ORDINANCE NUMBER 6438

AN ORDINANCE creating and defining certain lateral sanitary sewer districts in the City of
Salina, Kansas, designated as Lateral Sanitary Sewer Districts Numbered 417, 418 and 419,
and providing for the construction of Lateral Sanitary Sewers in said Lateral Sanitary Sewer
Districts Numbered 417, 418 and 419, so created and providing for the payment of the cost
thereof and for the levying of special assessments against the property in said district
for the payment of the cost of such construction and for the issuing of bonds to pay the
cost thereof.
BE IT ORDAINED by the Board of Co issioners of the City of Salina, Kansas:
Section 1. Lateral Sanitary Sewer District Number 417. That there be and there is
hereby created Lateral Sanitary Sewer District in the City of Salina, Kansas, which shall bele

and it is hereby designated as Lateral Sanitary Sewer District Number 417, and which district
shall include all the following described property in the City of Salina, Kansas, to -wit:
Benefit District:
Lots 1, 2, 3, Block 8; All of Block 7; All of Block 11;
Lots 1, 4, 6, 8, 10, 12, 14, 16, 18, 20, and 22 of Block
10; All in Gebhart Manor Addition to the City of Salina,
Kansas.
Section 2. It is necessary and it is hereby ordered that an eight inch V. C. P. La
Sanitary Sewer with all necessary connections, manholes, flushing tanks and other
appurtenances be constructed and built in and to serve said Lateral Sanitary Sewer District
Number 417 as created by Section 1 of this ordinance along the following course, to -wit:
(1) An eight inch Clay pipe sewer beginning by constructing
a manhole over an existing 10 inch clay pipe sewer which is
in the intersection of Wayne Avenue and Leland Way,
(2) thence north with an 8 inch clay pipe sewer on a line
10 feet west of the center line of Leland Way to a point
70 feet south of the south line of Albert Avenue where a
manhole will be built which will be the terminus of Lateral 417.
Section 3. Lateral Sanitary Sewer District Number 418. That there be and there is
hereby created Lateral Sanitary Sewer District in the City of Salina, Kansas, which shall be!
and it is hereby designated as Lateral Sanitary Sewer District Number 418, and which district
shall isieel6de all the following deseribed property in the City of Salina, ""I' to0wit:
Benefit District:
Lots 2, 3, 5, 7, 9, 11, 13, 15, 17, 19, 21, 23, and 24,
Block 10 and Lots 7, 8, 9, 10, 11, 12, 13, 14, 15, 16,
17, 18, 19, and 20 of Block 8, All in Gebhart Manor
Addition to the City of Salina, Kansas.
Section 4. it is necessary and it is hereby ordered that an eight inch V. C. T.
Sanitary Sewer with all necessary connections, manholes, flushing tanks and other
appurtenances be constructed and built in and to serve said Lateral Sanitary Sewer District
Number 418 as created by Section 3 of this ordinance along the following course, to -wit:
(1) An eight inch clay pipe sewer beginning at a manhole to
be constructed over an existing 10 inch sewer which is in the
intersection of Wayne Avenue and Raymond Avenue,
(2) thence north with an 8 inch clay pipe sewer on a line
10 feet west of the center line of Raymond Avenue to a point
160 feet east of the east line of Leland Way where a manhole will
be built which will be the terminus of Lateral 418.

Section 5. Lateral Sanitary Sewer District Number 419. That there be and there is
hereby created Lateral Sanitary Sewer District in the City of Salina, Kansas, which shall be
and it is hereby designated as Lateral Sanitary Sewer District 419, and which district shall
include all the following described property in the City of Salina, Kansas, to -wit:
Benefit District:
Lots 4, 5, and 6 of Block 8; Lots 1, 2, 3, 4, 5, 6,
7, 8, 9, 10, 11, 12, 13, 14, 15, 16, 17, 18, 19, 20,
and 21 of Block 9, All in Gebhart Manor Addition to the
City of Salina, Kansas.
Section 6. It is iecessary and it is hereby ordered that anfeight inch V. C. P. Latera
Sanitary Sewer with all necessary connections, manholes, flushing tanks and other
appurtenances be constructed and built in and to serve said Lateral Sanitary Sewer District
Number 419 as created by Section 5 of this ordinance along the following course, to -wit:
(1) An eight inch clay pipe sewer beginning at a manhole
to be constructed over an existing 10 inch sewer at the
intersection of Wayne Avenue and 10 feet east of the west
property line of Quincy Avenue,
(2) thence north on a line 10 feet east of the west line
of Quincy Avenue to the center line of Leslie Avenue,
(3) thence west 140 feet,
(4) thence north along the center line of easement at the
back of Lots 5 and 6, Block 9 to the southeast corner of
Lot; 3 of said Block,
(5) thence west along the center line of easement at the
back of Lots 1, 2, and 3, of Block 9, and Lots 4, 5, and 6,
of Block 8, to a point 20 feet west of the east lime of
Lot 4, Block 8 of said Addition.
Section 7. That the City Engineer shall on or before the 10th day of May" , 1
prepare and file in the office of the City Clerk, plans and specifications for the
construction of the Lateral Sanitary Sewers provided for in the preceding sections of this
ordinance which shall be of the proper character to serve the property lying within the
district for which such sewer is to be constructed and shall on or before the same date
prepare and submit to the Board of Commissioners a detailed estimate under oath of the cost
thereof. That thereafter the City Clerk shall advertise for three eenseetUse days in the
official city paper for sealed proposals for the building and construction of such sewers
according to such plans and specifications, which proposals shall be filed with the City
Clerk on or Wore the time fixed is such notice, at which time the Board of Commissions
may let a contract for the building and construction of such sewers to the lowest and best
responsible bidder or bidders therefore, if, there be any whose bids do not exceed the
estimated cost thereof, but said Board shall reserve the right to reject say or all such
proposals, and if no bids shall be received within such estimate, the Bard of Gosmissiomsrs
shall have the power to do such work and make such improvements within the estimated cost
thereof as provided by law.

Section S. That for the cost of building and constructing such sewer, special

assessments shall be made for the full cost thereof on all lots and pieces of land within
and for which such sewer shall be built, according to the appraised value thereof, without
regard to the buildings or improvements thereon.
Section 9. After the passage and publication of this ordinance, the Board of
Commissioners shall appoint three disinterested appraisers, who after having taken oath to
make a true and impartial appraisement of all lots and pieces of land liable to taxation for
the cost of such improvements shall within five days after having been notified of their
appointment proceed to appraise all of the lots and pieces of land within the district
liable to assessment and taxation as aforesaid, without regard to the buildings or
improvements thereon, and after making such appraisement shall return to the Board of
Commissioners of said City, and said Board shall designate a time for the special meeting
of said Board for the purpose of hearing any complaints that may be made as to the value of
any &ot or pieee of land appraised as aforesaid, of which special session due notice shall
be given in the official city paper, at which special session said Board may alter any
valuation of any lot or piece of land, if, in their opinion the same has been appraised
too high or boo low.
Section 10. The special assessments herein provided for may be paid by the person
liable therefore in ten approximately equal installments but the owner of any property liabl
to such assessment may within thirty days from the date of determining the amount assessed
against the property, pay the same in full and his property so paid on shall not be liable
for any assessments for the cost of such improvements, and bonds as hereinafter provided for
shall be issued in an amount of the cost of such improvements remaining unpaid at the end of
thirty days from the time such assessment is fixed.
Section 11. For the purpose of paying for the work and improvements in this ordinance
provided for, the Board of Co issioners may and are hereby authorized and directed to issue
improvements Bonds of the City of Salina, Kansas, in an amount not to exceed the total cost
of such improvement, and to run for a period of ten years and be payable in ten approximatel
equal annual installments, together with interest not to exceed five per cent per annum,
which bonds shall be issued and payable according to law; and for the purpose of paying the
principal and interest on said bonds as they severally become due and payable the Board of
Co issioners shall apportion and assess against the lands and pieces of land within the
taxing district of such improvements, special assessments covering the cost of such
improvement and apportionment therein contained shall hold good for all of the installments
are to be collected fwm the specific property chargeable therefore, with such improvements;
assessments and apportionment ordinance shall contain the 606al amatiat of tax apportioned
to each tract, piece or parcel of land within the taxing district and shall state the number

of annual installments in which such tax is to be collected; and thereafter the City Clerk
shall annually, at the same time that other taxes are certified, certify to the County C1erkl
of Saline County, Kansas, a full list of all property liable for such work and improvement,
together with the respective numbered amounts due on each of said tracts, pieces or parcels
of land, whisk amounts shall include the annual installments and interest on all unpaid
balances for one year at the rate of not to exceed five per cent per annum on such amounts
so certified, which amounts shall be collected as other taxes are collected.
Section 12. This ordinance shall take effect and be in full force Iron and after its
adoption and publication once in the official city paper.
