6440 Utility Imp - Indian RockCONSOLIDATHD-SALINA ORDINANCE NMMZR 6440 (Published in The Salina Journal , 1960) AN ORDINANCE creating and defining certain lateral sanitary sewer districts in the City of Salina, Kansas, designated as Lateral Sanitary Sewer Districts Number 421 and 422 and pumping station, and providing for the construction of lateral sanitary sewers and pumping station in said Lateral Sanitary Sewer Districts Number 421 and 422 and pumping station , soil l created and providing for the payment of the cost thereof and for the levying of special assessments against the property in said district for the payment of the cost of such i coslatruction and for the issuing of bonds to pay the cost thereof. BE IT ORDAINED by the Board of C- issioners of the City of Salina, Kansas: Section 1. Lateral Sanitary Sewer District Number 421. That there be and there is Ihereby created Lateral Sanitary Sewer District in the City of Salina, Kansas, which shall be I and it is hereby desipated as Lateral Sanitary Sewer District Number 421, and which district shall include All the following described property in the City of Salina, Kansas, to -wit: Benefit District: j All of Block 5, Indian Rock Addition, City of j Salina, Kansas. i Section 2. It is necessary and it is hereby ordered that an eight inch V. Co P. Lateral Sanitary Sewer with all necessary connections, manholes, flushing tanks and other appurtenances be constructed and build in and to serve said Lateral Sanitary Sewer District jNumber 421 as created by Section 1 of this ordinance along the following course, to -wit: (1) An 8 inch clay pipe sewer beginning at an existing i manhole in Ohio Street which is a wet well for pumping station opposite the easement common to Lots 10, 11, in Block 5, Indian Rock Addition. I (2) thence east along said easement in Block 5 to the corner of said Lot 10 where manhole "A" will be constructed, i (3) thence south from manhole "A" to the south line of Westchester Drive, (4) beginning again at manhole "A', thence north along center line of easement to the south line of Indian Rock Lane where a manhole will be constructed which will be the terminus of Lateral 421. i Section 3. Lateral Sanitary Sewer District Number 422. That there be and there is I hereby created Lateral Sanitary Sewer District in the City of Salina, Kansas, which shall be' and it is hereby designated as Lateral Sanitary Sewer District Number 422, and which distric shall include all the following described property in the City of Salina, Kansas, to -wit: I Benefit District: Lots 1 to 13 inclusive in Block 1 and all of Block 2; all in Indian Rock Addition, City of Salina, Kansas Section 4. It is necessary and it is hereby ordered that an eight inch V. C. P. i Lateral Sanitary Sewer with all necessary connections, manholes, flushing tanks and other appurtenances be constructed and built in and to servo said Lateral Sanitary Sewer District j Number 422 as creatdd by Section 3 of this ordinance along the following course, to -wit: (1) An eight inch clay pipe sewer beginning at an existing manhole on the south line of Indian Rock Lane and the north j and south easement of Block 5, of Indian Rock Addition, (2) thence northwesterly across Indian Rock Lane to easement on east line of Lot 1, Block 1 of said Addition, CONSOLIDATED -SALIVA 1 1 (3) thence north along the center line of said easement on east side of said Lot 1 to a point 7 feet south of the northeast corner thereof, (4) thence east and easterly following the center lines of the easements in Blocks 1 and 2 to a point at the southwest corner of Lot 7, Block 2 of said Indian Rock Addition where a manhole will be constructed which will be the terminus of Lateral 422. Section 5. Sanitary Sewer Pumping Station District. That there be and there is hereby created Sanitary Sewer Pumping Station District to serve all of Indian Rock Addition in the City of Salina, Kansas, which district shall include all of the following described property] to -wit: Benefit District: All of Indian Rock Addition, City of Salina, Kansas. Section 6. It is necessary and it is hereby ordered that a Sanitary Sewer Pumping Station be constructed in the east parking of Ohio Street directly in line with the easement wAfch is common to lots 10, 11, 14, and 15, of Block 5, Indian Rock Addition, to serve all of Indian Rock Addition as created by Section 5 of this ordinance. Section 7• That the City Zngineer shall on or before the 10th day of May 1960, prepare and file in the office of the City Clerk, plans and specifications for the construction of the lateral sanitary sewers and pumping station provided for in the precedinj sections of this ordinance which shall be of the proper character to serve the property lying within the district for which such sewer is to be constructed and shall on or before the same date prepare and submit to the Board of Commissioners a detailed estimate under oat] of the cost thereof. That thereafter the City Clerk shall advertise for three consecutive days in the official city paper for sealed proposals for the building and construction of such a sewer according to such plans and specifications, which proposals shall be filed with the City Clerk on or before the time fixed in such notice, at which time the Board of Om mitsioners may let a contract for the building and construction of such sewer to the lowest and best responsible bidder or bidders therefore, if, there be any whose bids do not exceed the estimated cost thereof, but said Board shall reserve the right to reject any or all such proposals, and if no bids shall be received within such estimate, the Board of Cissioners shall have the power to do such work and make such improvement within the estimated cost thereof as provided by law. Section 8. That for the cost of building and constructing such sewer, special assessments shall be made for the full cost thereof on all lots and pieces of land within and for which such sewer shall be built, according to the appraised value thereof, without regard to the buildings or improvements thereon. CONSOLIDATED-SALINA 1 i Section 9. After the passage and publication of this ordinance, the Board of Commissioners shall appoint three disinterested appraisers, who after having taken oath to make a true and!; impartial appraisement of all lots and pieces of land liable to taxation for the cost of such improvements shall within five days after having been notified of their appointment proceed to appraise all of the lots and pieces of land within the district liable to assessment and taxation as aforesaid, without regard to the buildings or improvements thereo and after making such appraisement shall return to.the Board of Commissioners of said City and said Board shall designate a time for a special meeting of said Board for the purpose of hearing any complaints that may be made as to the value of any lot or piece of land appraise as aforesaid of which special session due notice shall be given in the official city paper, at which special session said Board may alter any valuation of any lot or piece of land, if, in their opinion the same has been appraised too high or too low. Section 10. The special assessments herein provided for may be paid by the person liable therefore in ten approximately equal installments but the owner of any property liabl to such assessment may within thirty days from the date of determining the amount assessed against the propetty, pay the same in full and his property so paid on shall not be liable fDr any assessments for the cost of such improvements, and bonds as hereinafter provided for shall be issued in any amount of the cost of such improvements remaining unpaid at the end of thirty days from the time such assessment is fixed. Section 11. For the purpose of paying for the work and improvements in this ordinance provided for, the Board of Commissioners may and are hereby authorized and directed to issue improvement bonds of the City of Salina, Kansas, in an amount not to exceed the total cost of such improvement, and to run for a period of ten years and be payable in ten approximatel equal annual installments, together with interest not to exceed five per cent per annum i which bonds shall be issued and payable according to law; and for the purpose of paying the principal and interest on said bonds as they severally become due and payable the Board of commissioners shall apportion and assess against the lands and pieces of land within the taxing district of such improvements, special assessments covering the cost of improvement and apportionment therein contained shall hold good for all of the installments that are to be collected from the specific property chargeable therefore, with such improvements, such assessments and apportionment ordinance shall contain, the total amount of tax apportioned to each tract, piece or parcel of land within the taxing district and shall state the number of annual installments in which such tax is to be collected, and thereafter the City Clerk shall., mmaally, at the same time that other taxes are certified, certify to the County Clerk of Saline County, Kansas, a full list of all property liable for such work and improvement, ., CONSOLIDATED-SALINA 1 1 1 together with the respective numbered amounts due on each of said tracts, pieces or parcels of land, which amounts shall include the annual installments and interest on all unpaid balances for me year at the rate of not to exceed five per cent per annum on such amounts so certified, which amounts shall be collected as other taxes are collected. Section 12. This ordinance shall take effect and be in full force from and after its adoption and publication once in the official city paper.
