch V. C. T.
Lateral Sanitary Sewer with all necessary connections, manholes, flushing talks and other
appurtenances be constructed and built in and to serve said Lateral Sanitary Sewer District
Number 424 as created by Section 3 of this ordinance along the following course, to -wit:
An eight inch clay pipe sewer beginning at an existing
manhole which is in line with the utility easement
through Block 9,and 10 feet north of the south line of
of Belmont Boulevard thence south along the center line
of easrat through Block 9, to a point 10 feet southwest
of the northwest corner of Lot 9, Block 9, Belmont Addition
to the City of Salina, Kansas.
Section 5. Lateral Sanitary Sewer District Number 425. That there be and there is
created Lateral Sanitary Sewer District in the City of Salina, Kansas, which shall be and it

is hereby designated as Lateral Sanitary Sewer District Number 425, and which district
shall include all the following described property in the City of Salina, Kansas, to -wit:
Benefit District.-
Lots
istrict:Lots 1 through 7 and Lots 15 through 23, Bloc k 10,
Belmont Addition to the City of Salina, Kansas.
Section 6. It is necessary and it is hereby ordered that an eight inch v. C. t. Latera]
Sanitary Sewer with all necessary connections, manholes, flushing tanks and other
be constructed and built in and to serve said Lateral Sanitary Sewer District Number 425 as
created by Section 5 of this ordinance along the following course, to -wit:
An eight inch clay pipe sewer beginning at an existing
manhole which is in line with the utility easement through
Block 10, and 10 feet north of the south line of Belmont
Boulevard, thence south along the center line of easement
through Block 10, to a point 10 feet south of the northeast
corner of Lot 23, Block 10, Belmont Addition where a manhole
will be built which will be terminus of Lateral 425.
Section 7. That the City Engineer shall on or before the 17th day of May , 1
prepare and file in the Office of the City Clerk, plans and specifications for the construc
of the Lateral Sanitary Sewers provided for in the preceding sections of this ordinance whicl
shall be of the proper character to serve the property lying within the district for which
such sewer is to be constructed and shall on or before the same date prepare and submit to
the Board of Commissioners a detailed estimate under oath of the cost thereof. That thereafl
the City Clerk shall advertise for three consecutive days in the official city paper for
sealed proposals for the building and construction of such sewers according to such plans
and specifications, which proposals shall be filed with the City Clerk on or before
the time fixed in such notice, at which time the Board of Commissioners may let a contract
for the building and construction of such sewer to the lowest and best responsible bidder or
bidders therefore, if, there be any whose bids do not exceed the estimated cost thereof, but
said Board shall reserve the right to reject any or all such proposals, and if no bids shall
be received within such estimate, the Board of Commissioners shall have the power to do such
work and make such improvement within the estimated cost thereof as provided by law.
Section 8. That for the cost of building and constructing such sewer, special
assessments shall be made for the full cost thereof on all lots and pieces of land within and
for which such sewer shall be built, according to the appraised value thereof, without regard
to the buildings or improvements thereon.
Section 9. After the passage and publication of this ordinance, the Board of Commiss
shall appoint three disinterested appraisers, who after having taken oath to make a true and
impartial appraisement of all lots and pieces of land liable to taxation for the cost of such
improvements shall within five days after having been notified of their appointment proceed
to appraise all of the lots and pieces of land within the district liable to assessment and
taxation as aforesaid, without regard to the buildings or improvements thereon, and after
making such appraisement shall return to the Board of Commissioners of said City and said
Board shall designate a time for a special meeting of said Board for the purpose of hearing

any complaints that may be made as to the value of any lot or piece of land appraised as
aforesaid of which special session due notice shall be given in the official city paper, at
which special session said Board may alter any valuation of any lot or piece of land, if,
in their opinion the same has been appraised too high or too low.
Section 10. The special assessments herein provided for may be paid by the person liable
therefore in ten approximately equal installments but the owner of any property liable to
such assessment may within thirty days from the date of determining the amount assessed
against the property, pay the same in full and his property so paid on shall not be liable
for any assessments for the cost of such improvements, and bonds as hereinafter provided for
shall be issued in an amount of the cost of such improvements remaining unpaid at the end
of thirty days from the time such assessment is fixed.
Section 11. For the purpose of paying for the work and improvements in this ordinance
provided for, the Board of Cosmissionews may and are hereby authorized and directed to issue
improvement bonds of the City of Salina, Kansas, in an amount not to exceed the total cost
of such improvement, and to run for a period of ten years and be payable in ten approximatel
equal installments, together with interest not to exceed five per cent per annum, which
bonds shall be issued and payable according to law; and for the purpose of paying the
principal and interest on said bonds as they severally become due and payable the Board of
Commissioners shall apportion and assess against the lots and pieces of land within the
taxing district of such improvements, special assessments covering the cost of such
improvement and apportionment therein contained shall hold good for all of the installments
are to be collected from the specific property chargeable therefore, with such improvements;
such assessments and apportionment ordinance shall contain the total amount of tax apportion
to each tract, piece or parcel of land within the taxing district and shall state the number
of annual installments in which such tax is to be collected; and thereafter the City Clerk
shall annually, at the same time that other taxes are certified, certify to theCounty Clerk
of Saline County, Kansas, a full list of all property liable for such work And improvement,
together with the respective numbered amounts due on each of said tracts, pieces or parcels
of land, which amounts shall include the annual installments and interest on all unpaid
balances for one year at the rate of not to exceed five per cent per annum on such amounts
so certified, which amounts shall be collected as other taxes are collectedt
Section 12. This ordinance shall take effect and bar in full force from and after its
adoption and publication once in the official city paper.
