ORDINANCE NUMBER 6441

AN ORDINANCE ratifying and confirming a contract with the grown and grown Construction
Company for the construction of certain improvements on certain streets in the City of
Salina, Kansas, and providing for the issuance of temporary notes to pay the cost thereof
pending the issuance and sale of bonds.
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
Section 1. That the acceptance by the City of Salina, Kansas, of the proposal of the
Brown and Brown Construction Company, hereinafter referred to as the "Contractor" as
submitted to the Board of Commissioners on April 26, 1960, which is hereby found to be the
lowest and best bid for such work, and the contract awarded by the Board of Commissioners
of the City of Salina, Kansas, to said contractor and signed on behalf of the City by its
Mayor on May 3, 1960, for the construction of certain public improvements in the City of
Salina, Kansas, to -wit:
The curbing, guttering, paving and grading of Aullwood
Road with asphalt (Thirty-three (33) feet wide from
back of curb to back of curb) from the south line of
Greeley Avenue to the north line of Brookwood Lane, as
provided for by Resolution Number 2301.
The curbing, guttering, paving and grading of Crawford
Avenue with asphalt (Forty-one (41) feet wide from back
of curb to back of curb) from the east line of Roach
Street to the west line of Ohio Street, as provided for
by Resolution Number 2236.
The curbing, guttering, paving and grading of Eighth Street
with asphalt (Thirty-three (33) feet wide from back of curb
to back of curb) from the south line of Lincoln Avenue to
the north line of the Union Pacific R. R. right-of-wayq
as provided for by Resolution Number 2279.
The paving and grading of Elmore Drive with asphalt
(Twenty-eight (28) feet wide from toe of gutter to toe
of gutter) from the north line of Crawford Avenue to the south
line of Prescott Road, as provided for by Resolution Number 2242.
The paving and grading of Guernsey Drive with asphalt (Twenty-
eight (28) feet wide from toe of gutter to toe of gutter) from
the east line of Front Street to the west line of Prescott Road,
as provided for by Resolution Number 2240.
The curbing, guttering, paving and grading of Ingman Road
with asphalt (Thirty-three (33) feet wide from back of
curb to back of curb) from the south side of Carlton Place
to the north side of Talley Drive, as provided for by
Resolution Number 2235.
The Curbing, guttering, paving and grading of Lewis Street
with asphalt (Thirty-three (33) feet wide from back of curb
to back of curb) from the north line of Crawford Avenue
to the south line of Prescott Road, as provided for by
Resolution Number 2239.
The curbing,guttering, paving and grading of Northwood Lane
with asphalt (Thirty-three (33) feet wide from back of
curb to back of curb) from the east line of Marymount Road
to the west line of Aullwood Road, as provided for by
Resolution Number 2302.
The curbing, guttering, paving and grading of Page Avenue
with asphalt (Thirty-three (33)fset wide from back of curb
to back of curb) from the south line of Carlton Place to
the north side of Talley Drive, as provided for by Resolution
Number 2234.

The pawl*$ and grading of Prescott Road with asphalt
(Twenty-eight (28) feet wide from toe of gutter to
toe of gutter) from the east line of Front Street to
the east line of Roach Street, as provided for by
Resolution Dumber 2237.
The curbing, guttering, paving and grading of Prescott
Road with apphalt (Thirty-three (33) feet wide from back
of curb to back of curb) from the east line of Roach
Street to the west line of Ohio Street, as provided for
by Resolution Number 2238.
The paving and grading of Roach Street with asphalt
(Twenty-eight (28) feet wide from toe of gutter to
toe of gutter) from the north line of Crawford Avenue
to the south line of Prescott Road, as provided for by
Resolution Number 2241.
at and for the unit price for said work contained in said proposal, which proposal and
contract are hereby referred to and made parts of this ordinance, be and the same is hereby
ratified and confirmed, said proposal being within the estimated cost of said improvements
as shown by the sworn estimates of the City Engineer on file in the Office of the City Cler
which estimates are hereby referred to and made a part of this ordinance.
Section 2. Said improvements shall be built and constructed in accordance with the
plans and specifications therefore prepared by the City Engineer on file in the Office of
the City Clerk and in accordance with the proposal of Maid contractor and under the terms
of said contract, all of which are hereby referred to and made a part of this ordinance.
Section 3. That temporary notes signed by the Mayor and attest by the City Clerk be
issued from time to time as the work progresses in the manner and form as required by law,
to bear interest not to exceed 5 per cent per annum and to mature not later than December 1,
1961, and to be issued in such amounts and at such times as the money for the payment of the
cost of such notes being issued to said contractor and to be redeemed and cancelled at the
time that payment bonds are issued in lieu thereof.
Section 4. That this ordinance shall take effect and be in full force from and after
its adoption and publication once in the official city paper.
