R. right-of-way; paving and grading of Elmore Drive with asphalt (Twenty-eight (28) feet wide from toe of gutter to toe of gutter) from the north line of Crawford Avenue to the south line of Prescott Road; paving and grading of Guernsey Drive with asphalt (Twenty-eight (28) feet wide from toe of gutter to toe of gutter) from the east line of Front Street to the west line of Prescott Road; curbing, guttering, paving and grading of Ingman Road with asphalt (Thirty-three (33) feet wide from back of curb to back of curb) from the south side of Carlton Place to the north side of Talley Drive; curbing, guttering, paving and grading of Lewis Street with asphalt (Thirty-three (33) feet wide from back of curb to back of curb) from the north line of Crawford Avenue to the south line of Prescott Road; curbing, guttering, paving and grading of Northwood Lane with asphalt (Thirty-three (33) feet wide from back of curb to back of curb) from the east line of Marymount Road to the west line of Aullwood Road; curbing, guttering, paving and grading of Page Avenue with asphalt (Thirty-three (33) feet wide from back of curb to back of curb) from the south line of CarAtom Place to the north side of Talkey Drive; paving and grading of Prescott Road with asphalt (Twenty-eight (28) feet wide from toe of gutter to toe of gutter) from the east line of Front Street to the east line of Roach Street; curbing, guttering, paving and grading of Prescott Road with asphalt Vhirty-three (33) feet wide from back of curb to back of curb) from the east line of Roach Street to the west line of Ohio Street; paving and grading of Roach Street with asphalt (Twenty-eight (28) feet wide from toe of gutter to toe of gutter) from the north line of Crawford Avenue to the south line of Prescott Road; and providing for the payment of the cost thereof, and how the same shall be assessed and the manner of the payment of the cost thereof. WHEREAS, by Resolution Numbers 2301, 2236, 2279, 2242, 2240, 2235, 2239, 2302, 2234, 2237, 2238, 2241, duly adopted on Sausary 26, 1960, October 27, 1959, December 15, 1959 by the Board of Cosaflissioners of the City of Salina, Kansas, have declared that they deem it necessary to curb, gutter, pave and grade Aullwood Road with asphalt (Thirty-three (33) feet wide from back of curb to back of curb) from the south line of Greeley Avenue to the north line of Brookwood Lane; curb, gutter, pave and grade Crawford Avenue with asphalt (Forty-one (41) feet wide from back of curb to back of curb) from the east line of Roach Street to the west line of Ohio Street; curb, gutter, pave and grade Eighth Street with asphalt (Thirty-three (33) feet wide from back of curb to back of curb) from the south line of Lincoln Avenue to the north line of the Union Pacific R. WHEREAS, said Resolutions were published in The Salina Journal for six days, a daily news- paper, published in said City, and being the official city paper, and the majority of the resident property ownere owning a majority of square feet of the lots or real estate liable to taxation for the cost of said improvements did not within twenty days from the date of the last publication thereof file with the City Clerk sufficient protest in writing against the making of said improvements, no protests of any kind having been filed, SO NOW, THEREFO BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: CONSOLIDATED-SALINA Section 1. That it is necessary and it is hereby ordered that Aullwood Road, from the south line of Greeley Avenue to the north line of Brookwood Lane, in said City, be curbed, I guttered, paved and graded to the established paving grade (Thirty-three (33) feet wide from back of curb to back of curb) with asphalt and paved between the guttering lines thereof. Section 2. That it is necessary and it is hereby ordered that Crawford Avenue, from I the east line of Roach Street to the west line of Ohio Street, in said City, be curbed, I guttered, paved and graded to the established paving grade (forty-one (41) feet wide from I back of curb to back of curb) with asphalt and paved between the guttering lines thereof. Section 3. That it is necessary and it is hereby ordered that Eighth Street, from the south line of Lincoln Avenue to the north line of the Union Pacific R. R. right-of-way, in i said City, be curbed, guttered, paved and graded to the established paving grade (Thirty- three (33) feet wide from back of curb to back of curb) with asphalt and paved between the guttering lines thereof. Section 4. That it is necessary and it is hereby ordered that Elmore Drive, from the north line of Crawford Avenue to the south line of Prescott Road, in said City, be paved and graded to the established paving grade (Twenty-eight (28) feet wide from toe of gutter t4 I toe of gutter) with asphalt, and paved between the guttering lines thereof. Section 5. That it is necessary and it is hereby ordered that Guernsey Drive, from the east line of front Street to the west line of Prescott Road, in said City, be paved and graded to the established paving grade (Twenty-eight (28) feet wide from toe of gutter to I toe of gutter) with asphalt, and paved between the guttering lines thereof. Section i. That it is necessary and it is hereby ordered that Ing*an Road, from the south line of Carlton Place to the north side of Talley Drive, in said City, be curbed, i guttered, paved and graded to the established paving grade (Thirty-three (33) feet wide from back of curb to back of curb) with asphalt, and paved between the guttering lines thereof. Section 7. That it is necessary and it is hereby ordered that Lewis Street, from the north line of Crawford Avenue to the south line of Prescott Road, in said City, be curbed, guttered, paved and graded to the established paving grade (Thirty-three (33) feet wide from back of curb to back of curb) with asphalt, and paved between the guttering lines thereof. I Section 8. That it is necessary and it is hereby ordered that Northwood Lan*, from the east line of Marymount Road to the west line of Aullwood Road, in said City, be curbed, guttered, paved and graded to the established paving grade (Thirty-three (33) feet wide from back of curb to back of curb) with asphalt, and paved between the guttering lines thereof. Section 9. That it is necessary and it is hereby ordered that Page Avenue, from the south line of Carlton Place to the north side of Talley Drive, in said City, be curbed, guttered, paved and graded to the established paving grade (Thirty-three (33) feet wide from I back of curb to back of curb) with asphalt and paved between the guttering lines thereof. I Section 10. That it is necessary and it is hereby ordered that Prescott Road, from the east line of front Street to the east line of Roach Street, in said City, be paved and grades to the established paving grade, (Twenty-eight (28) feet wide from toe of gutter to toe of gutter) with asphalt, and paved between the guttering lines thereof. CONSOLIDATED-$ALINA 1 1 J Section 11. That it is necessary and it is hereby ordered that Prescott Road, from the east line of Reach Street to the west line of Ohio Street, in said City, be curbed, guttered, paved and graded to the established paving grade (Thirty-three (33) feet wide from back of curb to back of curb) with asphalt, and paved between the guttering lines thereof. Section 12. That it is necessary and it is hereby ordered that Roach Street, from the north line of Crawford Avenue to the south line of Prescott Road, in said City, be paved and graded to the established paving grade (Twenty-eight (28) feet wide from toe of gutter to toe of gutter) with asphalt, and paved between the guttering lines thereof. Section 13. That for the work and improvements herein provided for, the City Engineer shall make and file with the dity Clerk on or before the day of,1960, complete plans and specifications for the curbing, guttering, paving and grading with excavation necessary therefore, of the streets described in Sections 1 to 12, of this •rdinance, with the following type of im}revements: Concrete combined curb and gutter on each side thereof 30 inches wide from back of curb to paving line, curb 12 inches deep at back, gutter i inches deep, and the necessary grading of each to the established paving grade between the curb and gutter lines on each side thereof and within the limits of said street, as hereinbefore desctibed; and the necessary grading of each to the established paving grade, and the paving thereof with eight inch hot mimed asphaltic concrete. and said engineer shall on or before the same date, submit to the Board of Commissioners under oath, detailed estimates of the cost of such work and improvements. Section 14. That after such plans and specifications have been made and prepared by City Engineer and filed with the City Clerk as aforesaid, the Board of Ci issioners may advertise by advertisement published in the official city paper of the City of Salina, Kans for three consecutive days for the receipt of sealed proposals for the improving for the improving of said streets with the kind of material named and specified in the preceding sections hereof, and for the excavation and grading necessary for the completion of said work and after the receipt of such proposals, the baid Board of Cossissioners may and are hereby authorized and directed to let contracts for the improving of said streets with the materials selected by them to the lowest responsible bidder or bidders- therefor, as determi by the Board of Commissioners, and for such excavation and grading, said Board reserves the right to reject any and all bids. Section 15. That for the improving of the above,mentioned streets, such assessments shall be made for the full cost thereof according to law, on all lots and pieces of land to the center of the block on eider side of tho street to be improved according to the appraisers valuation thereof, without regard to the buildings or improvements tbareem for the distance to be improved. Section 16. That after the passage and publication of this ordinance, the Board of Commissioners shall appoint three disinterested appraisers, householders, who after having taken an oath to make a true and impartial appraisement of all lots and pieces of land liabl CONSOLIDATED-SALINA 1 to assessment and taxation as aforesaid, as may be designated by the Board of Commissioners of said City, without regard to the buildings or improvements thereon and after making such appraisement shall return to the Board of Commissioners of the City of Salina, and said Board of Commissioners shall designate a time and place for the hearing of any complaints that may be made as to the value of any lots and pieces of land appraised as aforesaid, of which due notice shall be given in the official city paper,: at which hearing the Board of Commissioners may alter any valuation of any lot or piece of land, if, in their opia6an the same has been appraised too high or too low. Section 17. That for the purpose of paying the soot of the work and improvements in this ordinance provided for, the Board of Commissioners are hereby authorized and directed to issue Internal Improvement Bonds of the City of Salina, in an amount not to exceed the contract price or cost of such improvements and to run for a period of ten years and to be payable in ten equal ias6allments, together with interest not to exceed five per cent (5% per annum, which bonds shall be lade payable at the Discal Agency of the State of Kansas and for the purpose of paying the principal and interest on said bonds as the�everally become due and payable, the Board of Commissioners shall apportion and assess against the lots and pieces of land within the taxing district of such improvements special assessments covering the cost of such improvements and the apportionment herein contained shall hold hood for all of the installments that are to be collected from the specific property chargeable with said improvements, such assessments and apportionment ordinance shall contain the .total amounts o tax apportioned to each tract, piece or parcel of land within the taxing district and shall state the number of annual installments in which such tax is to be collected; and thereafter the City Clerk shall annually at the same time other taxes are certified, certify to the County Clerk of Saline County, Kansas, a full list of all property liable for such work and improvements together with the respective amounts due on each of said tracts, pieces or parcels of lane, which amounts shall Anelude the aaawl imetabhosats and interest on all unpaid balances for one year at the rate of not to exceed five per cent per annum on such amounts so certified, which shall be collected as other taxes are collected, PROVIDED, that for the purpose of defraying the cost of UWamfag the intereeatL&w-- and areas formed by th crossing of streets and alleys,; aad for the grading of said streets, where the same is prov for in this ordinance as well as where the improvement is through or adjacent to property of the City for which the City is liable, the assessment will be made against all taxable property of the City of Salina and paid by the City at large.
