curb, gutter, pave and grade Rahm Street with concrete (Thirty-three (33) feet wide from back of curb to back of curb) from the east line of Fourth Street to the east line of Third Street; WHEREAS, each of the said Resolutions were published for six days in the Salina Journal, a daily newspaper, published in the said City, and being the official city paper, and the majority of the resident property owners owning a ujerity of the square feet of the lots or real estate liable to taxation for the cost of said improvements and did not within twenty days from the date of the last publicatian thereof file with the City Clerk a suffic protest in wtttIV4 against the making of said improvements, no protests of any kind having bees! filed, SO NOW, THEREFORE BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That it is necessary and it is hereby ordered that Hazel Court, from the west line of Ohio Street to the north line of Greeley Avenue, in said City, be curbed, gut paved and graded with cosetete (Thirty-three (33) feet wide from back of curb to back of c with excavation thereof, and graded to the established paving grades and paved between the guttering lines thereof. Section 2. That it is necessary and it is hereby ordered that Clark Street, from the south line of Spruce Street to the south line of Lot 8, Block 6, Walnut Grove Addition, in said City, be paved and graded with concrete (Twenty-eight (28) feet wide from toe of gutter to toe of gutter) with excavation thereof,and graded to the established paving grades and paved between the guttering lines thereof. Section 5. That it is necessary and it is hereby ordered that College Avenue, from the north line of South Street to the north line of Morrison Avenue, in said City, be paved and graded with concrete (Twenty-eight (28) feet wide from toe of gutter to toe of gutter) with excavation thereof, and graded to the established paving grades and paved between the guttering lines thereof. Section 6. That it is necessary and it is hereby ordered that Franklin Street, from the west line of Sherman Street to the east line of Custer Street, in said City, be paved graded with concrete (Twenty-eight (28) feet wide from toe of gutter to toe of gutter) with excavation thereof, and graded to the established paving grades and paved between the guttering lines thereof. Section 7. That itis necessary and it is hereby ordered that Franklin Street, from the west line of Sheridan Street to the east line of Merrill Avenue, in said City, be paved and graded with concrete (Twenty-eight (28) feet wide from toe of gutter to toe of gutterq with excavation thereof, and graded to the established paving grades and paved between the guttering lines thereof. Section 8. That it is necessary and it is hereby ordered that Illinois Street, from the east line of Sheridan Street to the west line -of Custer Street, in said City, be paved and graded with concrete (Twenty-eight (28) feet wide from toe of gutter to toe of gutter) with excavation thereof, and graded to the established paving grades and paved between the guttering lines thereof. Section 9. That it is necessary and it is hereby ordered that Lewis Street, from the south line of Belmont Boulevard to the south line of Lot 19, Block 9, Belmont Addition, in said City, be paved and graded with concrete (Thirty-three (33) feet wide from back of curb to back of curb) with excavation thereof, and graded to the established paving grades and paved between the guttering lines thereof. Section 16. That it is necessary and it is hereby ordered that Lewis Street, from the north line of Manor Road to the south line of Millwood Drive, in said City, be curbed, gut paved and graded with concrete (Thirty-three (33) feet wide from back of curb to back of with excavation thereof, and graded to the established paving grades and paved between the guttering lines thereof. That it is necessary and it is hereby ordered that Martin Avenue, from the west line of Beatrice Avenue to the west line of Ohio Street, in said City, be paved and graded with concrete (Twenty-eight (28) feet wide from toe of gutter to toe of gutter) with excavation thereof, and graded to the established paving grades and paved between the guttering.lines thereof. Section 12. That it is necessary and it is hereby ordered that Ohio Street, from the south line of Wayne Avenue to the south line of Oxford Drive, in said City, be paved and graded with concrete (Thirty-three (33) feet wide from back of curb to back of curb) with excavation thereof and graded to the established paving grades and paved between the guttering lines thereof. Section 13. That it is necessary and it is hereby ordered that Overbill Road, from the! south line of Country Club Road to the east line of fairdale Road, in said City, be paved and graded with concrete (Twenty -(20) feet wide from toe of gutter to toe of gutter) with excavation thereof and graded to the established paving grades and paved between the guttering lines thereof. Section 14. That tt is necessary and it is hereby ordered that Pearl Street, from the south line of Belmont Boulevard to the south line of Lot 18, Block 10, Belmont Addition, in said City, be paved and graded with concrete (Thirty-three (33) feet wide from back of curb to back of curb) with excavation thereof and graded to the established paving grades and paved between the guttering lines thereof. Section 15. That it is necessary and it is hereby ordered that Prescott Avenue, ffou the east lisle of Twelfth Street to the east line of Phillips Street, in said City, be paved and graded with concrete (Twenty-eight (28) feet wide from toe of gutter to toe of gutter) with excavation thereof, and graded to the established paving grades and paved b the guttering lines thereof. Section 16. That it is necessary and it is hereby ordered that Republic Avenue, from the west line of Beatrice Street to the west line of Ohio Street, in said City, be paved and graded with concrete (Twenty-e*ght (29) feet wide from toe of gutter to toe of gutter) with excavation thereof, and graded to the established paving grades and paved between the guttering lines thereof. Section 17. That it is necessary and it is hereby ordered that Stack Avenue , from the east line of Connecticut to the west line of Delaware, in said City, be paved and graded with concrete (Twenty-eight (28) feet wide from toe of gutter to toe of gutter) with excavation thereof, and graded to the established paving grades and paved between the guttering lines thereof. Section 18. That it is necessary and it is hereby ordered that North Third Street, from the south line of Pacific Avenue to the north line of Woodland Avenue, in -said City, be paved and graded with concrete (Twenty-eight (28) feet wide from toe of gutter to toe of gutter) with excavation thereof, and graded to the established paving grades and paved betwe the guttering lines thereof. That it is necessary and it is hereby orderdd that Venanso Street, from the east line of Custer Street to the west line of Sherman Street , in said City, be paved and graded with concrete (Twenty-eight (28) feet wide from toe of gutter to toe of gutter) with excavation thereof, and graded to the established paving grades and paved between the guttering lines thereof. Section 20. That it is necessary and it is hereby ordered that Venango Street, from the west line of Skerida# Street to the east line of Merrill Street, in said City, be paved and graded with concrete (Twenty-eight (28) feet wide from toe of gutter to toe of gutter) with excavation thereof, and graded to the established paving grades and paved between the guttering lines thereof. Section 21. That it is necessary and it is hereby ordered that Venango Street, from the west line of Sheridan Street to the east line of Custer Street, in said City, be paved and graded with concrete (Twenty-eight (28) feet wide from toe of gutter to toe of gutter) with excavation thereof, and graded to the established paving grades and paved between the g uttering lines thereof. Section 22. That it is necessary and it is hereby ordered that Wayne Avenue, from the west line of Quincy Street to the east right-of-way line of the Union Pacific Railroad, in said City, be curbed, guttered, paved and graded with concrete (Twenty-eight (28) feet wide from book of curb to back of curb) with excavation thereof, and graded to the esbablished paving grades and paved between the guttering lines thereof. Section 23. That it is necessary and it is hereby ordered that Wilson Avenue, from the west line of Ninth Street to the east line of Tenth Street, in said City, be paved and graded with concrete (Twenty-eight (28) feet wide from toe of gutter to toe of gutter) with excavation thereof, and graded to the established paving grades and paved between the guttering lines thereof. Section 24. That it is necessary and it is hereby ordered that Second Street, from a point 28 feet south of the north line of Lot 15, Block 6, Hutchinson's Addition to the south line of Lot 19, of said Block, in said City, be curbed and guttered and graded with.concrete with excavation thereof, and graded to the established paving grades. Section 25. That it is necessary and it is hereby ordered that Rahn Street, from the east line of fourth Street to the east line of Third Street, in said City, be curbed, guttered, paved and graded with concrete (Thirty-three (33) feet wide from back of curb to back of I curb) with excavation thereof and graded to the established paving grades and paved between the guttering lines thereof. Section 26. That for the work and improvamabs herein provided for the City Engineer ahAell make and file with the City Clerk on or before thedaq ofj , 1960, complete i plans and specifications for the curbing, guttering, paving and grading with excavation necessary therefore, of each of the streets or portions thereof described in Sections 1 to 25, both includive, of this ordinance, with the following type of improvements: CONSOLIDATED-SALINA 1 1 1 Concrete combined curb and gutter on each side thereof, 30 inches wide from back of curb to 1paving lite, curb 12 inches deep at back, guttering 6 inches ddep, and the necessary grading of each to the established paving grade, and paving thereof with 6 inch reinforced concrete, providing that in the event of the non- availability of reinforced material that then said pavement shall be constructed with concrete to a depth of 7k inches between the curb and gutter line on each side thereof and within the limits of said streets hereinbefore described. and said Engineer shall on or before the same date, submit to the Board of Commissioners under oath, detailed estimates of the cost of such work and improvements. Section 27. That after such plans and specifications have been made and prepared by City Engineer and filed with the City Clerk as aforesaid, the Board of Commissioners may advertise published advertisements in the official city paper of the City of Salina, Kansas, for three consecutive days for the receipt of sealed proposals for the improving of said streets with the kind of material named and specified in the preceding section hereof, and for the excavation and grading necessary for the completion of said work,and after the receipt of such proposals, the Board of Commissioners may and are hereby authorized and directed to let contracts for the improving of said street s with the materials selected by them to the lowest responsible bidder or bidders thereof, as determined by the Board of Commissioners, and for such excavation and grading. Said Board reserves the right to reject any or all bids. Section 28. That for the improving of the above mentioned streets, such ass shall be made for'the full cost thereof according to law on all lots and pieces of land to the center of the block on either side of the streets to be improved according to the appraisers valuation thereof, without regard to the buildings or improvements thereon for the distance to be improved. Section 29. After the passage and publication of this ordinance, the Board of Commissioners shall appoint three disinterested appraisers, householders, who after having taken an oath to make a true and impartial appraisement, of all lots and pieces of land liable to assessment and taxation as aforesaid, as may be designated by the Board of Commissioners of the City of Salina, without regard to the buildings or improvements thereon and after making such appraisement shall return to the Board of Commissioners of said City and said Board of Commissioners shall designate a time and place for the hearing any complaints that may be made as to the value of any lots and pieces of land appraised as aforesaid, of which due notice shall be given in the official city paper, at which hearing the Board of Commissioners may alter any valuation of any lot or piece of land, if, in thei ep*nion the same hat been appraised too high or too low. f CONSOLIDATED-SALINA LJ C7 Section 30. That for the purpose of paying the cost of the work and improvements in this ordinance provided for, the Board of Commissioners are hereby authorized and directed to issue internal improvement bonds of the City of Salina, in an amount not to exceed the contract price for the cost of such improvements and to run for a period of ten years and be payable is -test equal installments, together with interest not to exceed five per cent per annum, which bonds shall be made payable at the Fiscal Agency of the State of Kansas and for the purpose of paying the principal and interest on said bonds as they severally become due and pgyahle the Board of Commissioners shall apportion and assess against the lots and pieces of land witWA the taxing district of such improvements special assessments covering the cost of such improvements and the apportionment herein contained shall hold good for all of the installments that are to be collected from the specific property chargeable with said improvements, Such assessments and apportionment ordinance shall contain the total amount of tax apportioned to each tract, piece or parcel of land within the taxing district and shall state the number of annual installments in which such tax is t o be collected; and thereafter the City Clerk shall annually, at the same time other taxes are certified, certify to the County Clerk of Saline County, Kansas, a full list of all property liable to such work and assessments, together with the respective amounts due on each of said haste, pieces of laud, which amounts shall include the annual installments and interest on all unpaid balances for one year at the rate of not to exceed five per cent (5%) per annum on such amounts so certified which shall be collected as other taxes are collected; PROVIDED, that for the purpose of defraying the cost of improving the intersections and areas formed by the ee iug of streets and alleys, and for the grading of said streets where the same is provided for in this ordinance as well as where the improveme is thaough or adjaeeat to property of the City for which the City is liable, the assessment will be made against all taxable property of the City of Salina and paid by the City ar larg#. Section 31. That this ordinance shall take effect and be in full force from and after its adoption and publication once in the official city paper.
